The Public Squares. To the Editors of the Evening Bulletin: fallo one above the level of the intelligence of a Commissioner of City Property will deny that the public squares of the city are intended for the enjoyment of the citizens, and not as parlors in which lazy political "buminer's" may idle as superintendents upon a comfortable salary. I desire to call attention to the fact that, notwithstanding ' the truth of the proposition above stated, the public are,without any sufficient reason whatever,. during the larger portion of the year, den ied access to the squares they are taxed to support. For not only are these for the most part permanently closed during = all the winter and for the major portion of the spring'months, but, during the sum mer, whenever in the opinion of the indi vidual invested with the complimentary ti tle of superintendent, the- condition of the weather affords him an excuse to relieve himself for a day or two from the very on erous duties connected with his office. I submit that the $7OO per annum, which is, I iaelieve, the salary connected with this responsible pest is ample compensation for the daily duties of frightening the little , boys off the grass, regulating the domestic economy of the squirrels, and chewing the requisite quantity of tobacco, even though these exhausting labors be continued during tre entire three hundred and sixty-five days comprising the year instead of for only half that period. Nowhere but in this patient end longsuffering community would this 'imposition have been submitted to. In Boston, New York, Baltimore and Wash ington, in fact in every other city ea cent Philadelphia, the public squares are open the entire year. What reason can be urged to the contrary? That in the inclement seasons the gravel of the walks become soft and unpleasant to the feet? Pray let those who use the square be the judges of whether their hoots be clean or dirty. That it will entail extra expense in repairing the walks? Why not then close Fairmount Park and Independence Square? Those residing in the vicinity of our pub lic squares, who, during the recent sultry weather, had no alternative between keep ing their little ones sweltering in the house - or sending them upon the streets to play, with its attendant dangers, most justly feel indignant when they gaze through the iron railings, upon the shade and green, they are ea absurdly deprived of. The matter seri ously demands the attention of Councils, and should it require an ordinance to cum- Tel the square to be kept permanently open, such an ordinance should be passed without delay. J. B. EXPORTATION OF ARMS.—It appekrs from official documents that in December last Senor Romero addressed two notes to the Secretary of State in relation to an order is sued by Major-General McDowell, com manding the Military Department of Cali fornia, prohibiting the exportation of arms or munitions of war, by way of the frontier, into Mexico. These notes were referred to the Attorney-General of the United States, who said the question raised by the Secre tary of State was whether, in the opinion of the former, this order was in conformity with any laws, regulations, or orders in force bearing on the subject. The Attorney • General says no military officer has the right to issue any order to which he cannot lawfully compel obedience by the forces under his command. The test, therefore, of the validity in point of law, of this order, is whether he could lawfully employ the forces subject to his control, to prevent American citizens and other persons within our jurisdiction from transporting arms or munitions of war as merchandise across the frontier into Mexico in the present state of affairs in that country. The Attorney-General says he is of the opinion that the order of General McDowell was not to interfere with such trade con ducted by our people as the authorities have declared to be lawful, and is not, there fore, in conformity with the army order, being probably intended to be directed against military expeditions or armed en terprises carried on from this country against the belligerents contending in Mexi co. Such expeditions and enterprises are, of course, violations of our statutes, and no thing in.this opinion is intended to impugn - the validity of the order in respect to them. The Attorney-GeueraLapprehends it to be well settled that merchants may lawfully sell at home to a belligerent purchaser, or carry themselves to the belligerent Powers contraband articles, subject to the right of seizure in transitu. The right of the neutral to transport, and the hostile Power to seize, are conflicting rights, and neither party can charge the other with a criminal act. This is the view taken by Chancellor Kent. A.HAPPY RELEASE.—The Western papers - recently contained a thrilling account of the _adventures of a party in a cave in Indiana. They underwent many strange experiences and finally all were rescued, save one, a Dr. Hawn, who, being quite corpulent, became wedged in a narrow passage from which he -could not escape. It appears, however, that he subsequently got out, from the following: A correspondent, writing from "Central Indiana," April 16th, gives the sequel to the recent strange adventure of certain ex plorers of a cave in Crawford county of that State. Afterrelating the account of the discovery of Knapp, lying insensible at the mouth of an opening in the ground about five miles from where he entered, of his resuscitation, and his incongruous account of groping his way out to the month of this cavern, which no one supposed communicated with the pne in which he had been imprisoned, the writer says : "Now many resolute men pressed into this, cavern, from which Knapp hademerged, to seek the unfortunate doctor. They did rot need to take much trouble, how ever, for the missing man (Dr. Hawn) met them not far from where they entered. The three days' fast had so reduced the corpu lency of the Doctor, that at last he was able to creep out of the narrow passage in which he had been fastened. Fortunately he pur sued the very route Knapp had taken. In the three days Dr. Hawn lost forty pounds in weight. - INTERNAL REVENUE DECISION. The Pteommissioner of Internal Revenue has de eided that all expenses for insurance upon !property and all actual losses in business may be deducted from the gross amount of the year; but losses sustained after Decem ber 31, 1865, cannot reduce the income for the year. Losses incurred in the prosecu tion of one kind of business may be deducted 4 • rom gains in another, but not from those ortions of income derived from fixed in estment, such as bonds, mortgages, rents, and the like. Assessors should also be careful not to allow the deductions of amounts claimed to have been lost in busi ness, when in reality they should be re garded as investments or expenditures, as when merchants expend money in farming or gardening for recreation or adornment, other than pecuniary profit.
