Becrcts of the Schmitt Burglary Now Be ing 3Iade Public CORA WTATT AND THE CLARES OX TRIAL After the lapso of about a week the famous Fitzsimmons case, which was stopped by the death of District Attorney Johnston, was taken up j csterday. On the Skelly robbery Fitzsimmons and his accomplices wore found guilty, and now the court is fairly into the meat of the Schmitt robbery. Al though the attorneys protested Charles and Cora VTyatt were placed on trial with the famous robber. The courtroom was crow ded all day by peoplo anxious to hear the evidence and get a look at the defendants. Fitzsimmons, or Hudd, was still as dchant as ever when brought into court, and nearly all day kept lip a chatter and laugh. In fact, his actions are such as to cause comment as to hether his conduct is assumed or natural. When the case opened in the morning Laura Snowden, or, as sho testifies, Mrs. Hill, w as placed on the stand for the contin uation of the cross-examination that was in progress when the case 5a stopped a week ago. Thomas M. Maihall cro--s-cxamined her, bat did not shake her story. She fraid the silk recovered by Detective Gilkinson had been given her by Fitzsimmons. Her husband's name is William Hill. She has never been divorced, but is knoi n in Titts burg as Laura Snowden. J. A. Skilly, of lIcKcesporr, testified to the robbing of his store. O. P. II. Somercll and James Wright, employes of Mr. Skelly, told the story of the robbery. Wright identified the miner's lump as one found in the cellar after the robbery. Miss Dora Kcadlo testi fied to the amount of bilk stolen. Chas. Fos ter said he knew lludd and had seen him in McKeeport about a month before the rob bery. The Commonwealth rested, and, after a short consultation, Major Montooth, for the defence, slid they had no evidence to offer. Judg Slagle's charge to the Jury was short and direct, and at 11 o'clock the jury retired, ritzsimmons race Grew Pale. Some of the other work of the court was taken up until tho hour for the noon recess. When court.recon vened at 1 o'clock the jury was ready. It was brought in and the ver dict of guiltj on both counts, burglary and entering a building, was submitted. Al though this was expected tho eliect on tho prisoner was marked. His face paled and he became very nervous. The cae based on the robbery of John F." Echmitt's jewelry store, in Homestead, was taken up next. In this case the grand Jury Indicted A. G. Budd, alias Fred C. Fitzsim mons, Cbarle M. Clark, Emma Clark, Cora Wyatt, Daniel S. Deeer and Laura Snow den. Attorney Cox asked for separate trials but the Court refused, tomo little time was spent in securing a Jury, each side exhaust ing their list of challenges. During the call ing of the jury FitzMimnons was not a little amused and a"s a juror was stood aside he would look at tho juror and laugh. When the name of Henry Gallagher w as called the prisoner remarked loud enough to be heard nil around, "That's a Frenchman," and then indulged in a hearty laugh at his little joke. After a jury had been secured District At torney Burleigh informed the Court that they would only try Fitzsimmons, Charles JI. Clark, Emma Clark andCora Wyatt under the indictment. William Reardon, Esq., lor the dclene, ente.-edan objection to this, but it w as overruled by Judge Single, who said that the District Attorney had a right to do ns he pleased in such a matter. The open ing address was made by Assistant District Attorney Martin, who said that tho Com monwealth expected to prove that the rob berv had been committed by Fitzsimmons and that he was aided and abetted by the other defendants. John F. Schraitt was the first witness called. He testified that he was the proprie tor of a jewelry storo at No 30 Eighth ave nue. Homestead. At 5:15 o'clock on tno evening of January 31, 1S91, ho left his store, lirt lacking it, and then w ent home to sup per. He was away from the store half an hour, and on his return the gas was out and the travs with wutches chains, ringsr etc, gone lie then made a search of the place and found a hole in tho floor just under tho showcase. He Found the Burglar's Tools. The piece of floor cut out was shown tho witness and identified by him. The witness continued, that on going Into the cellar ho found a brace, a chisel, a jimmy and a car penter's chisel. The property taken wa3 valued at $2,91. and consisted mostly of "watches, of which 101 were taken and IS movements. The witness here produced a list of the numbers of the watches taken. He saw one of his watches at Lynn, Susque lianna county, Fa., where lie was taken by Detective Murphj. The satchel lull of watches found in the trunk of a tree after the murder of Detective Gilkinon was then presented and separately identified by Mr. Schmitt, ns each one had his price mark on it. At this point Detective Murphy picked up a watch, of hich the ring attached to tho Hem was brokon, and tried in vain to fix it. Fitzsimmons reached over tue table andre maiked, "Let me have it." Detective Murphj looked up in surprise and said, "Oh, no: you know too much aDout it already," at which Fitzsimmons indulged in another laugh. Tho witness continued that he saw Mrs. Clark in his store on the day of tho robbery at 4:45 o'clock. She stood at tho showcase containing the watches talked for 10 or 15 minutes over tho purchase of a comb. Caught by Laura Snowden's Wiles. Laura Snowden came in the store at 5 o'clock, stopped 15 minutes and talked about buying a watch or chain for a present for iier brother, but did not make any purchase. The witness knew Fitzsimmons for 18 months and he was in his store one week before the robbery. The cross-examination developed nothing other than Mr. Schmltt's statement that ho had gone out ot the Jewelry business, at which Fitzsimmons laughed heartily. Detective 1. J. Murphy testified that after the robbery he went with Mr.Schmitt to Lynn, Susquehanna county, on March 12,and found a lady's gold watch, two studs, a ring and a locket. Theso goods were at tho house of Dr. Ficker and were in tho possession of Mrs. Picker. The goods wero identified by Mr. Schmitt as some of the stolen property. Isaac Jury, a policeman at Homestead, tes tified that Mr. and Mrs. Clark live on Fourth a cnue, Homestead. He made a search of the Clark house alter the murder, and found buried under tho house a fruit jar which contained 3 pieces of silk, 3 lady's and 1 gen tleman b gom watcaes, i surer watcu, i rings and 1 locket. The Irnit jar was buried about nine inches in tho ground. Court adjourned for the day with this wit ness still on the stand. Other Work of the Criminal Court In the Criminal Court yesterday Albert Smith was convicted of assault and battery on George Lameson, March 31. Lameson, it was stated, came here to work on the new Davis Theater during the strike, and Smith, who was one of tho strikers, assaulted him. Smith -vi as fined $20 and costs. Harry Chambers and David Larimer, two young men living in the First ward, Alle gheny, pleaded guilty to two charges of malicious mischief. They were accused of having kicked in tho doors of a couple of houses on school street. They were also charged with having struck Oflicer Bittner, or Allegheny, on the head w ith a cobble ptone some timo ago, from the effects of which he Iot his reason, but the grand jury ignored tho bilL Theyweie lemanded for ten ten ce. John Craig, alias Graham, alias Huffman, pleaded guiltv to horse stealing. He was charged by J. F. Smith with having stolen a horse from him. He was sent four years to the penitentiary. John Garrison, of East Liberty, was ac quitted of the charge of the larcenv by bailee of $25 worth of brass screws from"R. S. Watters. Frank Robinson, alias Shay, of the Fifth ward, pleaded guilty to carrying concealed weupous, on information of E. M. Trich. He w as sentenced one year to the work house Johu Conlou, of Third avenue, pleaded guilty to aggravated assault and battery on William Rodcers. He was sentenced six months to the workhouse. J. II. Wilson pleaded guilty to two charges cf larceny. He was accused of stealing razors, etc., from J. H. Mart and Philp Al wcll. Ho was sentenced one year to the wolkhouse. W. T. Richardson (colored), of the Eighth ward, pleaded guilty to two charges orial.se pretenses, on information of E. M. Wind and H. Steinhauscr. He was sentenced 16 months to the workhouse. John Edmond pleaded guilty to the larcenv of a suit of clothing from John Bokassia, o'f Cherry alley, newas sentenced 10 months to the workhouse.
