JL Friedman yesterday filed their reasons for asking for a new trial in tie case of George Strasser, who was convicted of murder in the first degree for the killing of Joseph BrandL They allege that he is not guilty of a higher decree of homicide tnan volun tary manslaughter at the most; that irom the character of the testimony on the part of the Commonwealth the prisoner ought to have. been acquitted. They also claimed the Court erred in over ruling the offer of the prisoner to show the violent and vicious character of the de ceased and the threats he made against the prisoner; that newly-discovered evidence shows testimony of the Commonwealth was false, and lor a last reason, that the Com monwealth failed to call Henry "Wenzell, an eye witness of the killing, who testified beiore the Coroner. Judge Kennedy di rected the paper to be filed. Before Judge Ewing J. K. Dain was tried on a charge of cruelty to animals. The case resulted in some pertinent remarks by the Court directed at the agent of the Humane Society. Dain was charged by "W. J. Backhouse, agent of the Humane So ciety, with cruelty to horses at the Sewick ley Dairy Farm in not feeding them enough, etc. tJndse Swing's Caustic Criticism. There was but little in the case, and Judge Ewing remarked that there were many of these so-called agents who are poor judges of law and justice, and go around seeking against whom they may bring charges in which there is neither law nor justice. The purpose of these socie ties is a good one, but some persons seem to enter them ior the purpose of getting into other people's business, at least it seemed so to him irom cases that had come before him. The jury returned a verdict of not guilty, and divided the costs between Dain and Agent Backhouse. Judge Ewing re marked that it was a just verdict "W. C Staving and Albert Braun, dealers in the Allegheny market, were each fined 300 and sent ten days to jail ior selling oleomargarine. The men, with others, were prosecuted by J. M. Anderson, the detec tive in the employ of Emil Winter, who is seeking to make the oleomargarine law obnoxious by 'nforcmg it. Several days ago they went into court and pleaded nolle contendere. The Court,as it has been doing, suspended sentence until the Supreme Court decides the cases now pending before it upon the men agreeing not to sell any more oleomargarine. The defendants prom ised to sell no more, and then, it is charged, returned to their stands and at once com menced selling. The Court was informed of this and they were sent for yesterday and sentenced. The fine was the maximum and the imprisonment the minimum for a first ofiense. On the second offense they can be sent one year to prison. STJIHG FOE THE PENALTY. Oleomargarine Cases Arsnetl Before the Supreme Court Justices. In the Supreme Court yesterday argu ments were beard in a number of cases. The cases of the Commonwealth ior use of G. V. Kuss against "W. C Stavine, Charles E. Shirley and Roberts & Cook, appeals from the Common Picas Courts, were heard. The suits were to recover the civil penalty ior violating the oleomargarine laws. They were appealed and the constitutionality of the oleomargarine law attacked. Upon the the iss&e of these cases a number of criminal cases well depend. D. F. Henry Geise was acquitted of the lar ceny of some chain from Daniel Peters, of Mansfield. James Gallagher was acquitted ot felonious assault and battery on Michael Fleming, of Torbes street S. Gallinger was tried on a charge of perjury. He was accused of testifying falsely before Alder man Kerr, when he accused Wm. Brown of the fraudulent conversion of partnership property. Gallinger was acquitted and the costs placed on Brown, the prosecutor. Charles Schuberts, of Malum street, was convicted of assault and battery on Susanna Tavlor, of 'WadBWorth street. Prank Thompson pleaded guilty to as sault and battery on Walter Crady at Eey noldton. "W. A. Carver was convicted of the larceny by bailee of a watch from Will jam Spencer, ot Mansfield. James Dawson and Tnomas Smith pleaded guilty to the larceny of some tobacco, etc., from II. C. Cyphers, of the East End. Andrew Beatty was tried on the charge of embezzling some rent from S.
