On the night of tbo 17th inst., a boy named Klwood Davis, who had been boarding with Mr. Josiah Wright at Now Buffalo during the past winter, ab sconded taking with him two vests two pairs of pantaloons, an overcoat and, about ninety live dollars in money belonging to Mr. Wright and an entire suit, of clothes and about live dollars In money belonging to Edward Oeagan who was his room mate. The Huntingdon (J lobe says : A barn belonging to Fredrick Hea ter, residing in Tod Township, this county was burued to the ground on Friday tho 14th inst., consuming three head of horses two head of cattle, ono buggy, a spring wagon, and all of his grain, hay and moat, involving a loss of about $2d00. The sou of a lady re siding In Harrisliurg, a boy of about ton years of age was attacked, about a week ago with a soreness in ono of Ids fingers extending from the tip to between the flint and second joints. After suffering nearly a week, with increasing pain, the attention of the lad was drawn to a small pustule ou tho end of tho finger, immediately under the nail, In tho center of which was seen a black spot. Further examination disclosed the presence of tho half of a sewing necdlo imbedded in tho flesh, through which it was gradually working its exit from tho body. The needle was black and corroded. It is supposed that the lad unconsciously swallowed the noedle when he was a child as there is no recolloction in the family of any accident whereby it was run into tho body. Tho following case which is reported In tho Legal (jiuijfte of tho l'ltli inst., will be of interest to many of our readers : A stranger met Neal McCoy, of Juniata county, and brought him into a hotel of ono William Young, of Mifllintown, whero they each took a drink and then sat down, and tbo stranger ns Young testified tried to sell McCoy tho right to a patent hay-fork. After sitting somo time, McCoy wanted moid liquor, which was refused him, and ho and tho stranger then went out together. About this tiino (how,' where, or w lion was not proved, and McCoy stated that ho had no recollection of tho transaction,) McCoy's signature to a promisory noto for f 225 was procured. , Tho note was payablo to J. J. Wilhelni & Co., or bearer, on tho 1st day of July, 1870, at tho Juniata Valley bank, at Mifllintown, with use. Suit was brought against McCoy upon this note in tho com mon pleas of Juniata county by tho State Hank. " Upon tho trial Henry A. Sturgeon, Ksq., cashior of tho bank, was called as' a witness by the plaintiff, and testified that on tho 20th of June, 1870, J. J. Wilbehn ' & Co., called upon him to soil n, Dumber of this same kind of notes, that, he thereupon consulted two or thrco of tho directors of tho bank, and they agreed to purcluvso tho lot at the price Mr. Wilhclm asked, which was oOcts on the dollar, and they purchased the lot olTored, including tbo note of defen dant, for !fl,402;50. Mr. Sturgeon further stated that Wilbehn said tho notes were given for patent bay-forks j that tho bank holds the note of oud Moyer as a guaranty for tho paynicntof theso notes, incase they are not paid ; that Moyer's guaranty cov ered only the amount paid by the bank for the notes ; and that ho, Mr. Sturgeon, would not have purchased tho notes wi'Jiout a guarantee, "he plaiutw s. counsel, con tended that the circumstances under which these notes were purchased, as detailed by Mr. Sturgeon, could not inlaw defeat a recovery. Judgo Graham submitted the question of fraud to the jury, reserving tho question whether upon all the evidence, tho plaintiff was entitled to recover, to bo dis posed of on a rule to show cnuso why judg mcnt(should not be entered for tlie plaintiff non vbilanie vcreaieio. upon mo argument of tbo reserved question, Judgo Graham, in delivering his opinion,,, cited tho cases in point and deduced therefrom tho rule that to prccludo a defence to a nbto fraudu lently obtained, it must have, been taken without notice, cither actual or construc tive. Nor was this transaction in tho usual cour.so of business, for I cannot sup pose it is tbo usual cour se of business with tho State Bank or any other bank doing businohk under n charter from the State, to purchase paper upon a person unknown without an endorser, at fifty per cent, dis count, and take an indemnity against losn should the paper prove worthless.
