The Defendants are charged with £avtrig, on .the night of the 13th of January, kaocked down and robbed John O’Neal of Alleghe oy City*-...; ... ■ s. Johri O’Neal testified that about 10 o’clock on the 13th of January he tnci defendants as he came out Of prinking house, at the Toot of Fifth street, they accosted him very kindly and he entered into conversation with them; they separately told him that they hnd beeo-at the Theatre, and each one told him a different story as to what had been played. This aroused bis suspicions, and he told them lo go theirway--he then- weal into Graham’s, where thoy followed him, and he treated the ;pariv—there were several of them; the dofendauts are two of them; and wheo he came out they each.took his arm—they then went with him up Hand street, and the first thing he knew he received two blows,and something was thrown over his mouth; the one that had him by the left arm run his hands into hia pocket and took his money and said iT he made any noise they would pul a knife into him; after the one had got the money ha started to run; the witness then struggled to get loose and started after him, when one of them/ put his feet before him and ho received a blow from behind, which felled bun to the earth; lie got up again and overtook the person who had his* money, when he drew a kniie and struck at witness, but witness got him down and took the knife from him; when otheraof.themcame running to htsrescue and beat witness severely, and all of them made their escape; witness then came out on to St. Chur street; met a Watchman, but couldn’t do anything; met a. yoong man on the bridge by the name of Smith, to whom he told the circumstances,and he said he knew *be parties, that he had seen them with witness; he . had about $3O stolon from him. There were 6or 7 with him in Graham’s; five of them accompanied him. Jeremiah Lul2, sworn.—Smith, Cavanaugh and myself were at tho Theatre ; after it was out came to the corner of Libert? and St, Clair street ; O’Neal camo outand ashed' them if they would go in and take ft drink ;-we wont into Graham’s; after drink ing; we came out; we then went op towards Liber* ty street; I was then going into the house, and O’Neal coaxed me to lake him home; 1 then start* ed with him ; wo tried to get something at the corner of 6th and Wood ; we then started towards Hand, turned down and crossed over Penn ; when wo got between the bridge And Penn street, the man’s money was taken from him ; tho man turned round and started alter tho fellow who look his money; [asked him what was the matter, and he aaid somebody had taken Ins money; O’Neal and I went to the corner and staid there about ten min* ulcs j ho-started away, and I went down Penn street; did. not notice which way he went; I went towards the St. Clair street bridge ; met Cavanaugh end Smith, there; Smith handed Cavanaugh the money, and told him to keep it; him and Cavanaugh thon went towards homo; Smith and Cavanaugb were with oa when wo 101 l Graham’s ; Smith took the money from O’Neal on Hand street, opposite tho white church ; he took it ont of his coat pocket; none oflhem bad a hold ofO’NcalCavanaugh and I walked along with O’Neal; he .had hold of our arms; Smith walked behind ; wc had walked but a ehorl distance whoa all at once O’Neal wheeled round end said his money had been taken ; didn’t see Smith take tho money from O’Neal, but after* wards saw him hand it to Cavanaugb; I then went home; I leU O’Neal at the corner of Liberty and St.Clasr-atreeif ; did not sec a weopon that night; did not see O’Neal struck. Cross examined. After wc came out ofGraham’s wc stood about 20 minutes before we started wuh O’Neal; I said lot us go home, and then wc started, nod O’Neal came with us to the corner ol Liberty street, and he then asked me to go home with him ; there were six or seven with us at Graham’B; the rest started home before we did ; it was at the cor ner of St. Clair and Liberty that ne took hold of our arms; from the time that we left Sixth and Wood, didn’t see Smith but once; there wero no promises made to me if I would turn State’s evi dence ; I am induced by my love of justice to give evidence; I can’t say whether I will get clear or not; have bten id jail ever since 1 was arrested. Cornelius Lutz, sworn. Tho morning after O’* Neal was robbed, saw Smith near tho bridge; Qsked him what he had been doing las! night,* he said he Usd robbed a man ; said that he had got the money easy; said he had picked (hetnan’s pocket; it was $2O or $26; said ho wanted me to bring Jerry down ; tho same evening saw Smith again at ihc bridge; he aaid he had given Cavanaugh tho tuon «y; he said he didn’t want me to be a witness against him; Smith said that some of the money was marked. H. Graham, sworn. Reside on Penn street ; about II or 22 o’clock at night O’Neal and several boys came to, among whom I recognised Jerry Lutz and Cavanaugh. O’Neal asked them to drink something; there were six besides himself; the whole party started towards the St. Clair si. bridge, where there was a crowd coming along, who were singing. I then retired. 1 >R. Hague testified that he was high constable, and identified two knives which had been taken from Smith and Cavanaugh. Witness then detailed the manner.of their arrest. The Court then adjourned.
