Shortly af'cr the opening of court the case of the appeal of Alderman Doughty from toe finding of the Criminal Court, which was down on the list as the twelfth case for argument, was,by the request of the counsel on both sides.coutinued, and will be placed on the book as the last case. Non prosses were entered iu two cases of Mc Afee vs Doherty et al and the appeal of Brindle. The first case argued was the appeal of John F. Rivers, certiorari to Common Pleas Ko. 2. This case is one for the possession of a piece of property in Lawrenceville. The property was eonvevcd by deed by John A. Miller to Fred Rivers. The children of John A. Miller claim that at the time the deed was given, Miller was unfit, mentally, to transact business. The counsel for Mr. River, on the other hand, claims that Mil ler's mental condition was all right, and the property was deeaed to Rivers at a very small price, because of his having taken better care of Mr. Miller than his own children. AX APPEAL BT A BANK. The appeal of the Iron City National Bank from Common Pleas .No. 2 is au .action of assumpsit brought by the Iron City National Bank asramst Martha J. Mc Cord. the sum iuvolved amounting to about $500. The appeal of Ann Redman from Common Pleas No 2 in the matter of the petition of the Sellers Chapel Methodist Church of Braddock to sell real estate, was taken up. This case Is where the appellant donated to the church a certain piece of ground on which to build a church. The inc ease in the congregation jnade a larger church necessary, and tbey de termined to sell the .-- V and purchase a larger site. This was objected to by the ap pellant, hence the sui Ihe case of Mary Davis, appellant, VRtlie Jeff ei son Ga Coj iat.y, was next taken up for argument. This is a case w herein the pat coin jia:i entered upon the land of Maiy Davis In Baldvwn townsbiu. containing about 50 acres. An award of damages was made in Common Pleas No. 1, from which Mrs. Davis appealed, 'i heappeal was takeu on alleged errors made in the Jndce's c larjp. The appeal of James L. Orr from the flndms of Quarter Sessions Court mas taken up. In 'this case James L. Orr. a well-known real es tate agcnt,wa convicted of assault on a 16-year-old girl, Maj Kelly The argument was based on the allf ged alibi proven by Orr. and the par tialin of the charge made by Judge White. J.S. Robti argued for the appellant that Judge White totalis ignored the testimony in the pii-oaer's favor, and commented w holly on that in lavorof the f omnionn ealth.and In conclusion sain, -A juror should have no doubt where he uoald lae no doubt as a man," which Mr. Robu thought was a palpable f rror. The appeal of the Second National Bank of Alleghenj from the final decree of Orphan's Court was next placed in argument. There are four of these cases, and tliev all bear on the one special count. Thecae is for the recovery of certain bonds, mortgages, etc, beld as col lateral secnrit of James .Marshall, Jr who -vas one of the trustees of the Marshall estate. The lower court decided that the funds of the estate could not be held as the personal collat eral security of James Marshall, Jr., on which decision the appeal was taken. ANOTHER GRAFF-BENNETT F.CHO. In the appeal of the New York Life Insur ance Compan from C. P. No. 2, the argument was made by D. T. atson. The appellants lielda. tortgage debt on the Arm of Graff, Bennett & Co secured by real estate. The debt amounted to J150.000 evidenced by three bond', two for 545 000 each and one for KSCO.OOO. Alter the firm's as-ignmeat the. as-ignee paid ife of tbeae bonds, and 2,000 had been pam on account of another bona. The whole amount of the claim was then presented to the auditor and allowed by him, and a dividend, upon con dition that the insurance company assign to Joun H. Bailey, the assignee, for the benefit ol the creditors ot tbe firm who were unse cured, a portion of the mortgage debt cqnal to the amount of the dividend so awarded. This i refu-ed, hence the suit. A TEST CASE WANTED. Question as to "What KighU Witnesses Are Entitled to. County Controller Spcer yesterday refused to approve the bill of Theresa Teets for $305 for witness fees. The woman was a witness in the Killian murder cae. and was committed to jail by the Coroner, pending the trial of the case. She was in j'ail S05 days, and, according to custom, presented a bill for $1 a day for the time she was imprisoned. Judge White fol lowed precedent by approving her bilL When the bill was presented to Controller Speer he took a new course, and declined to authorize the payment. He said there was no law to authorize the payment ot such bills, and referred to a decision of Judge Wickham. of Beaver county, in a similar case. In this de cision -t was held th witnesses for the Com monwealth who could not furnish bail for their appearance wero not entitled to pay for the time they were in jail. In the Cnmiual Court yesterday M. Portzer and Joseph Leber wero tried on the charge of felonious assault. They w ere acquitted of this charge, but Portzer nas found guilty on another charge Martin Navish. Patsy Holo han and William Murdock were acquitted of tho larceny of 100. Andreas Borovlak was acquitted of the charge of assault on Eva Jan korska. aged 60 years. Margaret Piccard was acquitted of assault and battery on Kate Fleming. Tbejnryis out in the case of Kate Wenzel. alias smith, triea for the larceny of a cold watch irom R. S Walter. Ficd Reese was acquitted of assault on Mrs. Lena Kiefer. Miller, who was Mrs. Miller's hus band, in the fire at the defendants' refinerv in the Sixth ward, Allegheny, August 2L 1S90. Mention has been made of the Intended suit of John F. Scott against the majority party in the Pittsburg Plate Glass Company, repre sented by Edward Ford, Emory ll Ford, John Pitcatrn and Artemns Pitcalrn. because of the plaintiff being refused admission to the works, which, as a director, be claimed to have the right to enter and insoect. The attorneys for Mr. Scott have the bill in equity now drawn up, and it is the Intention to file it to-day. Itpras that he may be permitted to inspect the works and the bonks. There is at once a good deal of feeling and of Interest both as to the circumstances of this suit ana as to the legal outcome. The minority stockholders reorcsonted by Mr. Scott claim that they should, through their director on the board, have at least the same privileges to ex amine the property that an organized construc tion company syndicate may enjoy within the company. Minor Legal Items. The four suits of Huckenstein A Co. against John Nanz, actions on mechanics' liens, are on trial. The suit of McGinness, Herleby A Co., against L. C Barton, an action on an account, is on trial. In the suit of Julius Flneberg against Will iam J. Cappe and wife, an action on an account, a verdict was given for $23 for the plaintiff. This result is brought about by the new club or co-operative system ot conducting the piano business, adopted by Alex. Ross, of Allegheny City. The plan is a simple business problem. It provides for the purchase of 350 pianos for each club, thus securing for the mem bers tbe great reduction of $75 on each piano lrom the retail price. The plan also pro vides methods of payments to suit everyone. Members can pay cash and get their piano at once, or can arrange to have them deliv ered upon payment of $25 cash and $10 monthly, while those who only pav $1 per week will get their pianos in a short time, as there is one piano delivered each week to each club on these latter payments. There being 350 members, each 'paying $1 per week, they get the piano at the lowest cash price. Mr. Ross is now delivering piapos to two clubs, A and B. The membership m club B 'is not quite complete and anyone wanting a piano should apply for member ship at once, thus securing the reduction in price, then pay as they choose from 1 per week up.
