Judge Stowe yesterday handed down an
opinion in the cate of Clerk of Courts Ic
Gunuegle against Controller Grier. The
case was an application for a writ of man
damus to compel the Controller to grant a
warrant for a month's salary for Alexander
McGunnegle, a clerk in the office of the
Clerk of Courts. The Controller refused to
issue the warrant hecause the Clerk, he
claimed, had not worked during the month.
Judge Stowe, in his opinion, decided that
tinder the law the Controller could refuse to
pay the 1)111 if he saw fit to do so; it was
M-ithin hte diFcretionary power. If tlio
claimant saw lit ho had a remedy by an
ordinary action at law. The petition for a
mandamus was dismissed.

claimed to have paid his fare, while the con

day entered suits against Benedict and Ger
son Mi-eng lor $5,000 damages for alleged
false arre-t. It is asserted that the defend
ants caused informations jo bo made against

The regular quarterly meeting of the
Monongahela Presbytery was held In tho
Shndysldo United Presbyterian Church yes
terday. A motion to have the rireachers ox
change pulpits and try to raise money was
laid on the table. In tho afternoon a call
was extended to tho Synod to hold Its regu
lar mooting, which occurs on tho third Tuos
day in October, to meet In the Sixth Church.
It had previously been definitely settled
that tho Synod was to meet in Pittsburjr,
out no church had been selected. Kev. M.
Samson received and accepted a call fro'n
the Homestead church. Rer. Mr. Samson
will bo installed next month.
The evening session was devoted to tho
installation of Iter. J. K. JlcClurkln as pas
tor of the Shad side church. The services
were under tho charge of Moderator Elliott,
Rev. A. P. Duncan preached the sermon.
Hev. JL 31. Russell charged the pastor and
llev. Dr. Keid chargod the people. The
church was crowded.
