HUH FEOM TAB BUSI COUET EOOMS. An appeal was taken to the Supreme Court yesterday by George C. Boll and his wife, Minnie Boll, against the decision in the lower court in the case of A. M. Marshall, who recovered a, debt contracted by the ap pellants. Roll was a grocer doing business on "Wylie avenue. He contracted a number of debts, deeded his property to his wife and then made an assignment. Marshall, among others, sued and recovered on the wife's property, and a motion for a new trial was rna.de. Jndge "White relused it on the ground of palpable intent to defraud in a long opinion, and the appeal is taken on this refusal. IN THE CKQUUAL COUET. Annie McClelland, the Alleged Common Scold, Is DIscbnrEi-d. In the Criminal Conrt yesterday Miles O'Don ald was found not guilty of assanlt and battery on Thomas Walters. Annfe McClelland, charged by Eliza Gulllian with being a com mon scold, was found not guilty and the costs were divided. She was charged with abusing her German neighbors. The jury Is out in the case of C. White, charged with larceny by bailee of a suit of clothes from C Morris. Mary Connelly was found not guilty of the lar ceny of a pocketbook from S. L. Fleishman. E. Sullivan, charged with assault and battery, was found not guilty, but was ordered to pay half the costs. Philip Artz wan found not guilty. In the case of Frank Gibson, charged with the larceny of 1,500 feet of rope from a Charters oil well, the jury returned a verdict of not guilty. A nolle pros was entered in the case of Frank Kinart and the defendant was ordered to Day the costs. The case of Ellen Anderson against .inomasAnaerson. desertion, was dismissed ai the cost of the defendant. The case of snrety of the peace against Charles fiercer was dis missed and the costs placed on the prosecutor, Joseph Mueller. George J. J. The boat Is a ferry boat between New Brighton, Bndgewater and other towns, and was lately seized by the Sheriff of Beaver county and later by the United States Marshal. Shannon, Esq., In the case of Arthur Kirk against John E. DuBois was filed In the United States Cir cuit Court yesterday. The suit was to deter mine the validity of a patent on bear trap dams, begun in October, 1886. and a year later a decree was entered sustaining the complain ant, when a perpetual Injunction was awarded. The master was then appointed to take an account, and in his report says the complainant received no actual damage by the infringement, and the defendant received no gains. Excep tions to the report was also filed by complain ant's counsel on;the ground that the master erred in finding no damage for complainant and that he relused to accept certain testi mony. The "Westinghonse Electric Company has returned the action of the Thomson-Houston Electric Company in the matter of bringing suits for infringement of patents, with in terest Suits have been filed against the8econd Avenue Street Bailway Company, a licensee of the Thomson-Houston Company, for an infringement of the Finney patent ana .Forbes patent, which are both owned by the "Westinghonse Company. The Finney pat ent involved the overhead wire system, which establishes the fact that Finney was the first to propose the operation oi electric street railways by means of an overhead wire, and suitable regulating device inter posed between the wire and the motor lor regulating the speed of the car. It is said the Thomson-Houston Company recognizing the validity of this patent have frequently negotiated to secure a license under the same, and have oflered to pay a considerable sum Der car for the use of the invention. The Forbes patent covers the use of the carbon brush, an appliance which has be come essential in the operation of street railways and which is now used by all com panies supplying electric street railway apparatul In addition to these suits, the Union Switch and Signal Company has sued the Second Avenue Bailway Company for the use of the metallic connections from rail to rail, which are now used tor all street rail ways. Formerly the Thomson-Houston Company bought this from the Union Switch and Signal Company, but the "West inghonse people state that they have of late imrmged the patent and this action has been brought to restrain a further wrongful use of a very important invention. At last the Westinghonse Electric Com pany has also brought snit against the Wil- Kinsburg .Electric uompany.anotner licensee of the Thomson-Houston Company, for in fringing patents No. 342,552, for converters andre-issue No. 11,031, for multiple-arc distribution of alternate currents by con verters. x "When a call was made upon the Westing honse Electric Company for an explanation of the litigation, it was stated by one of the officials : , '"The Westinghonse Electric Company has always refrained Irutn pressing suits against the Thomson-Houston Company, largely because of the great expense in volved in litigation, but now that we have been attacked in Pittsburg, where litigation can be carried on with less expense and more convenience for the Westinghonse concern, we have determined to put the Thomson Houston Company on the defensive. This suit last Saturday was only brought by the Brush Company (which is controlled by the Thomson-Houston Company, the latter hav ing bonght it at great expense last winter), on acconnt of the meeting of our company to-morrow. The Thomson-Houston people intended by their action to create prejudice among onr stockholders .against our pro posed actions at the meeting. Apart from that, the Thomson-Honston Company is well aware that we are now manufacturing a single carbon arc lamp, the advantages of which are so apparent that the value of the double carbon patent has been effectually destroyed. 'It is true that the Duquesne Traction Company proposes to utilize some of the power from its power stations for lighting purposes, but a number of the leading men connected with that companv have unquali fiedly -said to the officials ot the Westing house Company that they have no intention to commit themselves to any foreign corpora tion while the Westinghousa Company can furnish them the apparatus they desire, it being to their interest to promote home in dustries. In view of the fact that they can not use the Thomson-Houston apparatus without becoming involved in expensive liti gation, there is no reason to expect that more than, trial apparatus will be bought from that company.',' OCCUPIES A HIGH PLACE.
