Whereas, Certain persons, companios, cor porations and associations own and main tain in the borough of Glenfleld gates hung and arranged to open and swing out and to ward boardwalks, pavements and streets, and Whereas, Gates so placed nnd hung and arranged are liable through negligence or otherwise to be left open and thus obstruct such boardwalk, pavement or street where such gate or gates are located. In fact, gates so hung and arranged have been and are now allowed, through the negligence of per sons owning, maintaining and using such gates to remain open, thus obstructing boardwalks, pavements and streets, and, owing to the position of such gates, the arrangement and operation of same and re sults tbereor, they are deemed to be danger ous topedestrians and area public nuisance. Section L Bo It enncted by the Burgess and Town Counciloftlie borough of Glenfleld,and it is hereby enacted by the authority of same. They, any and all person or persons, com panies, corporations or associations now owning or maintaining within the limits of the borough of Glenfleld, gates hung or ar ranged to open or swing out and toward the boardwalk, pavement or street, shall, within ten days from date of notice from the Coun cil of the borough of Glei.fleld, remove such gate or obstruction, and if such gate or gates Bo located, hung and arranged have not been removed within the time as stated in such notice, then the same can and shall be re moved by the proper authorities of the borough of Glenflold at the proper cost and expense to party or parties, companies', cor porations or associations owning and main taining such gate or gates. Sec. 2. Any person or persons, company, corporation or association wilfully violat ing this ordinance, shall, upon conviction be fore the Burgess or Justice of the Peace of said borough, on first offense pay a fine of three ($3 00) dollars, together with all costs of suit and collection of fine. Upon con viction on second nnd all succeeding offenses the fine shall be not less than five ($5 CO) nor more than $20, together with all costs of suits and collection of lines. Sec. 3. Whereas, The common uuoand practice of running loaded wheelbarrows on and upon boardwalks has proven destructive to walks so used, and Whereas, The running of wheelbarrows, bicycles, velocipedes, carts, wagons and sleds on walks and pavements are an ob struction on same, dangerous to citizens and the public generally, destructive to property and has become and is deemed a public nui sance, therefore, Section 1. Bo it enncted by the Burgess and the Town Councils of the botongh of Glen fleld, and it is hereby enacted by the author ity of the same, that no person or persons from the date of the adoption and passage of this ordinance be permitted to run wheel barrows, bicycles, velocipedes, wugons,carts or sleds over or upon the walks or pave ments along public roads, or streets. sec. 2.
