COTJ5CILMEJf MAT SUSTAIN' THE ACTIOS Mayor Gourley yesterday publicly an nounced for the first time that he had de cided to veto the resolutions providing for the purchase of the Fite, Flinn and Lock hart properties as an addition to Highland Park. The Teto messages were written nearly a month ago when it was expected there would be a special meeting of Coun cils. The Mayor declined to say at that time what he proposed to do about the resolutions, though it was generally sup posed that as lie bad not signed them he in tended to turn them down. Kow that his action in the premises is definitely known, there is much speculation as to what Councils will do. A considera ble effort was required to persuade a major ity of the Councilmen to vote for the pass age of the bills, and, as some members have since stated, those who favored the purchase used the argument with Councilmen, in or der to secure their votes, that the Mayor was in favor of adding this property to Highland Park and w ould surely sign the resolutions. Several members who are usually passive in matters of this kind opposed the resolu tion vigorously, though it was represented to them that tbe measures did not provide for an actual purchase, but were merely necessary to keep alive options on tbe land, so that next February, if Councils choose, an appropriation of $250,000 can be pro vided and the property purchased. John Lambie, Dr. Evans and others op posed this argument, stating that by the terms of the bills the city would be bound, if they became law, to buy and pay for the property, no matter what statements might be made to the contrary. It required adroit maneuvering on the part of the other side to counteract the effect of Mr. Lambie's argument, and several members iu voting explained their position by saying they voted lor the resolutions with the under standing that only the holding of options on the property was contemplated, and that they would not vote to buy outright. berlom Charge by the Mayor. It is now believed that not enough mem bers of Councils can be secured to override the Mayor's veto. He will not make pub lic the nature ot tbe arguments he uses in bis disapproval message, but it is under stood that he w ill charge misrepresentation en the part of certain Conncilmen and oth ers, both as regards his position on the reso lutions and the ultimate effect of their pass age. It is known that the Mayor is op posed to increasing the size of either of the present parks. He did, at first, favor the purchase of the Fite property because he believes that the present entrance to High land Pvrk is too small and insignifi cant lor the beautiful stretch of land beyond, and that with the addition of the Fite strip on the east side of Highland avenue there n ould be room enough to ar range an entrance commensurate with the size and importance ot the park. But he is opposed to buying the Lockhart and Flinn properties and, while he would have been willing to buy the Fite tract, he feels that be cannot consistently favor the purchase of one and not alL The Mayor has given mucb study to tbe park question within the past six" months, and has arrived at tbe conclusion that Highland and Schenley Parks are already large enough. He thinks that Highland Park is too far out to become as popular with the mass of the people as it should be, that its location is such that it will always remain so, and that, barring a comparative Jew who can remain close to it, the people must always pay car tare to get to it As to Schenley Park, he believes it will soon be the center ol the cit 's population, and will always be the most convenient and the most popular with the common people. Favors a Southside Parl& He also thinks that unless one owns a horse and carriage even Schenley Park is too large. Xo one, he thinks, cares to walk over a tract of more than 100 acres, and it would be iar more beneficial to the people to have several parks of that size than two large ones in one end of the city. He thinks the next money spent for parks should go to the Southside. Twenty, 50 or 100 acres could be bought on the Southside bills, and with a little improvement would be a vast comfort and benefit to tbe large population of that section. The people of the Lawrenceville and Bloomfield districts should have a park also, he thinks, and then those of the West End. He uses the same argument for im mediate purchases in these various sections that Chief Bigclow does for extending the territory of Highland Park, that is, that now is the time to buy, because in a few j ears property will have so increased in value that the expense will be more than double as great as at present. Another point the Mayor will probably touch upon in his veto message is that while the figures on the various tracts in question are probably lower than market values he is opposed to buying unnecessary land, when tor lack of money the city is leasing and paying exorbitant rents for property lor the public works and salety depart ments in various parts of the city which public economy would indicate should be owned by the city. ALVEKTISIHG THE TOWS. City Clrrk Booth Gets a Magnificent Map or Melbourne, X. S. VT. City Clerk Booth received a communica tion yesterday from John Clayton, the town clerk of Melbourne, X. S. W., containing an order of the town council requiring Mr. Clayton to send to this city a map of Mel bourne. It is a drawing in detail of the business houses and buildings from a bird's eye view, and is a most excellent and beau tiful picture, calculated to impress one with the importance and magnificence of the place. Mrs. Cntkljky Died or Strangulation. The autopsy ordered by the Court on the body of Mrs. Max Cutkisky was held in tbe Hebrew Cemetery yesterday by Dr. J. W. Boyce, of Mercy Hospital. He was assisted by Drs. J. Guy McCandless, J. P. McCord and K. E. Warner. The examination failed to show anv sisns of foul play, and the woman evidently died of strangulation. Struck by a Cable Car. A wagon belonging to George Harrison, a sign painter, was struck by a cable car at Thirty-ninth aud Butler streets last even ing and was completely demolished. Jndgs Acheson Hands Down a Decision In the Case or John Matthews Against the Fidelity Title and Trust Company Court Notes, in the United States Circuit Court yester day Judge Acheson handed down an opinion in the case of John Matthews against the Fidelity Title and Trust Company, as trustees of the Lawrence Bank, to recover (21,000 on a mortgage. The mortgage wa given by Moorhead, McCleano & Co. to Mat thews, who deposited It in the Lawrence Bank. The latter gave It as collateral se curity to the Union Bank. It was subse quently paid by Moorhead, McCleane 4 Co.. and the Union Bank credited tho amount to the Lawrence Bank. The Lawrence Bank Bald most of Its Idebtodness to the nion Bank and tho latter made It all pood with some of tho mortgage money. The balance, $21,000, was turned over to the Law rence Bank's trustee, the Fidelity Title and Trust Company, and Matthews sued tore cover it. Judgo Acheson decided that the mortgage had been merely loaned to the Union Bank nnd that Matthews was entitled to tho amount sued for. A Requisition for Tapper. District Attorney Burleigh yesterday signed an application to Governor Pattison for a requisition on the Governor of New York to obtain B. Tapper, who is under ar rest in New York Citv. Tapper is charged before Magistrate McKenna with the larceny or $200 w orth or clocks and wringers from the C. F. Adams Companv of Liberty street. He was arrested in Sew York Wednesday, on a telegram sent to the police officials by Superintendent O'Mara. He will be brought back as soon as the papers are obtained. Want a Jury Trial.
