The Mayor and the Sunday Liquor; Dealers.. Within a fewweeks a, number of clergy men addressed Mayor Henry, - urging' him to enforce the lavr against the sale of intoxi cating liquors on the Sabbath. In answer the Mayor recites the various aets of As sembly touching this subject, ang states that • aecording to his construction of the law he has no such power as the petition suggests. There are but three statutes relating to the Sabbath. The first is that of 1705, but the provisions of this act do not permit the Mayor or thepolicemen to exercise the au thority therein conferred upon constables. The second statute is that of- April - 22,1794, which enacts" that if any person shallper form any worldly employment or business • on the Lord's day, works of necessity 9,nd charity only excepted, and be convicted, such person shall for every offence pay four dollars, to be levied by distress, and in cash of refusal or neglect to pay, or goods cannot be found on which to levy, the party shall be imprisoned six days in the house of cor rection; provided that the prosecution shall commence within seventy-two hours after the offence is committed. The serving of all legal process on Sun day, except in cases of treason, felony or breach of peace, is forbidden by statute. The violation of the Sunday law is a mis demeanor, but unless accompanied by noise or disorder it is:not an actual breach of the peace. Such is the language of the Supreme Court of Pennsylvania, in the decision of a ease arising under this .law. The remedy for its infraction is by complaint within seventy-two hours thereafter,before a justice of the peace, who, upon due evidence, may impose a fine of four dollars upon the offender; but only one penalty of four dollars can be incurred by any one offender for all the acts, however numerous, per formed during any Sunday in the exercise of his business. The third statute is the act of 26th of February, 1855, which makes it unlawful for any person to se(11, trade or barter in any spirituous or malt liquors, wine or cider. on the first day of the week, commonly called Sunday; or for the keeper or keepers of any hotel, inn, tavern, ale-house, beer-house, or other public house or place, knowingly to allow or permit any, spirituous or malt liquors, wine or cider, to be drank on or within the premises or house occupied or kept by such keeper or keepers, his, her or their agents or servants, on the first day of the week, and imposes a penalty of fifty , dollars. The third section enacts that— "ln addition to the civil penalties im posed, by the last preceding section, for a violation of the provisions of the first sec tion of this act, every person who shall vio late the provisions of that section shall be taken and deemed to have committed a mis demeanor, and shall, on conviction thereof in any criminal court in this Common ' - wealth, be fined in any sum not less than ten, nor more than one hundred dollars, and be imprisoned in the county jail for a period of not less than ten, nor more than sixty days, at the discretion of the court." • The Mayor of Philadelphia having no jurisdiction in civil suits, can entertain no prosecution under any of these statutes for the penalties thereby imposed; but he may, by act of the 28th of March, 1860, upoil affi davit before him, issue warrants for the arrest of parties selling liquor on Sunday, and upon satisfactory evidence, bind them over for trial before a criminal court, and with the return of the transcript from his docket, his official duty in these cases ends. The Mayor, therefore, thinks that it is apparent that there is no power vested in him or in any magistrate to close up or pre vent access to a tavern or other drinking place on Sunday., And that upon such day no policeman can lawfully be sent to visit these resorts, or to arrest persons commit , ting misdemeanors by setting at naught the restrictions of the law. VUG DES was on the SECOND day of Decdmbs.r.A, D. 1655. presented. setting forth inter a!ia, that Tobias Rudclph. by an indenture of mort,v,age dated the eighth day cf October, Anno Domino 1791, and recorded at Philadelphia in Mortgage 800k.X., No. 6, page 430, did grant and con vey in mortgage unto James .Jtsmes certain premises situate in the city of Philadelphia,, con taining in breadth upon High 'street, thirty-eight feet and four-ninths parts of a foot and continuing the same breadth from the said street to the extent of lis feet southward Bounded northward with High street, eastward with Jasper Carpenter's ground, at the distance of 57 feet and two-thirds part of a foot from Sixth street, southward with John Gellelyn's ground, and westward with other ground of the said Jasper Carpenter, to secure the payment Of the suns of seven hundred and fifty pounds, that the said petitioner was the owner in: trust of said premises, that he verily believed the legal- holders of said mortgage bad long since died and that pay ment had been made of ail moneys due thereon, but that satisfaction bad never been entered upon the re cord of said mortgage which he desired to have en tered, and praying that the Court direct the Sheriff to serve a notice or give public notice to the legal repre sentatives or said James James, stating the aforesaid. facts, according to law. Whereupon the Court directed as aforesaid.
