PROCEEDINGS OP THE COUNTY COURTS Jan Janoski was placed on trial in Crim inal Court yesterday for the alleged murder of Casper Xomezk. District Attorney Bur leigh conducted the prosecution and Attor neys Frank I. Gotser and J. B. Owens the defense. The defendant and the deceased had been friends and were having an un usually merry time on Christmas. They were at the house of Albert Mackowiack, 803 Manor street, Southside, where the de fendant boarded. "When last seen together they were in the hallway, talking. The deceased complained the next day at his boarding house on South Tenth street that he had been assaulted by the defendant and knocked down and jumped on. Peritonitis set in from wounds he had received, and on the following Wednesday he died. The morning was taken up in securing a jury and hearing the evidence of the physi cian relative to the cause of death. Stanis laus Pshybelsky, the proprietor of thchone where the deceased boarded, testified in the afternoon that the deceased was well Christ mas morning and had not been drinking much. Alderman Beinhauer testified to taking the dying deposition of the deceased, and it was placed in evidence. It stated that the deceased was not drunk nor had he pro voked the defendant. The latter.lt averred, hit him, knocked him down and Jumped on htm. Injuring him severely. Several other unimportant witnees were beard and the prosecution closed. The de lense opened bv claiminc that the alleced r flair was in the aftoruoon of Chiistmas, In an open hallway, throutrh which people con stantly were parsing, jet no ono claimed to have ecen an assault or a struggle. Mrs. Kate Biazak Mas called. Sho had seen the two men In the hallway. Tho deceased was vrrvitrnnk. Ko ouarrcl occurred hetw oen the two men that he saw and their rela tion appeared friendly. She was thrown across the car and cut and bruised, and permanently injured internally. The company, It Is claimed, is liable for the acci dent. "Want an Agreement Carried Out. A bill In equity was filed yesterday by Margaret S. Stewart and Martha ". Stewart against D. B. AVilson. The plaintiffs state that on December 18, 1391, Wilson made an agreement in writing to purchase from the plaintiffs the property at "o. 205 Arch street, Allegheny, for $4,000.
