Donovan S250 and imposing ten days' imprisonment on him for his failure to ohey a writ of mandamus requiring him to actept the vote of Horace M. Lower in the Seventh elec tion district of the Second Assembly dis trict last election, the Court of Appeals, October term, has abolished the practice ol having a Supreme Court Justice hear ap plications for mandamus on election day. Other election days have been busy days at the county Court House. The Justice as signed to duty for the occasion up to about 3 r. ar. has had his hands full of business, and, indeed, it has sometimes been neces sary to have more than one judge act. Since the adoption oi the booth system of voting many questions have arisen concern ing it, and last election day many voters applied for ivrits who declared that the Inspectors had without proper cause re fused their votes. No Count to Be Held on a Holiday. Lower was one of three whose votes vrere refused. He had -found difficulty about folding hit ballots. He obtained an order to show cause why a writ .of mandamus should not issue against the Inspectors, re turnable forthwith. The Inspectors did not appear at the hearinjr, and Justice Law rence issued a writ ol mandamus against them. It was alleged that Donovan had set the writ at naucht, ana, when it was served, had said that he would not regard the order. Two of the Inspectors wanted to obey the writ, and the other, while voting with Donovan, did not use words setting the Judge at defiance. The general term affirmed the order ad iudtrinc Donovan in contempt. The appeal was on the cround chiefly that no court can J be held on a holiday, and that a mandamus can be issued only by a court, and not by a judge. This is not a's clear to the mind as to lawyers, who are obliged to discriminate between orders of Court and orders ot judces. In a long opinion, written by Juege Andrews, with Judge Grav dissent ing, the Court of Appeals decided that this position was well taken, and that no Judge throughout the State or in this district, where a special statute was pleaded, can issue a mandamus, but that it must issue from the Court. The Only Remedy "With the Legislature. "The right of a voter to vote," says the Court, "may be lost unless this power shall be conferred. "Under the statute no court can be opened within the State on the day of any general election to transact any business except for the purpose of receiving a verdict cr discharging a jury and for the exercise by a single. magistrate of certain jurisdiction in criminal cases. If an enlarged jurisdiction in these cases is ex pedient, the remedy is with the Legis lature." Justice Lawrence, who sat in private chambers for this work last election day, re fused to-day to .sppak.of- the case, but an other Justice of the Supreme Court, who did not desire to be quoted, admitted that no justice of that court will sit hereafter to hear applications for writs of mandamus, as no court can be held on that day, and this writ cannot, by the decision, issue except from a Court. This being the case it is fortunate for the Democrats in this city that a majority ot every board of election inspectors is Dem ocratic.
