JInrdcr Case, Now on Trial.

PROCEEDINGS OP THE COUNTY COURTS
Jan Janoski was placed on trial in Crim
inal Court yesterday for the alleged murder
of Casper Xomezk. District Attorney Bur
leigh conducted the prosecution and Attor
neys Frank I. Gotser and J. B. Owens the
defense. The defendant and the deceased
had been friends and were having an un
usually merry time on Christmas. They
were at the house of Albert Mackowiack,
803 Manor street, Southside, where the de
fendant boarded. "When last seen together
they were in the hallway, talking. The
deceased complained the next day at his
boarding house on South Tenth street that
he had been assaulted by the defendant and
knocked down and jumped on. Peritonitis
set in from wounds he had received, and on
the following Wednesday he died.
The morning was taken up in securing a
jury and hearing the evidence of the physi
cian relative to the cause of death. Stanis
laus Pshybelsky, the proprietor of thchone
where the deceased boarded, testified in the
afternoon that the deceased was well Christ
mas morning and had not been drinking
much.
Alderman Beinhauer testified to taking
the dying deposition of the deceased, and it
was placed in evidence. It stated that the
deceased was not drunk nor had he pro
voked the defendant. The latter.lt averred,
hit him, knocked him down and Jumped on
htm. Injuring him severely.
Several other unimportant witnees were
beard and the prosecution closed. The de
lense opened bv claiminc that the alleced
r flair was in the aftoruoon of Chiistmas, In
an open hallway, throutrh which people con
stantly were parsing, jet no ono claimed to
have ecen an assault or a struggle. Mrs.
Kate Biazak Mas called. Sho had seen the
two men In the hallway. Tho deceased was
vrrvitrnnk. Ko ouarrcl occurred hetw oen
the two men that he saw and their rela
tion appeared friendly. The defense here
called scleral vtitneses to prove that the
deceased had lieen very drunk. The court
then adjourned and the tiial will bo re
sumed this morning.

Clelland was tiled yesterday for probate.
Tho instrument is dated September 13, 1839.

$2,000 Is to be paid to Mrs. Ada 1). Canfleld,

the advantage of John D. Foster and Anna

Foster, her sister, to whom the testator wm

monev is primarily for the benefit of
the children and secondarily for the
benefit of Mrs. Canfield To hundred
iiciven to Mrs. Kate S. Hammer, widow of
1'hilip C. Hammer, residing at No. 112 Forbes
street, on account or lierson William, named
after tho testator. Two hundred Is ptven to
the Misses Mackeown, of JJo. 322 Liberty
street, as a slight toKen of hi appreciation
of them. Two hundred Is also given
to Mrs. Miranda A. Allen, colored, of So. 26
High street, 'n addition to what he
regularly paid her. on account of tho faith
ful care given his room and clothes for
fi ften years. In case of the death of any of
those to n horn the bequests aro given, be
fore the testator, tho money Is to go to his
4ter, Mrs. Mary Winter, of East Palestine,
Ohio.
After the payment of his debts, "of which
at present writing I have none, except good
will to all," as stated.the cost of a tombstone,
etc., all the residue of his estate Is given to
his mother residing at East Palestine Ohio.
, His brother-in-law, the Kev. T. W. Winter,
of East Palestine, Is appointed executor
r without bond.
After 820,000 for rersonal Injuries.
A statement was filed yesterday in the suit
of Hannah Wilson against tho Citizens'
Traction Company. Twenty thousand dol
lars damages are asked for personal Injuries.
The plaintiff states that on November 19,
1S91, she was a passenger on carJTo. 103. At
the corner of Butler and Thirty-seventh
streets the car ran into a wagon. She was
thrown across the car and cut and bruised,
and permanently injured internally. The
company, It Is claimed, is liable for the acci
dent. "Want an Agreement Carried Out.
A bill In equity was filed yesterday by
Margaret S. Stewart and Martha ". Stewart
against D. B. AVilson. The plaintiffs state
that on December 18, 1391, Wilson made an
agreement in writing to purchase from the
plaintiffs the property at "o. 205 Arch street,
Allegheny, for $4,000. He has since refused
to fulfill the agreement and the court is
asked to compell him to do so.

Barton, administrator or Annie Smith, an
action to recover for board, a verdict was
given yesterday for $31 50 for the plaintiff.
A veiidict of $100 for the plaintiff was
given yesterday in the case of Honora
Clark against ex-Mayor Robert Liddcllfor
damages for alleged libel in accusing her of
perjury.
A verdict of not guilty was given yester
day In the case of James Green and William
Xoonan, tried Wednesday on a charge lot
burglary for entering the house or Willain
Smith, or Oakland.
In the cae of Eosenhain Bros, against H.
A. Batzer & Co., an issue to determine tho
ownership of five barrels of whisky, a ver
dict was given yesterday for the plaintiff for
the whisky in question.
Is the ejectment knit of John Balston
against A.J. Xcllls & Co., a verdict was
given yesterday for the plaintiff for tho
property in dispute to bo released on the
payment of $3,490 within GO days.
A verdict for tho plaintiff was given In the
suitor J. J. Turner. against John Cleland.
The case was an Interpleader to scenro per
mission to intervene with a claim on an exe
cution issued against the defendant.

cuit Court yetteiday, handed down decisions
In favor of the plaintiff in the cases of -John
Lane against Sarah Park et al and Anderson,
De Pny & Co., for infringements on patents
on cultivators and plows.
A verdict for the defendant was given
yesterday In tho suit of James L. Kelly
against William Kerr. The suit was for
damage. Kerr, It was alleged, had gone to
the house or Kelly to erve as a witness for
a tenant of Kellv's, who intended to mako a
demand on him for tho keys of a house.
Kelly, it was stated, tried to bar Kerr out,
but the latter pushed the door open and, it
was asset ted. in so doing hnrt Kelly. The
latter then bronzbt the suit for damages for
bis injuries.
