Allegheny County Decisions Handed Down bj the Supreme Court. SO iyjDXCTIOXS AGAIXST DEPOSITS The trial of Henry Huser, principal, and "William J. Groft and Barney Huser, as ac cessories, for the murder of .Henry H. Kelly at Webster on the night of August 22, 1891, was begun before Judje Porter jesterday. It is Judge Porter's first case in his regular official term. It will proba bly be finished to-day. District Attorney Burleigh and William ifcElroy represented the Commonwealth, and D. F. Patterson, who was one of the attorneys for the defense in the trial of James Xutt some years ago, appears for the defendants. The row in which Kelly was fatally wounded occurred in the saloon of George Xang, in Webster, Westmoreland county. He was removed to his home in Forward township, this county, where he died on the night of August 24. All of the fore noon yesterda as consumed m securing a jury. The case wa- opened by District At torney Burleigh, and Dr. C B. Wood, who had attended Kcllt, was the first witness He descnoed the w ounds found on Kelly s body and testified that lie bad died from exhaustion and loss of blood, having had several hemorrhage. W L. Kelly, a bi other of the deceased, was the next witness, but his testlmonv w is un important, except to show that his brother had good health previous to the time he was wounded. A. A. Tilbrook testified to having helped Kelly up over a bank after he had Deen cut, but he did not see the cutting Eeese Boj d saia he was standing in front of the saloon when Kellv first put in an ap pearance. The latter got into a controversy with a German and then went Into the saloon. In a very short time Kelly and three or four men came rushing out. They were striking at each other. Witness then went into the saloon and notified those present that there was a row outside. When he came out again the cutting had been done and Kelly was coming up o er a bank. E Kne was the next witness, and it seemed that he was the best jet called for the Commonwealth He aid he saw Groft and Henri Huser push Kelly up into the closet Witne- started into the saloon for help, n hen Henry Huser threatened to kill him. He braced himself against the door, and two men, Huserandanotherone, caught hold of him Huseraccused witness of call ing him nimes, and said he would kill him. In the meantime two other men. whom the witness could not identify, although he thought Groft was one of them, bad Kelly cornered in tl'e closet adjoining the saloon. On cro-s examination. An Action Against the Duqnesne Becanse of the Color Line. J W Echols, Esq , yesterday entered the suit of Stephen W. Duncan, colored, against John W: Noi ton andDaaid Henderson, do ing business as John W. Norton & Co , pro prietors of the Duquesne Theater. Duncan states that on December IS, 1S9L he went to the box ofliee of the Duquesne Theater and purchased two tickets for two reserved scats, paamg $1 50 for each ticket. They were for the ea euing of December 22, at the Terformaiice of "Mie Stoops to Conquer" by Stuart Robson On the e cmng in question he and a ladj friend w cnt to the theater and presented then tickets They were received by the ticket taker, who gave them back the coupons for the -e.its and directed them to the "left-hand aisle." They g-tve the coupons to an usher, who became soniewhit conlused, and fiui'la told them their seats were up-stairs Toaaoid trouble they went up into the balcom. The ushers there consulted and finally offered them scats behind a pillar in the reiror the bilcony. Thej refused to accept them and demanded back their coupons. Excuses were made and they weie sent hack aim forth, but did not get the coupons. Foi the inconvenience and injury done him, Duncan now asks $1,001 damages. THE INJUNCTION EEFTJSED. An argument was heaid before Judge Col lier yesterday morning in the case of Carne gie, Phipps&Co. agjinst the Philadelphia Gas Company The suit is to compel the gas company to supply the plaintiffs' mills with gas as per a contract made in ls&k Tne gas company claims that they nave not sufficient gas to supply both mills and private con sumers and they have elected to supply the latter when a preference must be made. NOT SHOPLIFIEES. Trial of Two Accused Women Results in Their Acquittal. Criminal Court reopened yesterday, after its holiday rest. Judges Porter and- Ken nedy changed rooms, as compared with the manner in which they sat during December. Mollie Camp and Theresa Teets, who were charged witn shoplifting at Home's store, on December 17, 1891, weretriedbefore Judge Kennedy in room No. 1. It was alleged that they had stolen a French cape valued at $18. Both defendants were acquitted. Theresa Teets at times assumes the name of Killan, and is the woman who was con cerned in the Alex. The jury is out in the suit of Jacob Haller against the Citizens' Traction Com pany for damages for injuries. Haller al leges that as he was about to get on a car it was started too soon, and he was thrown to the ground and severely injured. TnE testimony taken in the divorce case of Margaret Dunkel against W. W. Dunkel was filed yesterday. They were married January 1, 1873, and separated July 18, 1891.
