I, : tgilajj :4_:4:I:MAI [CLOSE OF TXSTERDAT'S PROCEEDINGS.] SENATIL—Mr. Howard moved that the se nate proceed to the consideration of the Re. construction resolution recently passed by the House. • Mr. Sumner spoke in favor of postponing the resolution until the testimony offared by the Reconstruction Committee should be more thoroughly analyzed and considered. After sinew further discussion, the joint resolution was taken up ' and read as it passed the House. Mr. Howard took the floor to explain the proposition.in behalf ot'the Special clom mit tee of Fifteen. He spoke of the labors of the Reconstruction Committee, and said it had not been their purpose to present an unfair or partisan report. One result 'of their in vestigation has been the resolution for the amendment of the Constitutionof the United States now under consideration. Article—. SECTION 1. No State shall make or enforce any law which shall abridge the privilege or immunities of citi zens of the United States, nor shall any State deprive any person of life, liberty or of property, without due process of law, nor deny to anyperson within its, jurisdiction the equal protection of the laws. SEc. 2. No class of persons, as to the right of any of whom to suffrage any discrimina tion shall be made;shall be included in the basis of reprssentation, unless such dis crimination be in virtue of impartial quali fication, founded on intelligence orproperty. or because of alienage, or for participation in the rebellion, or other crimes. SEC. 3. The , public __debt ..• of the United States, including all , debts or obligations which have been or may hereafter be in cluded in suppressing or in carrying on war in defence of the Union, or for payment of bounties or pensions incident to such war, and provided by law, shall be inviolate; but debts'or obligations' which. have been or may hereafter be incurred in aid of insur rection, or of war against the United States, and claims for compensation for loss of involuntary or servile labor, shall not be assumed or paid by any State nor by the United States. SEC. 4. That Congress shall have power to confirm, by appropriate legislation, the pro visions of this article. Mr. Wilson moved to strike out the words, "or property," in the second section. Mr. Wade accepted the amendment, and his amendment, as amended, was ordered to be printed. Mr. Wilson offered the following as a sub stitute for the second clause of the House resolution: "Representatives shall be apportioned among the several States according to their respective numbers; and if in any State the elective franchise is or shall be denied to any of its inhabitants, being male citizens of the United States above the age of twenty-one years, for any cause except insurrection of rebellion against the United States, the basis of representation in such State shall be reduced in the proportion which the number of male citizens FO excluded shall bear to the whole number of male citizens over the age of twenty-one years." Mr. Wilson submitted the following sub stitute for the third section of the House re solution, which was ordered to ba printed: "That any person who resigned or aban doned, or may resign 9r abandon, any place under the United States Government, and has taken or may take part in rebellion against the Government, shall be ineligible to any office under the United States or any State Government." . . Mr. Clark offered the following substitute for the third section of the House resolution; which was ordered to be printed; No person shall be a Senator or Represen tative an Congress, or be permitted to hold any office . - tinder the Government of the United States, who, having" previously taken an oath to support the Constitution thereof, shall, have voluntarily aided in any insurrection or rebelliori against the United States, or given aid or comfort thereto. Mr. •Howard suggested the striking out of the word "voluntarily," in the above, which was agreed to. ' - I The. Senate; at 4 o'clock, went into Exe cutive session and soon after adjourned. - HOITSE.—The House went into Committee of the Whole on the State of the Union, Mr. Dawes Mass.) in the chair, and resumed. the consideration of the Tax bill, com mencing with the paragraph on bank business. On motion of Mr. Morrill (Vt.), the para graph was amended by adding ate folio w ring : "And the returns required to be made by such provident institutions and savings banks after July, 1866, shall be made on the first Monday of January and July of each year, in such form and manner as may be prescribed by the Commissioner of Internal Revenue." The paragraph relating to the income tax provoked a good deal of discussion. Mr. Pike having moved an amendment re-enacting the present law, and Mr. Spald ing moving an amendment to impose an additional duty of three per cent, on the ex cess of incomes over six thousand dollars, Mr. Ross offered an amendment making the discriminative tax ten, fifteen, twenty arid twenty-five per cent. Mr. Spalding withdrew his amendment, and the amendment of Mr. Ross was re jected. The amendment offered by Mr. Pike was adopted. This leaves the law as it at pres ent stands, with a tax of five per cent. on incomes up to five thousand dollars, and a tax of ten per cent. on the excess over five thousand dollars, the only difference being that the limit of the first six hundred dol lars is extended, to one thousand. The vote onit was 57 yeas to 42 nays. Mr. Ancona (Pa.) offered an amendment to make the thousand dollar limitation apply to the present year,witich was rejected. Among the deduction to be made in esti mating income were added, on motion of Mr. Wilson (Iowa), "Losses - actually -sus tained during the year arising from fire, shipwreck, or incurredin trade, and debts ascertained to be worthless, but excluding all estimated depreciation of values." The Committee rose, and the Speaker presented a message from, the, .President, in answer to a resolution:4lll 27t11, re questing a collation of the provisions in reference to -freedmen contained in the amended constitutions of the Southern States, and of the laws of those States passed since the suppression of the rebellion; trans mitting a report from the Secretary of State. Referred to the Committee of Reconstruc tion-. Also, a message from the President trans mitting a report from the Secretary of the Treasury, in compliance with the House resolution of May 7th, calling for informa tion in reference to clerks employed in the several Executive Departments of the Go vernment. Referred to the Select. Commi ttee on the Civil Service. • The House took a recess from half-past four till half-past seven. Evening Session. --The House re -assembled at 7.30 P. M., and having resolved itself into Committee of the Whole, resumed the con sideration of the clauses of the , Tax bill re gulating'thetax on incomes. Mr. Garfield (Ohio) moved to amend the clause regulating the manner of assessment bya adding the following: "Provided, further, that the list of incomes in the offices of the Assessor and Collector, shall be open to in spection by the• public; but neither the As sessor nor Collector shall furnish such lists of any portion thereof -for publication nor permit the same to be copied, for publica tion." Several -members proposed to modify the ameridment by allowing the lists to be copied for publication, but the Committee rejected the modification, and the - atnend ment of Mr. Giarfield was then agreed to..' The communication from the City Solici tor is as follows ; CITY SOLICITORS' OFFICE, PHILADEL PHIA, May 7, 1866.—T0 Colonel Page, Esq., Chairman of Special Committee of Select Council:—Your favor of sth inst. was re ceived by me this morning. - You request my opinion as to the right and power of your committee under the. fiftieth section of the act of February 2, 1854 (P. L. 45), to which you refer me, to call witnesses before you by subpoena, to ex aminethem under oath, and, in caseof their refusal to attend, or attending, to be exam ined, "what remedy the committee have under the law to compel attendance and to enforce the giving of testimony" I have heretofore been called upon to express an opinion' uponthe qestions Cans presented, and since the receipt of 'your favor I have reconsidered the subject with some care. The result of my reflection upon the law is that the Legislature, itt no statute to which my attention has heen called, gives - to any Committee of Councils the power to enforce obedience to. 'a subpoena by attach ment, or to commit for contempt, and that consequently your committee are without remedy in the case presented in your letter. - It may be suggested that this view prac tically defeats the objects of the law, and that the greater the fraud in any supposed case, the less would 'be the opportumty of a chance of investigation. This is much to be deplored; but on the other hand it is to be remembered that the power to attach and to commit means to imprison perhaps in definitely, and I know of no case in which it can be lawfully exercised without an ex press grant of authority. Thus the act of June 16, 1836, N 2 (P. L., 993), confers the power upon our Courts to issue writs of subpoena, adding under the penalties withheld appointed, viz: "Under such pains and penalties as by the rules of the common law and course of practice in the King's Court at Westminster are usu ally appointed." [Act of May V-, 1722, E, 33; Smith, 143.] The power to the Legialatureitselfto issue subpoenas is expressly complied with, the grant of authority and by attachment to compel = a 5 the allowance of witnesses, and shall have power by direc tion of the House to issue a warrant of com mitment. [Resolution of January 13,185`, P. L. 491.] The Legislature have, also, deemed it ne cessary to confer the power to "issue an at tachment" in express terms on Arbitrators (act June 16, 1836, P. L., 537). On Auditors (act April 11, 1848„ 4. P. L.,507). On County Auditors (act April 15, 1834, 3. 50, P. L ,'545). On Register of • Wills (act March 16, 1832, 8, P. L., 136). On Commissioners (act Feb :ruary 26, 1831, 2, P. L., 92). On the Court of Common Pleas (act of April 8, 1833, 19 • P. L., 309), and on the Auditor- General (act March' 30, 1811, 4, 5 Smith, 228, and same act 32, 5 Smith, 235). • In 1864 this auestion was liefare a corn - mittee of Select gouneiJi - of which E. Spen cer Miller, Esq., was chairman, and in reply to a letter.from him, I expressed substan tially the views herein stated. My recon siclenetion of the subject in reference to your communication has simply led me to make some additional citations. I am very respectfully and trulyyours, F. CARROLL BREWSTER, City Solicitor. Colonel Page said ,that he had not been influenced by any partisan motives in push ing the investigation, but on account of the great clamor raised by the public, he had beep induced to move the appointment of a Joint Committee of Councils to investigate the matter. Common Council had refused to concur in the resolution, consequently the Special Committee of Select Council, of which he was Chairman, was appointed. Mr. Gray moved that the members of the committee exert themselves to-day to pre vent the paserage of the resolution, which originated in Common. Council on Onus-, day last, and which provides for the ap pointment of ;a joint committee to investi gate the same subject. He said that resolution <• was passed in Common Council with the intention to ignore the special committee, and that Select Council would consider the same to-day. He be lieved that it should not be concurred in. The Trustees understand that-this commit. tee intend to thoroughly investigate the management of the works, and by having the joint resolution passed in Common Council they expect a new committee from Select Council to be appointed.
