ItBTSRDIT IK THB C0U5TI CODETB A bill in equity was filed yesterday by F. J. Fleck, E. Wahleler, J. Winkelman, George Salatha, J. C. Davidson. Lawrence "Walter, Sr., M. R:ckel and Mary Gas against the Federal Street and Pleasant Valley Passenrer Railway Company, oper ating the Troy Hill Passenger Railway. The plaintifiiare property owners on Lowrie street, Allegheny. The Troy Hill com pany, by ordinance on September 11, 1890, was granted right of way for a single track on Lowrie street from Gardner street to Kiggle street. Trie company, it is alleged, sow has workmen at intervals of abont two squares, who are moving the track from the middle of the street to within four leet of the cnrb. They are also nnttinj: in long switches, whichoceupy almost the whole street, it be ing only 21 leet wide. The ordinance emot ing them aright ot war, it was alleged, had so provision tor switches. The plaintiffs believe that it is the inten tion of the company to make its return along Lowrie street, instead of taking the circnitons route provided in the ordinance. They will eventually, it is claimed, con tinue the sitchis ntitil they form a uni form double track over Lowrie street, which is in violation of the ordinance. The Court is asked to grant an injunction restraining the defendants from laying the switches and compel them to put down the tracks in accordance with the ordinance. The plaintiff secured a verdict in the Bum of $2,800 against Felix McKnight and James Quinn, and the jury found for the defendants as to Bridget McKnight and Peter Qninn. A Golden has been appointed Commissioner to hold an inquest In lunacy in the case of John McNulty, far., the liveryman. The petition for the inquest was filed by Mrs. Catherine A. McNulty. the wife of Mr. Mo Uulty. She alleged that bis mind had become impaired, and that be was incapable of man aging the affairs of his estate. Mr. MoNulty 13 reputed to be worth about $50,000.
