Judge Slagle's Opinions as to When He Issues Can Be Made, Judge Slagle yesterday handed down an opinion refusing to grant a transfer of four liquor licenses, and defining the position bf the court on the question of transferring licenses. The licenses he refused to transfer were: From Thomas Hogan to Frank Bole, Sixteenth ward; F. R. Dohlgren to Appel & AVolbus, Braddock; V. Simon to Ed Scanlon, Sixteenth ward; H. M. Donohue to S. D. Caro thcrs, McKeesport. In his opinion the Judge said: The act of 1S37 docs not make any provision for the transfer of licenses, but It has been held that the act of 1S3S Is not repealed and is applicable to licenses granted under the act of 1887. Judge Ma gee, of the Court of Common Pleas No, 2, Hied an opinion on the subject, which has been acquiesced In and adopted bv all the Judges of tbis county. The seventh section of the act of April 20, 1S&, provides that no license to vend the liquors afore said granted under this or any other law of the Commonwealth shall be transferable but if the party licensed shall die, re move or cease to keep such house, his or her license may be transferred bv the authority erantliur the same, or a license be granted the successor of such party for the re mainder of the year. It will be observed that the license is not transferable bj the person licensed. It can only be transferred by the Court, but the power of the Court to make such transfer is limited to three cases, when the party has died, has re moved, or has ceased to keep the house. When the party is not dead or has not removed, the first lnaulrv for the Court is: Has the nerson licensed ceased to keep said house. If not. the license can not be transferred. A mere closing of the bar is not sufficient There must be an absolute and unqualified cessation of the business to which the sale of liquor is appurtenant. An inten tion to quit If the license can be transferred is not sufficient, even though the sale of liquor is sus pended until buch transfer can be procured. ORPHANS DEMAND DAMAGES. A Saloonkeeper Asked to Provide for the Children of James McNally. Thomas M. Marshall, Jr., yesterday en tered suit in behalf of Rose and Ella Mc- Nally, aged 13 and 11 years respectively, against B. B. McDowell, the saloonkeeper, at 6224 Station street, East End, for $10,000 dam ages for the death of their father, James McXally. It is stated that June 6, 1S9LMC Nally, who was in good health and about 41 Years old, went to McDowell's saloon, where he was given liqnor to drink until he be came intoxicated. The defendant then threw him on the floor and pushed him out into the street about 9 r. si. When McNally was thrown out he fell on tne pavement, strunng nis ncao, cutting it, and receiving internal injuries. He became unconscious, and was taken to the police station, dying the next day.
