FATAL AFFAIR. —On Tuesday nijfiht,Jan.lO, warrants were issued by Justice BOOART for the ar- 1 v- -t of ISAAC ACLA, MARGARET ACLA, his wife, BETSY AI :.A, his mother, and a young man by the name of •I '-ecu VAUC.EBSON, charged upon the complaint of "WEN FIXI.AN, of this place, with killing his brother, j 'HN FINI.AN, The warrant was returned on Tues | !.iy with all but ISAAC ACLA arrested and brought I ;> fir hearing. The following are the material facts I circumstances as brought out upon the oxami | i-atioii: <in Tuesday morning, OWEN FINLAN, accompan- ! ii-d 1 > his brother JOHN FINLAN, a young man about i iglitcen years of age, went with authority from tin Provost Marshal of this District, to the house i : I,u Ai I.A, in Asylum township, to arrest said V I.A is a deserter. It appeared that ACLA had en drafted but refused to report. They found A t.i i;i his blacksmith shop at work. Upon their , • 'hit; into the shop, ACLA warned them to stand' , fi; d lie would not be taken alive. The young aidrew their revolvers. They exhibited to him : their authority for his arrest. There was at this i tune another pi-son there by the name of VANWEB- i j POOL. About this time ACLA'S mother and wife came to the shop—the old woman was very much V'ited and used threatening language. After con " ruble altercation ACLA alleged that he had pa- 1 pi r, to dear him from arrest, which were in his cfifst at his house. The young men consented re- ; • H 'tniitly to go with him and they all started to the i house. A part of the house is occupied by ACLA and a part by his mother. ACLA proceeded to his : part as it to hunt tor his papers, and was immedi- 1 tcly followed by OWEN FINLAN. He proceeded to 1 i bedroom and commenced to search in a chest. OWEN S suspicions were aroused that ACLA was ! Tilling for a pistol and immediately caught hold f him and pulled liim away from the chest and i uto examine it himself. At this time the old •'•a.iii had come into the bedroom. OWEN was clinched by ACLA and liis Mother and a severe ■tnigglc took place, OWEN trying all the time to his pistol to shoot ACLA. In the struggle OWEN - „ verily beaten upon the head and face by the '• women with a stick of wood, and kicked and aiuled by ACLA SO that he was overpowered and pistol taken from him. It appears from the '•valence of the man VAXDEBPOOL, who remained thi- front room, or the old women's part, '■■mghout the whole affair.that JOHN FINLAN and s Fi S wife followed ACLA and bis mother and OWEN ■ tie back room or kitchen ; that while the con as going ou between OWEN, ACLA, and his <h' r, hi saw JOHN trying to go to assist OWEN, •'L'L ACLA'S wife trying to prevent him, that, he """U saw JOHN and ACLA'S wife in a clinch coming ■'igli the door of the backroom into the front "'la where he was, that she rushed him out with •ifiirnit ease and threw him out of the front door into th, road and shut the door, that JOHN in a ' "Le nt or two broke into the room again, and i aiti-r went out : that he did not discover that •'* Was hurt about the head or bleeding ; that ! • N he came out of the hack room with ACLA'S he he had no pistol in his hand, that he did not " ' her strike JOHN. Soon after JOHN was put out ' ' N got loose and hurried out to find JOHN, and "a i-red him standing in the road a short dis -1,1,11' boin the house : that he made inquiry of 'i s about his pistol, and about his injuries, as he le' ilnig profusely from a wound or wounds tore jut of his head. He answered that the I ' l ll that got his pistol struck him. Soon after v told Owen that the women that got his pistol ■bv.k kim with u stove lid. JOHN started to go to a house about a half mile off to get his head dressed. ' OWEN soon after followed him with his horse and ! ■ cutter. After JOHN'S head was dressed they start ed for home. A short time after JOHN become in sensible and continued so until they arrived at home. Physicians were called immediately. He continued insensible until about 8 o'clock p. m., and died. An inquisit ion was held upon the body by Justice BOGABT and a Jury, and a tin (ling was ren dered according to the facts. At the examination of the Defendants before the Justice the two wt>- inen were committed to answer—the young man VEBGERHON was discharged. The man ISAAC ACLA escaped and has not been arrested yet.
