BOLLTUNS dt Gssausins,l Circuit Court United States.— Case for Intringement of Hsa- FS. tatv's Patent Right for casting P•asv, Seim & Co. , Chilled Rollers. Defendant gave an evidence Patent to John C Parry for some purpose. CHARGE OF COURT A question of infringement is one of faet,of which the try are the )udges. The construction of the patent is for the Court. After rending and commenting on the specification of Plaintiff's patent, the Court observed: In doubtful cases it to not the custom of the Court to express any opinion of the facts of the case ; but in this cane the facts are un disputed, and the Court think it is proper to state, as the opinion of both the Judges on the true construction of Plaintiff's Patent, that the Defendant's Patent is a gross and palpable piracy of the Plaintiff's invention. It has evidently been obtained on the ground that it was an improvement on Plaintiff's patented invention, and now seeks to usurp his rights under pretence of an improvement—a pretence which is proved also to he un founded.
