This was an option on the case by a tenant against a landlord to recover dam ages for an alleged breach of duty in not I guaranteeing.to the plaictiff, from time to time, and at all times, peaceable and quiet possession and enjoyment without molestation or hinderance the demised premises. This is undoubtedly in every demise an implied covenant of quiet and peaceable enjoyment—but not that the tenant shall be guarenteed from all mo lestation or damn es from the wrongful acts of strangers, havinsr.no right or title to the demised prnnisesorahy part there of. It is very clear that the wall removed was not a part of the house let, and from the nature of the case, could' not have been supposed 'to be so. The learned judge below, however, appears to have thought that' here was a defy oh the part of the landlord to maintain the prem ises m a tenantable condition. The point of discussion seems to turn upon what is u law.
