SECTION 1. , 8e _it enacted by the Senate and House of Representatives-of the Commonwealth of Pennsylvania, in General -Assembly met, and it is hereby enacted by-the-mithority of the. same, That after.the City election-hi - January next, the Select Council of the'City of Pittsburgh shall con sist of twriMembere from each Ward of said City, one of whom shall be elected annually, to hold his office for and during the period. of two years; that at the election in January next, no person shall be elected to the said Select Council, unless a vacancy shalt exist in the present delegation holding ever after the said time, and then only to supply such vacancy. Sxcx, 2. That from and : after the second Tues day of January next, the Common Cpuncil of the City of Pittsburgh shall - consist of thirty metn. hers, to be elected annually; that in the month of November next, and in the same month in .every thirdyear thereafter, the members of the Common Council of the said City shall be apportioned -by the Councils for the time being among the seve ral Wards of the said City, according to the num ber of taxable inhabitants in each Ward: Provided that each Ward shall be entitled to eleceat least one member. , SECT. 3.. That it shall be the duty of th '• s - sessons for the time being, of each of the severs Wards of the said City, to make out and furniah to the said Councils .on or before the first day of -November next, and' on or before the same day in every third year thereafter, a complete and accurate transcript, upon oathAom the duplicate of last previous triennial assessment, of the' names and, surnames of the taxable inhabitants therein', for which service he shall be allowed such reasonable compensation as the said Councils maydirect; and for any default in the performance of the same, he shall forfeit and pay to the said City the sum of f two hundred dollars, to be recovered, bythem, as debts of the like amount are by law recoverable. SECT. 4. That in case of any rvglect, default, or inability on the part of any of the said Assessors, to perform the duty beteinbefore prescribed, it shall be lawful for the said Councils, and it shall be their duty forthwith, to appoint by joint ballot, if ' I they cannot otherwise agtee, some other ; compe tent person, or persons, for that purpose, who, hav ing accepted the said trust, shall be subject to the ' like duties and penalties, as her* before imposed upon the said Assessors. That nothing in this act contained shalt be held or construed to interfere with the power of the Councils of the said City, to adjust and alter the boundaries of the Wards thereot as heretofore. . &MT. 6. That the viewers' appainted under the act, to which this is a supple ment, shall enquire what damage the owner, or owners of lands, houses, or other property may sustain, by reason of the opening of any street or streets, alley or alleys, in the plan of said city din trict, taking into consideration the advantages that may accrue to any person petitioniegfor darnaiesi and the said viewers shall further proceatosisemi tarn, as far as possible, the names of all the own, ers of lots, or parts of lots, who rpay receive any benefit or increase of value to their property, adja cent to said street or alley, and the said Viewers shall apportion the ailment thereof, fairly and equitably upon each of said owners or in case the said owners cannot be ascertained, upon the lot or lots so benefitted in proportion to the value of each of said lots, or parts of lots; Provided, That in case the said viewers - shall in any instance believe that the amount of said damage cannot equitably be assessed upon the adjacent. property, and shall so certify, then they may direct that an amount not exceeding , one fourth of the w hole ;sum shell be paid from the treasury of Allegheny county, the whole proceedings to be subject to the appro val of the court, as in other cases of read damages. SECT. 2. That the said viewers having, as afore said, made such assessment and apportionment of damages which when returned into said court, shall be approved by said court, and shall be entered and recorded at-large upon the docket of said court, which thereupon shall bind and conclude all par ties owning, or claiming to own the property af fected by this act, or the proceedings under it, and the sums therein specified to be payable, shall be and remain a lien upon each lot or parts of lots, to the extent of the assessment, and charge thereon until duly satisfied and paid by such owner or owners. Szet. 3. That the amount of the damages thus assessed, and - remaining a lien upon said lots may at any time bedischarged by the owner or owners. paying the amount thereof into the treasury of the city of Pittsburgh, fur the use of the persons en. OW thereto; and unless paid within one year af ter said confirmation by court, as aforesaid, the lot or parcel of ground may be levied upon, and sold under a writ of levari lacias, issued in-the name of the mayor, aldermen, and citizens of Pittsburgh, at the instance of any person interested, and the mo neys so assessed and paid into the city treasury, shall be paid over to persons entitled thereto, or to their legal representatives. . SEcT..4. That all former laws inconsistent here with, be'and the Emmeline hereby repealed. Sscr. 5. That the Court of Quarter Sessions of the Peace of Allegheny Co. be, and the same is hereby authorized and empowered, upon application by petition, to appoint Viewers to view batharine street, in the city of Pittsburgh, as the same is now located on the plan of the. city district and adopted by said City, and on the report of said Viewers to vacate the whole or, any part of said street, and if desired by the petitioners to substitute in lieu thereof; an alley or alleys, not less than twenty feet in width, running as nearly as may be, parallel to Bedford and Cliff streets, in said City, and extend ing from one cross street to another, and the raid Court shall proceed therein in the sume manner, in all respects, as is directed by the existing laws re lating to roads and highways.
