S. Will iams, Esq., has made his report to Common Pleas No. 2. The matter lias been very stubbornly contested by M. A. Woodward for the plaintiffs and J. E. McKclvey and J. B. Ferguson for the defense. The hear ings began on the 10th of July lait. Le rrgiets that they did not accept the proffer or a test by defendants, and states that it was declined on tho ground that tho works could be so operated and manipulated during such test as to prevent the ordinary effects from being produced. Finally the Master proceeds to state that from the testimony given at 31 hearings he Is not able to find that plaintiffs hare sustained substantial injury, either in person or property, other than fn personal discomfort, when the apons are carried by the wiud over their prop ;.1J. bat be does find that these vapors in the combination in which they isue aro vegetable anil animal poison-, and their effect is a cnmnl ative one, and he does find that the language of judce Gordon, in Pennsylvania Lead Com patiy's appeal 90 1'. &x, uage 125, that. the bill is sufficient to evoke the action ot a court ot equity," Is peculiarly applicable to this case, and, further, that it is the cumulative char acter ot this injnry. It increases from year to 'tear, not onlj as ttie works are enlarged, but as more and more lead is added to the ground. The deposit being an indestructible metal that is neither evaporated or absorbed must neces sarily accumulate. While the Master does not think the plain tiffs have been damaged to warrant the in jui ction asked for, the evidence satisfies him that from the cumulative effect of theso sub stances complained of there is danger, unless additional means are adopted by defendant for eliminating the obnoxious substances emitted from tho stack, it may be oulj a questiou of time until plaintiffs arc substantially injured, property destroyed and health and lives en dancered. He. tberelore. recommends that while the Court dismiss plaintiffs' bill, it be vitbout prejudice to their rights to file a new one in future for the grievance complained of, and that defendants pay the cost of proceed ings, the evidence fnlh justifying plaintiffs in making the Inquiry, and he submits a form of decree to that effect. Hhe suspected Mrs. Collins and Mrs. Wilson, and finally tliolr bas ket was srirrd and searched. Initwrro found tho missing articles, and somo tablecloths al leged to have been taken from the store next door. They writi arrested and a scaroli war rant for the house piorured. Edward Courtney and George Fisher were convicted of entering the offlce of E. House on Forbes street and attempting to blow open a aafe. It was the second trial ot the case. After tho first conviction Fisher strrngly protested his innocence and attempted to commit sulcido by hanging himself iu his cell in jail. His conn ed petitioned for a new trial, wliicli Jndgu Ew Ing granted, but they were again found guilty. Samuel Maxwell was acqmtted of the charge, of aggravated assault and battery on William Brent. A partial hearing was had before Judges Stowe and Slagle yesterday in the case of Mary Reese and others against the city of Pittsburg and E. M. Bigelow. The suit is to restrain the defendants from dumping dirt on tho wharf along Duquesne way and, it was al leged, rendering It unfit for wharf purposes. J. S. Ferguson. Esq., represented the plaintiffs. He asked for an Injunction, alleging that neither the city nor auyono else had a right to destrov the wharf for the purposes for which it bad been intended. City Attorney Moreland appeared for the defendants. He alleged that the city did not intend to destroy the wharf, but only intended to put it In good shape lor wharfage purposes. He read an affidavit from E. M. lllgclow to tkat effect. Mr. Bigelow stated that the formation of the ground was bad, and it was often submerged by water, and now that the wharf had been cleared of shanties he Intended to put It In good shape. The dirt hauled was to establish an even and uniform grade. The obiectlous of the plaintiffs v. ero due to their being stopped from storing boilers, machinery, etc., along tho wharf.
