r:-'vKTTOc?- wmmt'mf' TH PITTSBUEG DISPATCH: nT TUESDAY. APRIL 26, 189a' SPIRITS AS ADVISERS. Peculiar Allegations Made at the Hearing of a Will Contest. FORGOT HER OWN SISTER'S NAME. in Attorney Pleads a General Belief in Fortune Tellers. CHAEGES MADE AGAINST A MINISTER Spirits were introduced into the Orphans' Court yesterday, and fortune telling ra more than a side issue in the contest of the will of the late Anna Keitr, of Pittsburg, before Judge Over. The testator died July 6, 1891, leaving an estate worth about 513,000. By her will she gives J2.000 to the Evangelical Lutheran St Paul's Church, 52,000 to the Concordia Orphans' Home, of Delano, Pa., 5500 to the Martin Luther Orphans' Home, near "West Eoxbury, Mass., 5200 to Konrad Poectlor and 55 to her sister, Eva Martin. The residue of her estate is given to her pastor, Eev. Nicholas Soergel. The will is contested by her sister, whose name, however, is Mrs, Eva Domhofl and not Martin, as stated in the will. Mrs. Domhofi states that she is the sole heir at law of the deceased. Making a 'trill Under Difficulties. She asserts that her sister was of unsound mind, and incapable of making a will; that she was 76 years of age when she died, and could not read or write Engisb. She claims that the deceased did not know tbe value of her estate, nor had she any knowledge of the two Homes she made bequests to. The Rev. Mr. Soergel, who wrote the will, it is charged, used undue influence over her, and retained tbe will in bis possession, the de ceased never knowing its contents, except what he might have told her when she made her mark to it. An evidence of her Memory was that she did not know her sister's name, the latter having been mar ried to Domho9iorl5 years. At the hearing yesterday Attorneys L. P. Stone and C Hasbrook appeared tor the contestant, and J. S. Ferguson in support of the will. The contestant, as an evidence of unsound mind, oflered testimony to the effect that tbe deceased had consulted fortune tellers. Tlie Fate of Three Attorneys. It was showed that she had asked a fortune teller about three attorneys she had em ployed. The fortune teller told her they were no good and she discharged them. She also asked about her son, wanting to know if he would remarrv. She was told he would. He did, and afterwards died. Attorney J. S. Ferguson, for the will, comended-that the fortune telling matter was not evidence of unsound mind. He said that if it was, two out of every three wills could be thrown out. He ofiered statements by various writers to the effect that 65 out of every 100 persons believe in fortune tellers and matters of that nature. Testimony was also offered that the old lady had believed she saw spirits and that they came through key holes to visit her. The case was continued until to-dar. NEW ADTEBTI3EBCENT3. The case of the contested will of the late Mrs. Charles Fisher, of Lawrenceville, is on trial before Judge Stowe. The will is being contested by Mrs. Fisher's husband and five children, the estate bavins been left to one son, John Fisher, Jr. The case was certified from the Register's office to the Common Pleas Court tor jury trial, and the action is entitled John Fisher, Jr., and G. C Hartman and J. McKee, executors, against Lena Schmidt, Carrie Siebert, Charles Fisher, Mary Kimberly, Annie Beilly and Ida Fisher. Those named as de fendants are the contestants. They allege that their mother was men tally incapable of making a will by reason of age and the use of intoxicating liquor, and that undue influence was used.
