is by law incapable of holding or exercising, at the

By the 4th section of an act passed the 16th day
of April, 1810, it is provided ",that the 19th section
of an act passed July 2, 1839, eintitled_“.An art re
',lung to the electiens of this commonwealth," shall
nut beim construed as to prevent any militia officer
frtAn serving as Judge, Inspector or Cleric, at any
general or special election of this Commonwealth.

day after the election, which will be on the 17th
day of October.
AN ACT fin . the Supjression of Manufacture and
Sale of lataritating Liquors, as a Beverage.
WHEREAS, All laws to be efficient should have
the approbation and sanction of the People :
And Whereas, It is represented that a large num
ber, if not a 'majontylof the citizens of this Com
monwealth, ore deeply impressed with the necessi
ty of the Passage of a Prohibitory Liquor Law:
And Whereas, It is impossible to obtain a certain
indication of popular sentiment relating thereto by
means of petitions and remonstrance: Therefore,
gI. -Be it enacted by the Svnate and House of Re
presentatives of the Commonwealth' of Peansviaania
in Ocizeral Assembly mot, and it is hereby enacted
by authority of the same, That the qualified voters
of this Cointnonwealth are hereby_authorized at the
places for balding the general elections in their re
spective wards, boroughs end townstips, on the se
cond Tuesday of October next, to vote fur and
againq a law wnicb shall entirely prohibit by pro
pel and constitutional regulations and penallies,the,
manufacture and sale of intoxicating liquors, except
for medical,sacramental, mechanical and ortiatical
purposes. /
§2. That the officers authorized by law to hold
elections in each wird, borough and township, of
this Commonwealth, are hereby directed and re
quired at the place fixed by law, in the several,dis
tricts fur the holding of the general elections intatd
districts, on the second Tdesday of October next,
when they shall be organized as so election board,
to receiVe from esdh qualified voter of their din
tact& a ticket written or printed on the - outside.
Prohibitory Liquor Law, nod the tiokets in favor
of tbeproposed law shall contain in the inside the
words" For a Prohibitory Liquor Law," and those
opposed to the propesed law shall contain in the in
side words, `• Against the Prohibitory Liquor
Law," which votes shall be counted, and returned
to the court house of the naontiea or City, in which
the said election shall be beld, , on the following Fri•
day by the return judges, who shall cast up and
certify all the votes polled in said county or city, to
the office of the Secretary of the Cominonwealth at
Harrisburg, directed and transmitted in the sattte
manner, the vote* fqr Governer are required to be
directed and transmitted, and said Secretary shall
on the third Friday of January next ensuing, com
municate the said returns to the Legislature, to be
opened and counted in the same manner the votes
for Governor are opened and counted, and 'conaid
ered as the prayer of the voters of this Common
wealth relative to a Prohibitory Liquor Law.
