FLEMING'S ASSIGNMENT DEED FILED.
Owen McNally was tried in the Criminal
Court yesterday and convicted of four
charges of larfenv and pleaded guilty to two
others. Sadie Samuels, who was charged
with being an accomplice, pleaded guilty to
receiving stolen goods. At the
trial yesterday it was shown that
McXally had stolen a bracelet
and diamond pin irom the house
of Dr. "Wvlie; some money nd a gold pin
from the house of Dr. Sweitzell on Penn
avenue; clothes and other articles to the
value of SliS Irom the bouse of Mrs. Ed
wards, No. 410 Pcnn avenue, and clotbes from
the house of Mr. Beatty on Penn avenue. Mc
Nally had on a suit of clothes belonging to Mr.
Beatty when arrested. The charges he pleaded
guilty to were the larceny of a pin from John
Burrell and a watch from Harry Simmons, both
of Allegheny. The jury returned a verdict ot
guilty in all of the first four cases.
When the enlict had been received, W. Df
Moore, McNallj's attorney, said that he hai
not pushed Ins picas that McNally was a kle.

Mr. Moore continued, bowever.that he wisied
to call some witnesses. Dr. Wvlie was pu: on

not express his opinion because McNally'had
stolen from him,"but that was what be thcugbt
of the man.

action in ejectment to obtain possession of
property on Manhattan street, Allegleny. The
plaintiffs are the children of the ate Lewis

Elcessor died intestate in 1SS9. Some time
before his death he transferred to lis last wife,
tbn defendant, the property in question. The
plaintiffs, who are his lien s at lar, now claim
that the property should come to fliem. They
assert that the transfer of the property made
by Elcessor w.t illegal and voiX because El
cessor was weak-minded ana unfit to transact
business, and they claim undue influence was
used on hiru,

John Lanlor pleaded gniitr to aggravated as
sault and batiery. J. T. Pu-ris and R. T. Gra
ham arc on trial for aggjavated assault and
battery.

A deed of voluntary assignment from Coch
ran Fleming. J. K. Flemiig and Cochrane
Iteming, Jr.. partners as Flening Bros., and as
individuals, with Sarah A. Fleming, wife of
Cochrane Fleming, to Johr B. Renj, was filed
yesterday. AH property wis assigned for the
lx-ni-nt of creditors. The Jourt appointed S.
V. Black and J. W. Flemirg appraiser!, of the
rroperty.

Coyle, an action in ejectment, a verdict was
given yesterday for S3.U71 21 for the plaintiff.
The snit of Henry Allbnght against the Bir
mingham and Brownsville Turnpike Company
for damages for injury to property caused by
the falling in of a drain is on trial before Judge
Collier.

Test rday was rather a "blue Monday" at
the Exposition, rn comparison with the
large frowds of lastweek, but a large crowd
is exacted to-day. The following extract
from in order of which 2,000 were mailed, will
explain:
"Tf respond totin apparent general desire of
thefloyal Arcanum brothers for an oppor
tunity to meet together, accompanied by their
famfies and friends, for mutual exchange of
greetings and congratulations on the maimifi
cenj progress of our order, arrangements have
beei perfected for holding what shall be known
as Roal Arcanum Day' at the Pittsburg Ex
poation. '(The management has fixed, Tuesday. Octo
bei 7. a the date, and tenders, through the
grind officers, a cordial invitation to the whole
osier. A special programme of Royal Arca
njm music will be rendered and no pains
siarea to make too day memorable in the
erder's history. Headquarters will be at The
Jispatch stand, in the main building, where
fvery member is requested to register his name
ind the name of bis council.
"It isShnped Sthat each member will wear
some emblem of tho order a badge, if he has
one, or a small red ribbon in his buttonhole.
Ribbons will be furnished on application at
the headquarters aforesaid."

British-American Institute will have fuU sway.
The voting topic at The Dispatch head
quarters vesterdav was "Should Pittsbntc
Krect a Memorial to Stephen C. Foster."
There were only four "no" votes registered,
and the only negative reason given was, "But,
nevertheless, he was a public benefactor; if all
such would get monuments the city would be
full of them."
Some of the affirmative reasons were: "Let
ns not forget Fletcher's aphorism, "Let us write
the songs of a people, and you can write the
laws.' " "America's sweetest songsters." "Yes,
but don't come the Now York on us."
For many days visitors at the .Expo have ad
mired the tea blossom on the plant in the He
No Tea exhibit: but it will be seen no more.
Last night it was plucked,- and. together with a
seed and some leaves, will be added to the
treasures of the Western Pennsylvania Botan
ical Society.

Mr. Hamilton is alive to the plan of
placing novelties at his stand in the Exposi
tion to make it always attractive and inter-
esting. Just as changes are made at the ex
hibit, just so are they made in larger pro
portions at the warerooms: but the surpris
ing part of it is that each time it is some
thing finer, something that will teach the
public, or, in other phrase, raise the level of
music to a higher plane. Stand-still con
servatism don't suit Mr. Hamilton; he is
wide awater progressive, and, in the sense
that he must and will have only the best ior
his patrons, aggressive. That is why he has
all those superb instruments to gladden the
listeners, such as the Decker Bros', grands
and uprights, whose massive tones and won
derful sympathy bold one spell-bound; and
the great Knabe grand: that provoke the
happiest emotions; and Fischers and the
Esteys that win upon you whether you will
or not; and the celebrated Clough & War
ren, and Story & Clark, and Estey and
other reed organs, all highest types of this
class of instruments, while best of all is the
pipe organ, head and shoulders over any
thing ever shown at an Exposition here; a
collection in fact that would take the gold
medal were any to be awarded. To see the

AN ORDINANCE PROVIDING FOR
the issuing of duplicate licensed vender
plates.
Section 1 Be it ordained and enacted by tbe
city of Pittsburg, in Select and Common
Councils assembled, and it is'hcrebv ordained
and enacted by the authority of the same.
That the City Treasurer bo and is hereby
authorized and empowered, on production of
satisfactory evidence of the loss of his plate by
any licensed vender, to issue a duplicate there
for. Section 2 That he shall in issuing said
duplicate, cancel the old certificate and issno
to the vender a certificate bearinc a new num
ber, and shall notify the Chief of the Depart
ment of Public Safety of tbe number ot the
plate that bag been Iost and canceled.
Section 3 That he shall collect from said
vender for tbe use of the city for said duplicate
tbe sum of one dollar.
Section i That any ordinance or part of
ordinance conflicting with the provisions of
this ordinance be and tbe same is hereby re
pealed so far as the same affects this ordi
nance. Ordained and enacted into a law in Councils

AN ORDINANCE A SUPPLEMENT TO
an ordinance entitled "an ordinance pro
viding for tbe sale and conveyance of certain
real estate of the citv of Pittsburg, situate in
the township of Mifflin, county of Allegheny,
State of Pennsylvania, known as the City
Farm," approved the 12th day of July, A. D.
Whereas, under an act of Assembly of tbe
Commonwealth of Pennsylvania entitled "an
act in relation to the government of cities of
tbe second class," approved the' 14th day of
June. A. D. 1687, it is enacted "the Councils
snail nave lull power and authority to provide
by ordinance tor the relief and employment of
the poor of said cities, and for that purpose
shall have power and authority to sell and pur
chase real estate and improvements and erect
such improvements as may be deemed neces
sary tor tbe proper care and maintenance of
said poor."
And, Whereas, under a certain other act of
Assembly of said Commonwealth of Pennsyl
vania, entitled "an act relating to tbe acquisi
tion, purchase and sale of real estate by the
Board of Guardians for the relief and employ
ment of tbepoot in cities of the second class,"
approved tbe 25th day of May, A D. 1887. It Is
enacted, "That tbe money realized from the
sale of property as authorized by the first sec
tion of this act shall bo appropriated, to the
purchase and payment of a new farm site for
and the erection ot buildings thereon, as here
inbefore provided, the surplus, if any, shall be
paid Into the City Treasury for city purposes,"
therefore
Section 1 Be it ordained and enacted by tho
city of Pittsburg, in Select and Common Coun
cils assembled, and it is hereby ordained and
enacted by the authority of tbe same. That tbe
money arising from the sitle of the real estate of
said city authorized to be sold and conveyed
under tbe ordinance to which this is a supple
ment, shall be, and is hereby appropriated and
directed to be nsed first m paying for the real
estate authorized to be purchased for said city
under an ordinance entitled, "An ordinance
providing for the purchase of real estate by the
city of Pittsburg for the proper care and main
tenance of the poor of said city," approved the
12th day of Julv A. D. 1890, and the balance
thereof or so much as may be necessary shall be
used, laid out and expended in tbe construc
tion, erection and completion of such build
ings and improvements thereon as may from
timo to time be made and dqne.
Section 2 That tbo Controller of said city is
hereby authorized and directed to arrange with
the purchasers of the said property so author
ized as aforesaid to be sold to anticipate the
payment of so much of the purchase money
inereoi as suaii ue necessary to complete the
pnrchase of the real estate so authorized to be
purchased under tbe ordinance aforesaid, and
in order to do so tbe said Controller is hereby
authorized and empowered, if required to give
such purchasers fnrther time for the payment
of the balance of tbe purchase money pro
vided the payment of such balance shall be
secured bv a purchase money mortgage until
such time as it shall bo actually.paid, and shall
bear interest at the rate of five per centum per
annum provided, however, that the extension so
given shall not extend be) Ond the time re
quired for the completion of such buildings.
Section 3 The Chief of the Department of
Chanties of said city is hereby authorized and
directed at any time within the period named
in tbe ordinance to which this is a supplement,
to deliver to S.UJ purchasers possession of snch
parts or portion of the property temporarily
reserved for the use of said city in the ordi
nance aforesaid whenever in his judgment the
same shall no longer be required for public
purposes.
Section 4 All ordinances or parts ot ordi
nances conflicting herewith or supplied hereby
are hereby repealed.

A GENERAL ORDINANCE-RELATING
to tbe entry upon, over or under, or the
use or occupation oi any street, lane or alley,
or anv part thereof, by any person or corpora
tion for the purpose of supplying light, heat
and power, or any of them, to the puhlic by
means of electricity, and providing reasonable
regulations pertaining thereto for the public
convenience and safety.
Section 1 Be it ordained and enacted by the
city of Pittsburg, In Select and Common Coun
cils assembled, and it U hereby ordained and
enacted by tho authority of the same. That all
corporations formed for the purpose of supply
ing light, heat and power, or any of them, to the
public by means of electricity which shall
hereafter obtain, by an ordinance duly passed
and approved, the consent of the Councils of
this city to enter-. upon, over or under,
or use or occupy) any of the streets,
lanes, alleys or highways, or parts thereof,
within tbe city for any purpose shall, upon
tbe passage and approval of such ordinance,
and upon the acceptance of this general ordi
nance as hereinafter provided but not other
wise, have and be declared to possess the right,
under this general ordinance, to enter upon,
over or under, and to occupy and use the
same under and subject to the following regu
lations: Fust Every such company before entering
upon the streets, lanes, alleys or highways of
this city for tbe purpose of constructing there
on or thereunder any apparatus, device or

means for the supply of light, heat and power
or any of them, by means of electricity, shall
file in tbe office of the Department of Public
Works i plan showing tho location and size of
such proposed apparatus, device or meaas and
the nature and character thereof.
In case such company proposes to use wires,
cables or any other means in whole or in pare
over and above tbe surface of the streets and
highways, such plans shall show tbe size,
nature and character, height, with reference to
the grade line and means of insulation of such
proposed wires, cables or other means, and
also the size, character and location, with
respect to tho roadway or curb line of the
posts, poles or other means proposed to be
used for tbe support of such over
head system, and in case such company
proposes to use under tbe surface of the
streets any wires, cable, condoit, tube, sub
way .or underground system, such plan shall
show the location, manner of constrnctlon and
means of insulation of such proposed wire,
cable, conduit, tube, subway or underground
system and tbe size and deptn thereof, with
reference to tbe surface of tbe street, and all
such plans shall be subject to the approval of
the Chief of tbe Department of Public Works

''Second All wires, cables or other means
used by any such companies over tbe surface of
any of the streets or highways shall be erected
at a height of not less than 20 feet above the
grade line, and no such wires, cables or other
overhead system shall Co constructed diago
nally across any street or highway. Every snch
company constructing any wires, cables or
other overhead system along and over any, of
the streets or highways shall erect tbe same
along and over the curb lines so nearly as may
be practicable, and no such wires, cables or
other overhead system shall be constructed by
any such company over and across any street or
highway except at the intersection thereof with
another street or highway, and in every case
where any such company constructs any cable,
wire or other overhead system across any street
or highway and along which any cable or wire
is used for the purpose of supplying motive
power for tbe traction of cars upon such street
or highway, such company so constructing any
cable, wire or other overhead system across
such street or highway shall erect the same
over and above all cables and wires ued for
the snpply of motive oower upon such street or
highway, and shall place underneath its cables,
wires or other overhead system such other and
additional guard wires or other means as may
be necessary to at all times preveut its cables,
wires or other overhead system from falling
upon or coming in contact with any wires or ca
bles used for tbe supply of motive power upon
such street or highway.
Third all wires, cables, conduits, tubes, sub
ways or other underground system constructed
by such company under the surface of any
street or highway shall be placed not less than
two feet beneath the surface of the roadway of
such street or highway, and as near the
curb line thereof as may be prac
ticable. In no event shall more than
two squares of any street or highway be
opened at any one time for the construction or
repair of any underground system, and every
such company which shall remove or disturb
tbe pavement on any street or highway shall
promptly replace or renew the same in good
order and condition under the supervision and
direction of the Department of Public Works.
Fourth Tbe entire system used and all tbe
devices, means, appliances and apparatus ot
every such company in so far as tbe same or
any part thereof may relate to or in any way
affect or endanger the safety of tbe public,
shall at all times be subject to the inspection
of and under tbe supervision of the Depart
ment ofPublic Safety.
Fifth When and as often as may be required
by the Department of Public Safety each of such
companies shall furnish to said department full
information concerning the operation of its sys
tem of sunply and every part thereof, and also
a statement showing tbe amount of electro
motive force used and the current strength
conveyed or used along its lines, and said de
partment shall at all times have tbe right to in
spect and test tbe same.
Sixth If at any time any of tbe wires or de
vices of any of tbe said companies shall in any
manner obstrnct, endanger or interfere with
the tire department or any of its employes in
the proper use of its apparatus when called
into service, the said fire department or any of
the employes thereof shall have the right and
be at liberty to cnt down and remove such
wires or devices, without the city or any of its
agents or employes being held in any manner
liable in consequence tbereof.
Section 2 In case any such companies fall
to secure an approval of its plans or devices in
any respect as hereinbefore provided, it shall
thereupon have the right to make application
to Councils for such approval, and Councils
may, by a concurrent resolution or otherwise,
make or grant such approval.
Section 3 None ot such companies shall
have tbe right to enter upon, over or under,
use or occupy any of the streets, lanes, alleys
or highways or parts tbereof within this city
until after such company shall have procured
the consent of the Councils of this city by an
ordinance other than this one duly passed and
approved granting such rights to such com
pany, and unless such company shall tile with
the Controller of this city within 30 days after
the passage or approval of snch ordinance its
certificate of acceptance ot all the conditions
and provisions ot this ordinance, tbe said cer
tificate to be executed under tbe corporate seal
of such company, duly attested by the presi
dent and secretary thereof.
Section 4 Each and every person or cor
poration violating any of the provisions of this
ordinance shall pay a fine of not less than ten
($10) dollars nor moretban one hundred (5100)
for each and every violation of this ordinance,
to be recovered summarily before the Mayor
or anv police magistrate of the citv of Pitts
burg.
Section 5 This ordinance shall be known as
the general ordinance, relating to light, beat
and power companies.
Section 6 That any ordinance or part of
ordinance conflicting with the provisions of
this ordinance be and the same is hereby re
pealed so far as the same affects this ordi

to the east line of Sheridan street, and the
