CRIMINAL COURT OPIXS KEXT WEEK A bill in equity was filed yesterday by James Blick, Henry Loutitt, "William Jenkins and "William Duncan, mine inspec tors, against J. D. Sauters, the mine owner and operator. The plaintiffs state that they are the inspectors lor the First, Second, Fifth and Seventh districts of the bituminous coal region of Pennsylvania. Sauters owns and operates a coal mine in Uorth Fayette township, which is in In spector James Blick's district. It is asserted that on August 27 Blick made an official examination of Sauter's mine, and found the condition of it such that the delay neces sary to proceed in the ordinary method pro vided by law would, in his judgment, jeopardize the lives and limbs of the em ployes working In the mine. Blick notified the other Inspectors, and on August 2S they all exmained it anl agreed that there was great danger. The mine, it was stated, is perforated with seven oil and gas -nclls, and a large number are in process of being drilled into and through the mine and others are projected. Two of the wells drilled through the mine show sediment and water passing from the drill boles into the mine. Oil wells in tho region of this mine produce large volumes of gas, and in gojng through the mine there is great and immediate danger from behind the casing of the wells or from a break in it directly into the mine or through crevices in the strata, thereby filling the mine with gns. One of the wells is now prodnceing gas in dangerous quantities and the other six are approaching the pis producing strata. There 1GD persons em ployed dailv in this mine. In consequence of this condition of affairs the Court is asked to make an order compelling J. D. Sauters" to suspend all work in and about the said minr. The bill -n as filed by Attorney H. D. lonrs. Judge Ewing fixed next Monday for a bearing in the case. CUT DOWN THE TELEPHONE POLES. A I!ig Corporation Wants to Restrain a Tanner's Ax. Tne Central District Printing and Tele graph Company yesterday filed a bill in equity against W. A. Zaun. The defendant is the owner of property at the corner of the Noblestown turnpike road and the Pitts burg and Stcubenvillo turnpike road in Chartiers tow nship. The plaintiff was con structing a line to Mansfield and poles were erected in front of Zahn's property. On August l, it was alleged. Zahn cut down five of the poles and now threatens to cut down more1 if they are erected. An injunction was asked lor to restrain him from so doing. The bill was filed in Common Pleas No. 2. Zabn alleged in court that the wires over hung his property. An agreement was made whereby the company was to file a bond in the sum of S3 000 as security for any damages there might be, ana Zahn was to leave the poles alone. If Zahn did not comply with the agreement the injunction was "to be issued. EEOPENING OF CRIMINAL COHBT. Judges Ewing and White Will Open the September Session. Nest Monday the Criminal Court Vill open after the summer recess. No assign ment has yet been made, but Judges Ewing and White ill probably be on the bench. Judge Reid, of tho United States District Court, yesterday made an order dismissing the first and third specifications to the mo tion for the discharge of A. T. Baum from bankruptcy. The second specification was fixed lor trial at the October term. It al leges that Baum conspired to prevent the, sale of 2,200 acres of land in Clearfield county for the benefit of creditors, and that he re moved 3,000,000 feet of lumberfrom the bind.
