He has consented to asiist Judge Evrinij this term, which trill relieve Judge Magcc, who -was assigned to help Judse En ing, and allow him to attend to Common Pleas work. The case before Judge McClung yesterday was that of Catharino Ualkovic, a Slav living in Alle gheny. She was indicted for infanticide, but as there was no evidence that the child had been murdered she was only tried on the charge of concealing the death of a child. A nolle pros was allowed in the co of Mora Voveuic, indicted with her as an accessory." after the fact. "The Jury re turned a verdict of not guilty. In Judco Ewing's branch of the court John aily pleaded guilty to larceny and false pretense. Daily was employed by E. a Campbell, of Sharpsburg. and one day lclt, taking with him a quantity of clothing, money, jewelry, etc., belonging to Camp bell. The latter started after him, and find ing him at the Union depot arrested him. AVhen he seized Daily the latter drew a re volver and tried to shoot him. Daily was sentenced two years to tbe penitentiary. William 3Iarball, who was tried Monday Icr attempting tocommit an assault on John A. Kyle and ratrick Xeelan, at McKee's Hocks, w as found not guilty. John Macbeth pleaded gnilty to nault and battery on Mrs. Annie Paul, Augut , in Strawberry alley. He was sentenced throe months to jail. George l'enrod pleaded guilty to the lar ceny of a watch from C. E. Smith, June IS. at a boarding houe on I'enn avenue. He was sent one vear to the woikhouse. Long pleaded guilty to stealing a vuit of e.othes from a room mate in a boardine house in the Fifteenth ward, August 21 He was sent seven months to tbe workhouse Jeff Mav pleaded guilrv to the larceny of a watch lroni E. H. Woods, July 26, at tho lreton Hotel, Grant street. He was sen tenced one j ear to tho workhouse. Charles Robey. of the Third ward, Alle gheny, pleaded guilty to tholarceny ofa ring Jrom airs. Fisher and an umberella from Amanda Crable, August 7. He was sent to the woakhouse. James Hona'd pleaded guilty to the larceny of J2 from Jo'in Stagman, July 19. He was sentenced nine months to the workhouse. Margie Fogarty pleaded guiltx to selling liquor without a license, on Nixon street, Twonty-ecoud ward, on information of C. AV. Van Ebseu. ' A bill in equity was filed yesterday by Da vid N. Lea against John L. Moore, the Soutbside Oil and Gas Compan' and the Itoyal Gas Company. The suit is brought to have declared void an oil and gas leate. Lea leased to Monro, who assigned the lease to the Isouthsiilc company. They only drilled far enough to get gas, and tiicu rented the well to the HojalGas Com pan v for $509 per month. As the terms of the lease to com plete an oil well within a year were not complied with. Lea wants it declared void and the defendants compelled to account to liim for the gas obtained. The Mansfield Coal and Coke Company yesterday filed a hill In equity against W. L. Mellon. The plaintiffs own the coal under land in Collier township, purchased from James Xeely. 'Ince then Xeoly has leased the oil and gas rights to Melion, who is now boring a w ell and is about to bore Ave more. It is claimed that he lias no right to bore through their coal. Judgo White granted a preliminary injunction, and fixed Septem ber 12 for a hearing. - Tho lVliarfboat Shooting Recalled. Joseph Cross yesterday entered suit against James Abriola to lecover $5,000 dam ages. Cross states that on July 22, 1831 Abriola got into a quarrel with the second porter on the steamer Hudson. Cross re ported them, at which Abriola got angry "n(1 lrocuring a revolver, shot Cross twice. Ono bullet struck him In the lett shoulder, inflicting a severe wound. A capias 'was Issued lor the arrest of Abriola. Magoie Halst yesterday entered suit against George J. Schaffcr, John Mohan and James Brennan for $10,000 damages for false arrest. She alleges that on July IS they far rested her and took her to the Fourteenth ward station, where she was kept locked up for two days. The charge is not stated. EEQtnsrnoK papees hicessabt Abram Grodner, Wanted In Cleveland, Released by Court From Central Station. Abram Grodner was released from Central Station yesterday on habeas corpus proceed ings by Jndge White. The petition for the writ of habeas corpus -was filed by Rosa Grodner, the wife of the prisoner. Sbosaid that he was in Central Station on a charge made by Herrlck & Son, of Cleveland, O. She was unable to give the nature of the charge. Ho was Illegally detained she asserted, and. she asked for his release. Judge White issued the writ directing Police Superinten dent Weir to produce the prisoner In court forthwith. The writ was nerved at once and in a short time Grodner was brought Into court. Upon a hearing, it developed that Grodner had purchased furniture from Herrick & Son, of Cleveland. Ho gave a mortgage on the goods to seenre payment, and then surreptitiously removed them to Pittsburg. Under the chattel law of Ohio this was an offense, and the Information on which he was arrested In Pittsburg was made against him. No requisition had been obtained for him. and Jndge White said that he could not hold him in the absence of one. He directed hiti to be released, but said that he was liable to arrest at any tlmo. AVhereas, Certain persons, companies, cor porations and associations own and main tain in the borough of .Glenfleld gates hung and arranged to open and swing out and to ward boardwalks, pavements and streets, and AVhereas, Gatos so placed and hung and arranged are liable through negligence or otherwise to be left open and thus obstruct such boardwalk, pavement or street where suoh gate or gates are located. In fact, gates so hung and arranged have been and are now allowed, through tho negligence of per sons owning, maintaining ana using such gates to remain open, thus obstructing boardwalks, pavements and streets, and, owing to the position of such gates, the arrangement and operation of same and re sults thereof, they are deemed to be danger ous topedestrians and area public nubance. Section L Be it enacted by the Burgess and TownConncilortboboroughofGlenfleld,and it is hereby enacted by the authority of same. They, any and all person or persons, com panies, corporations or associations now owning or maintaining within the limits of the borough of Glenfleld,' gates hung or ar ranged to open or swing out and. toward tho boardwalk, pavement or street, shall, within ten days from date of notice from the Coun cil of tho borough of Glei.fleld, remove such gate or obstruction, and if such gate or gates be located, hung and arranged have not been removed nlthin the time as stated in suoh notice, then the same can and shall be re moved by tbe proper authorities of the borough of Glenfleld at the proper cost and expense to party or parties, companies, cor porations or associations owning and main taining such gnto or gates.
