After reading and commenting on the specification of Pluintiff's patent, the Court observed : In doubtful cases it is not the custom of the Court to express any opinion of the facts of the case ; but in this case the facts are 1211- disputed, and the Court think it is proper to state, as the opinion of both the Judges on the true construction of Plaintiff's Patent, that the Defendant's Patent is a gross and palpable piracy of the Plaintiff's invention.
