Maguire, charged with the murder °fin s ggie Baer, at the Continental Theatre, on the 2d of April, lagi, ten jurors were selected from the regular panel before it was exhausted. A. special venire issued for twelve telesmen returnable at half-past four o'clock yesterday afternoon. When these ay peared the challenges exhausted the panel without obtaining an additional Jerez'. A second spe cial venire summoning twenty salesmen then issued, made returnable this morning at eleven o'clock. From these the two'remainh gg jurors were selected, and at 12 o'clock, the Jury being full, the trial proceeded, , The court room was uncomfortably filled. and al though the occurrence is of a distant date, the interest in the trial appears to,be very general. . District Attorney Mann opened the case for the Commonwealth. He referred to the numerous scenes of violence now so common throtignout the land, and urged the necessity for a rigid and inflexible adminis tration of the law, Murder is becoming common. and he had heard a rumor that one of the girls, a witness in the present caseated an assault committed upon her last night. an attempt was Made to cut her throat by some one jealous of her. On the day of the' murder be visited the cellar and invited the girls to go to the Continental Theatre; he furnished money for the purpose; Maggie Baer went to the theatre, and was sitting in a private box, when Maguire came and secured admissionr _to ~ :the box; watking to Maggie be inquired if she would-give him an an swer...Sbn_healtated for some time, and mien she answered evasively, be leveled the pistolat her bre s sl ; discharging-three loads into her holy. Maguire Was at once arrested. This was the case. Thine was no doubt that .Maguire is the man who committed the murder. After the Commonwealth had established the death at the bands of,the_ prisoner, he would wait to hear the +defence,' and then it would become his duty to tho roughly sift that testimony. Dr.itimpleigh testified that he was physician to the- Coroner in April, 1851; made a post mortem examina tion of the body of Maggie Baer; maderhe examination on the sid of April, at tie r. - Conrad's establishment in Parrishatreet, above Eleventh; there were three gun allot wounds upon •he body; oue a slight liesb'wound on the out aide of the left thigh; one cm tbe back of the head a little to the right of the medium line; and an other -in front of the right 'arm-pit over the space between the first and second ribs; the b iii on striking against the bone of the head, a part was split off and was fund between the skull and the scam;-the main part of the ball penetrated the brain to thehatent 0,1".2 inches, harrying with it' some pieces or the inner plate of the bone: one ball entered bet weemtheilrst and second ribs, under the right arm pit, and passed- to the cavity of the chest and pasted through the right lung, passing behind the heart and tbrotigh the aorta, three niches from- • the heart; the aorta is th main artery passing from the - heart: - then `.'it • 'mussed- through a portion of the left lung; It was found in the cavity of the left-chest; the2-wouud through the_aortis_wita. the immediate cause of death, though the wound in the bead would - have proved fatal..-The wound in the head seemed to he from the front, while the others were dr woward. These could have been infidelupon a -person in a Bitting posture by a person standing. Death must have been almost instantaneous. Officer Thomas Moore testified that he was present at the theatre, the night Maggie Baer was shot; I had seen Maggie Baer before this occurrence; saw her at the theatre on thin night sitting in one of the stage boxes; heard the report of the pistol from the box where Maggie Baer was; after the first-load was dis charged it drew my attention to the box; after the Berm dialosd I looked at the box and saw the prl toner firing again; between the second and third shot- • officer- Rice and myself _sprang Into tho box, arrested the prisoner, and took him to thastation-house; the third shot went off aa we gat into the box; his pistol was pointed at Maggie Baer; did not get the' pistol; while we were absent some one - picked up tho pistol: when we were taking him to the station house I asked him why he had shot this wo man; he said "because I I , veri her and determined that no other man should have h?r"; I asked him brae bad been drinking, and be told me he had drank nothing bar one rod , cocktail that evening. Cross examined—That is all l recollect that he said; lie made no more resistance to the arrest than is Usual; be did not look to me as though he were nosier the in flt.t nce of liquor; the- body ass taken to the Central Station. Fa Coroner Taylor testified 'that he obtained the body of - Maggie Baer at the Central Station; it wad afterwards taken to Parrish street,whereDrShapleigh made the prst-mortem examination. Officer James Rice testified that he was at the theatre 'the night Maggie Baer , was shot; beard the shots fired and saw the prisoner' he was po!nting the pistol at :idaggie Beer, after the first shot; was looking at him -when he discharged the second shot; ran to the box, ..ar.d when I got in the box the tl ird shot wes fired; I took hold of the prisoner and fell with him in the .sx , rner, and the pistol fell bacx in the corner; had never seen the prisoner before that night.
