EAUER AND NOED AGAIN INDICTED Hugh O'Dr-nnell, the recopnizcl leader of the locked-out men at Homestead, had a hearing belore Judge Porter yesterday afternoon, on an application to be ad mitted to bail on the charge of murder in connection vith the riot at Home stead on the morning of July G. O'Donnell was on Saturday arrested for the second time charged with the killing of the Tiukerton men. "When first arrested he was admitted to bail in the sum of 510,000. The hearing in ihe second esse was not con cluded yesterday. It will be continued this morning. Attorneys Knor, Breck, Patterson and Kobb represented the Com cionwealtlu The defense was represented by John F. Cot. When led into the courtroom by a burly officer O'Donnell looked about him like one thoroughly frightened. There were but lew of the Homestead peple present. To that Jew, however, the prisoner bowed politely and made an effort at emiling. He then bowed to the array of reporters that tat about the room. Then he took his seat ot the counsel table immediately behind his attorney, Mr. Cox. O'Donnell as Handsome as Ever. He looked remarkably robust His heavy black mustache, shining like a raven's wing, was curled back from his positive mouth. His hair, just as black as his mustache, stood erect His complexion, a deep olive, was tiuged a richer hue by his recent tra els and his hands looked as Bolt and wliite as a woman's. He evi denced some nervousness during the exami nation, and he constantly prompted his attorney. It was just 1:50 in the afternoon when the court opened. Without any preliminaries Captain Breck opened the case and read to the caurt all the evidence taken when O'Donnell wes admitted to bail several weeks ago. The reading of the testimony consumed nearly three hours. Then fol lowed the examination of witnesses. Captain Aul, formerly a DlSPATcn re porter, was the first witness. He testified to being with a man named Boyle, of Home stead, who was in Pittsbnrs on the night of .Tuly 5, watching tor Pinkertons. Boyle, the witness said, bad told him that the Pinkertons were coming cither by boat or railroa-'. The witness said that he had jiatroled the wharves ol both rivers looking Jor the Piukertons but had failed to locate them. He then returned to The Dispatch office, but had scarcely reached there when Boyle rushed in err much excited and said he had seen the steamer Tide with two barges ot Pinkertons passing under the Smithfie'.d street bridge on the way to Hucestead. A Telegram to Homestead. The witness then went with Boyle to a telegraph office he-e Bovle wrote a tele gram. It read: "Watch the rier; steamer is coming Tith barge0." It was addressed to Hugh O'Donnell, Homestead. The mes sage was sent a few minute belore 2 o'clock In the morning. Walter J. Cliristv, a Disr ATCit reporter, the next witness, told ot Boyle's coming into Tun Dispatch office and asking to have some one sent with him to watch lor the Pinkerton's. The witness also testified to having introduced Captain Aul to Boyle. The two then went o.i to lok lor the Pink ertons. J. 11. Tanner, formerlv a Dispatch re porter, was the next witness, and for over an hoar occupied the stand. He told of the arrangements made among the strikers to divide the work of keeping out non-union workmen. He told ot the cration of the river patrol, which was kept constantly on guard. The following day O'Donnell gave the witness a list of the people who would be allowed to enter the mill property, which embraced the watchmen, the Govern ment inspectors and the company's clerks. The witness became somewhat contused over O'Donncll's statement to liim about deputv s'lerifis and all the lawycis and Judc Porter took a hand iu firing a volley ot questions at the con tuse i witness. It was finally developed that O'Donnell had told Tanner that he did not care if the Sheriff put 500 Pittsburg deputies at Homestead. Gregg, of the Cleveland Press, was in the cupola in the afternoon of July (i while the strikers were throwing the dvnamitc The witness said he heard O'Donnell say, "It's funny they can't sink those boats." George J. Campbell, editor of the West IIli7abeth Star, said he was present in the afternoon when the men were trying to pump oil on the barges. He heard some one suggest that they put the oil on rafts and floatit down against the barges. He looked around and saw O'Donnell pointing up the river. He thought it was O'Donnell w ho had niidc the remark. II. B. Layton, the Pittsburg representa tive of the Chicago Tribune, saw O'Donnell in the Postal Telegraph Company's office on the night of July C. He had a gun with him and threatened the witness' lite. C C Ileese heard O'Donnell say on the afternoon ot July G: "This is a great revo lution." John Gregg, a Times reporter at the time ot the not, was the last "witness. He did not know anything new, and the hearing was continued until 9:30 o'clock this morn ing. John McFarland, Jessie Lutz, Jacob JIaurcr and Archibald Goet, four men of Homestead, arrested on Saturday for inter fering with officers and workmen, appeared before Alderman McMasters yesterday morning and entered bail for a hearing at 11 o'clock this morning. In the Criminal Court yesterday Eobert Golden was convicted of assault and bat tery on Edward Maxwell, of the East End. Emma Snyder pleaded guilty to the lar ceny of a pocketbook from R. F. Thursby, Center avenue. Amelia Jones, Jor illegal liquor selling, was fined 51, '-'00 and sent six mouths to the workhouse. A. S. Ludwig for felonious assault and f b-vttery, was sent ono year to the work house. M. Keenan is on trial for the larceny of a watch from B. Keenan. James Thompson was acquitted of the forgery of a check in the name of J. S. Conners, of Braddock. T. B. Jloreland, of East Liberty, failed to respond on roll call as a juror, and an attachment was issued for his arrest on con tempt of court A Damage Suit for Assault Jlathias Zetnan and wifeyesterday entered suit against John Glaser for damages.
