AX INJUNCTION THAT WAS RESCINDED The Fayette Fuel Gas Company -will h-ve another shy at the Supreme Court to-day this time on a most unique phase of the mandamus question. An epitomized statement of a lengthycase history is simply that Louis P. 'Wliitenian lnd a niatp tactory at Uniontown which the com pany ' supplied with fuel pas. On October 23. 1S90, the g.13 company shut off the supply from ilr. Wliitemaa's iti rks. That gentleman employed ex-Judge Campjmpbell, and sailed into court with a bnl asking that an inj unction issue for the uual purpose. The company, through its President, Larry Miner, straightway pro cured the talent of Frank I lams, of the Pittsburg bar, and made a fight. Judge James Inghram refused to make ti e decree. Mr. Campbell then raised his toicc in the Supreme Court Tiere, last tall, ami all Fayette county stood on the tiptoe ot excitement. That court directed the lowei court to go back on itself and issue a pre.imiuary injunction on the company re straining it from stopping the gas supply, provided Mr. "Wbitemau furnish the corn panv with a bond for 5,000 precautionary against the usual probatde losses. Fart of the Injunction Rescinded. This Judge Inshrain did, at the same tunc extending the decree to the Sheriff of the county, that official having seized the gav company's property and so on on an execution Issued by A. W. Mellon, a judg ment debior of the concern, who had caused the execution to be issued. Subsequently Judge Inghram became convinced Hiatus f prayer lor the injunction had not fginai'V included either the Sheriffor Mr Mellon as defendants, and as the in- u ftion, as extended to the Sheriff, was a wr ug on a blameless third party, rescinded t at part of the injunction relating to the Sheriff, and allowed to stand rilvthat part of the decree covering the ;: company. Mention has been made on several occa sions during the past year of the coming town of Mendelssohn, where a large piano factory was in process of erection. Those who are most interested there have preferred to act rather than talk, and have busied them selves in advancing the material interests of that favored section, knowing that at the proper time the advantages of Mendelssohn would become apparent. Mr. John D. Mc Cune, of the real estate firm of McCune & Coulter, yesterday was interviewed rcnard ing the prospects ot the place. In reply to questionsMr. McCunesaid: "Theplaeehasa most prosperous future. The piano factory is already well advanced toward completion. Work is being rapidly pushed on the new plaut of the Iron and Steel Band Company, Limited, which concern having dis posed of its property in Pittsburg is ener getically working to get all in readiness lor business at Mendelssohn. Tnis concern has lieretolore purchased the sheet iron it re quired Irom ottier manufacturers, but they lure in contemplation a plan to build a plant for the manufacture of sheet iron in connection with their, present work. There are also two other manufacturing concerns that have decided to locale at Mendelssohn, which insures abundance of work there and will make a thriving population, viz: The Keystone floop Manufacturing Company, and the Koofinjj Paper Manufacturing Com pany." Mr. McCune was asked to tell of the special advantages of Mendelssohn, which made it so desirable a location lor manu facturing purposes. Said he: "It is at Wilson station, only 10 miles from Pittsburg, on the line of the Mouongahcla division of the Pennsylvania Ilailroad, and is the first really eligible site on the Monongahela river south of Dnquesne. The land reserved for niauutacturing plants lies between the railroad and the river. It is very smooth, level ground, yet high enough that no floods cm overflow it. There is the loveliest town site in the Mononga liela Y.iiler. It rises gently, and commands a view oi the valley Irom McKersport nearly to Elizabeth. John A. "Wood & Son have laid out about 100 acres in build ing lots, which will soon be placed on the market. It is laid out with wide streets and avenues in the most attractive manner, and for healthfulness is unsurpassed. Abundant coal supply is at hand, Messis. Tne railroad company has just completed an immense siding, which had become neces sary to accommodate the increasing trade of the place, and all necessary shipping facili ties will be furnished by the railroad com pany, which is in accordance with the lib eral policy of that company toward our manufacturers."
