COXTEOLLER GRIER'S ANSWER FILED The jury in the Taylor murder case re turned a rerdict yesterday of voluntary manslaughter. The result was considered quite a victory for District Attorney Bur leigh, who was thought to have a very meager chance to make out a case when he commenced. It was conceded, however, that he won the case on his presentation of it to the jury. He expressed himself as very well satisfied with the result, but Mr. MeQuaide, counsel for the defense, thought the jury had taken an extreme view of the case, and was inclined to regard the verdict as a notice that a freeman's home is no longer a freeman's, cattle. .Judge Porter sentenced Henry Huserand "W. J. Groft yetterday, who were convicted earlier in the week of the killing of "Will iam J. Kelly in Lans's saloon at "Webster. Groft was sentenced four years and three months and Huscr four years and tea months to the penitentiary. SheriffMcCleary read the death warrant to Patrick Fitzpatrick yesterday, who has been ordered by the Governor to be hanged on March 1, between the hours of 10 A. Titzpatrick showed no signs of concern as the document was read to him. and refused to look at it himsclC The con demned man entertains no hope of a com mutation of sentence Another murder trial will be commenced in Criminal Court to-morrow. It is the case of Baptise Celeste and Michael Sheiler, Edward Le Grand and Amaut Deliss, who have been indicted ior the killing of Xapoleon Le Grande, a brother of one of the defendants. The murder occurred at a party at Tom's Run, some months ago, and consisted in Le Grande being hit over the head with a beer glass. The jury in the case of John S. Dawson, of Homestead, charped with the assault of his 12-year-old d tusliter, brought in a ver dict of guilty yctcrdav. Other sentences in Criminal Court were: Joseph Miller, larceny, ten days to work house: T. County Controller Gricr yesterday filed his answer to the mandamus proceedings instituted by Deputy District Attorney Goehring to compel the Controller to pay him his salary for November. In his answer the Controller states that the salaries of officers of Allegheny county are governed by the fee bill act of March 31, 187C. It provides that the salaries arc to be paid out of the fees earned by the respective offi cers. Unier an act of lSfiT two thirds of the fees earned by the District Attorney go to the maintenance of the Dis trict Attorney's office, and one-third for the Assistant District Attornev's office. The carnintrs of the office for the year 1891 were f 10,747. "When the salaries ot the Distiict Attorney and As sistant District Attorney and their clerks were paid there remained ?64 84. There is tio sinking or other fund for the purpose, and theiefore there is no moneys from which Goehring's salary can be drawn. The Controller further maintains that there is no act of Assemblv or authority in law to create the office of Deputv District Attorney and the Silary Board hpd no authority to organize such an office. It is further stated that the present Assistant District Attorney, John S. A charter was granted yesterday in Com mon Pleas Io. 3 for the Duquesne College. The application was the second one made, the first one being contested by the Western University, which laid claim to the name of Duquesne College. The Court refused the application because of the clause granting the college the power to confer degrees. It was held that the court had no power to give such authority. In the second appli cation the clause referring to granting de grees was omitted, and the charter was granted. A charter was also granted the Germania Liederkranz.
