AKOTHEE BUSY DAT IN THE COURTS Lewis McMullen, Esq., yesterday filed his report as master, in the long-pending case of Bernard, Kafferty and others, prop erty holders on High street, against the Central Traction Company. The suit was a bill in equity filed by the property holders against the traction company to restrain it from laying its tracks and operating its line on High street, between "Vfebster aTenne and "Wylie avenue. It was claimed that the company had no rights on the street, and, in consequence, was a nuisance. Th6 company asserted that they were legally authorized by the act of Assembly nnder which they were incorporated, and by the t:ity ordinance granting aright of way to the Central Passenger Kail way Company, which tbev had leased, to enter on the street. The Court" refused a preliminary injunction in the case, and it was referred to a master. Tn the meantime the traction company pro ceeded with the work, and its cars are now running on the street. The master in his report, after viewing the mass of evidence taken, finds that it ex ceeded the power granted by the act of March 22. 18S7, nnder which it was in corporated. Under the act the traction company has only the right to construct its tracks on the streets already traversed by the tracks of the Central Passenger Railway Company, which was leased by it. High street was in the right of way held by the Central Passenger Railway Company bnt tbev had never laid, tracks on it As a re sult the de.endants occupancy of the street was without authority of law, and therefore a nuisance. He could recommend nothing as to dam ages for the plaintiffs whose property was damaged unilormly, on account of the evi dence. Their claims varied considerable and were to the effect that their property had depreciated in value trom 40 to 75 per cent. The street is only 40 teet irom house line to house line and has 21)4 feet of cart way. In conclusion, the master states that the only decree he can recommend is an abatement of the nuisance. Exceptions to the master's finding were filed by the parties in the case bnt they were overruled and the case will now be argued in Common Pleas No. 2. Appealed From tbe Board of Viewer. An appeal from the decision of the Board of Viewers on the opening of Forbes street, between Boyd and Diamond streets, was filed yesterday in behalf of Mary E. Schen ley. By the opening a strip of her estate from Shingiss to Troy street, 69 feet wide, is taken. She is allowed no damage, but is assessed 52 637 50 for benefits. Other prop erty of hers on Forbes street miles away, which is not benefited at all, is assessed benefits. The whole assessment, she asserts, is illegal and unjust. CASES IN COTJBT.
