A LIVELY STRUGGLE FOR POSSESSION The Covenanter Church troubles are now .fairly in court, and a met important point -ivill be judicially decided. Attorneys Sol Sclioycr and J. F Hunter yesterday filed the answer of the Jjist End Reformed Pres byterian Church to the suit brought by John 3C Dcnhoim to foreclose the mortgage on the church uropcrty. The mortgage is dated June 27, WJ1, and is tor 52,093. It -was pay able in;tOdas from date, and contained a dante of lorfeiture if not paid in ten days. The case is really a fight to obtain posses sion of the church property between the supporters of the Ue. O. IJ. Milligan. former! pastor of the congregation, who was deposed by Synod tor his part at the famous "East End meeting," and who is noK in the T7. P. Church, and'the faction cf the congregation tiho remained as the Kast End l'eformed Presbyterian Chuich. The answer to the foreclosure proceedings as made by John C. Caldcrwood for the con gregation. He recites the trial and suspen sion of the licv. O. B. Milligan, pastor of the church, and the withdrawal ot Milligan and Jiis followers, including James 3JL Den liolm and 'William J. Barnett, from the Be formed Presbyterian Church, and their connection with the T7. P. Church. P. thurcli building. An equity suit was brought to prevent interference. Contin uing, the answer states that if the church corporation is indebted in any manner, for which indebtedness the mortgage was given, it is not to the plaintiff It is charged that the procuring of the morteage to be civen was in collusion and with an intent to un duly control the property of the congrega tion in theccnts which have since led tothe suspension and disenrollmcnt of Milligan, Denholmand others from membership in the congregation. The rnone covered by the mortgage was ndvaneed lrom time to time by James jl. Dcnhoim, without any authorization of the congregation. Prior to the date of the mortircce the withdrawal of Million and his followers had taken place, and James 3L Denholm, "William Barnett and others, in sympathy with Milligan and intending to secure control of the church property, caused the mortgage to be given for the al leged indebtedness. The mortgage was no protected by anv valid compliance with the laws oi the congregation, and Denholm put i in the name of his brother, John K. Dcnhoim, so it would not appear on the fcce of it that the President of the Board of Trustees had to execute a mortgage to lurnsclf as au individual. The Distinct Charge Iliad?. Barnett, who signed the mortgage as President and Secretary of the Board of Trustees and attached the seal of the congregation, had no right to do so, as thev were no longer members. Also that the triving of the mortgage or incurring of the indebtedness was never authorized at any legally called meeting of the corpora tion.
