at Washington but at Harrisburg. Prior
to the:session of 1855 the membersof our
State Legislature were paid thee dollars' a
ilky, and twenty cents per mile for travel
ing expensie. At that session we believe
their pay Was increased to $1,500 fOr the
cession, it was subsequently fixed at 81,
000 until now, tvlieu following the ex
ample of their friends in Congress, there
appears to be a disposition to increase it
once more to 81,500.

since the Republican party has got itself
pretty firmly fixed in the political middle.

following illustration of the workinsg of
the Civil Service bill in that State: -'•Col
onel Wanglin, a soldier who did good
service for'the Union in the war, losing
an arm and being otherwiie wounded,
was appointed Pustmas'er at Belleville,
Illinois, by President Lincoln, and held
the' office until recently. During the
campaign of last year Governor Oglesby
promised the postoffice to the editor of a
weekly newspaper in that place. There
was no charges of official malfeasance
against Colonel Wanglin, neither could
his loyalty to the administration be im
peached ; but be had not been as active
in the cause of Oglesby as that gentle
men wished, while the newspaper which
was owned by the wonld-lx) postmaster
was particular servile. Oglesby he . ; t his
promise to the newspaper man, and the
President cheerfull coney:ill-id in the
suggestion made by him and caused a
change in the pestmastership." In this
cause Senator Oglesby wanted the Belle
ville_rostmastcrship to pay some of the
debts contracted during his election to
the Senate, and the Chit Service bill was
trampled under foot by the'President.

success, and the chairman of the state
committee boldly proclaims it.

The following opinion delivered by
Judge Sharswood of the State Supreme
Court about a year ago, which we pub
lished roen after, we republish at this!
time for the benelit of any of our readers
whom it may concern. An understand-
Mg of it may save trouble and even use
less litigation.
This was an option on the case by a
tenant against a landlord to recover dam
ages
for an alleged breach of duty in not I
guaranteeing.to the plaictiff, from time
to time, and at all times, peaceable and
quiet possession and enjoyment without
molestation or hinderance the demised
premises. This is undoubtedly in every
demise an implied covenant of quiet and
peaceable enjoyment—but not that the
tenant shall be guarenteed from all mo
lestation or damn es from the wrongful
acts of strangers, havinsr.no right or title
to the demised prnnisesorahy part there

breach of the implied obligation of the
landlord that the tenant shall enjoy
quiet and peticeable•possrion during the
term. .
The covenant of quiet enjoyment,'
wheather expressed or implied. only means'
that the tenant shall not bo evicted or I
disturbed by good title in the pncceQiion
of the demised premises or some part 1
thereof. It is very clear that the wall
removed was not a part of the house let,
and from the nature of the case, could'
not have been supposed 'to be so. The
house let was a frame hailding—thewalls
were part of an adjoining building,. The
learned judge below, however, appears to
have thought that' here was a defy oh the
part of the landlord to maintain the prem
ises m a tenantable condition. From
evidence that defendant had done smile I
i repairs. lie left it to the jury to infer.that
there was a general contract by him to.do
all necessary to keep the house tenable.
Even admitting that this ground could
' be resorted to under the pleading,, ins !
, manifest that the fact that. a landlord 1
rvoltintarily, and at the request of a ten- 1
pant, does certain repairs is no evidence
from which such an 'lnference can be

sprang from the hitt. To say that a law
resting upon future contingency is in
valid would be to rob the Legislature of
the power to act wisely and well for the
best interests of people. Though the
Legislature cannot delegate the power
to make a law, yet,it can make a law and
delegate the power to ascertain some
particular point upon whichathe action
of the law itsell is to depend. The May•
or and Councils have delegated to them
the power of making laws and ordimmers,
but this was simply the pou'er to deter
mine what. is best for 'the city, and the
charter 01 the city was the htw which
breathed life and force into the result
of their deliberations. The decisions in
this State since Parker vs. The Common
wealth ruled this case. After citing nu
merous authorities, the ojdu ion closed by
affirming the judgement of the Court be
low.

After the dissenting opinion of Chief
Justice Read, Judge Sharswood made the
following remarks from the bench.
I concur in the opinion that has just
been read, and I do not know that I have
anything to add. The result of all the
authorities on this subject, which I don't
understand to be denied, is that it is not
competent for the. Legislature to delegate
the law making power. The point of
discussion seems to turn upon what is u
law.
It is clear there is a great many things
which the Legislature eau do, and which
it is the habit of doitig, and which con
stitute acts of the Legislature, which in
the settee of Parker vs. the Commonwealth
are not laws.
...There are a good many
acts of executive administration which
Are.,y can delegate to the courts, or to the
ninnicipel corporations, or to the people
of the different districts. But a 'law,"
propolv speaking, is a rule of conduct
pr.scriG r ed by the supreme power of the
state, commanding . what is right and
prohibiting whet is wrong.

The Apportionment Bill
The ruthlosnesil with which the radi
cal majority in.the legislature are resolv

of the house. Last. year an . apportion

table, giving equal representation to all
parties of the commonwealth, was secur
ed by the democrats of the *ante, but
was defeated by it combination' of disrp
poin4ed aspirants who prevailed on (lM'-
ernor Ovary to exercise .the Tem. Thu
success of that inti lame is witnessed in an
apportionment' whiiiti concedes to the
democrats of the state nine districts in
twenty-seven. The simple plan on which
this dishone. t partisan work is constiuct
ed is to pile populous democratic counties
together in large districts t and make small
districts out of the republican counties.
For example, York and Cumberland,uith
a population of 120,040, are not entitled
to a member of congress, but the demo
cratic county of Adams, with it popula
tion of 30,31.1 is thrown in so as not to
endanger a republican district, while to
the republican district of Washington,
Beaver anti Butler, with 121,141 inhabi
tants, is given a mmiber. This is a dis
crimination of about thirty thousand
against the democrats, Mid the earn( rank

In other respects the bill is a monster
of gerrymandering iniiinity. The an
cient :did populous detimeratic county of
Rinks is divided, one rOrtion licing, Gong
to Montgomery, and the other.to Lehigh
and Northampton. Not only are coati

anatie city is torn from its mtimcipahty
and.thrown into a rural district. That
