f P THE PITTSBURG DISPATCH. WEDNESDAY," APRIL 23, 1890.' -'&W&ft' "V few asSF '"" m jjwi LOSS OF AGMBDIAN. Judge Over Eefnses Him Commis sions on Account of Negligence. A WAKD IS KOT BOUXD AT ALL Bj a JadffDient Entered Against a Guar dian for Maintenance. SOTES AKD SEWS FKOH THE CODETS Judge Over, of the Orphans' Court, yes terday handed down an opinion in the mat ter of the account of Ernest Ziegler as guardian of Edward Kunberger. In his ac count Ziegler credited himself with 5836 40 paid Mrs. Caroline Hutchison on a judg ment obtained by her against the boy Kun berger, who is her half brother, for boarding him for three years. Judge Oyer refused to allow Ziegler credit for this amount. He said: This Court has exclusiTe Jurisdiction in re tard to allowance for support and education of minora, ana a ward is not bound by a judg ment against his guardian for his mainte nance. In tbe settlement of the guardian's account he may conte-t such a judgment, both as to its fairness and amount. Continuing be taitl that tbe evidence did not support tbe claim of Mrs. Hutchison, all having lived in one family. Tbe boy contributed his earnings, and tbe amount paid Mrs. Hutchison would be charged to the guardian. Tbe latter by his negligence in not properly defending his ward's case, also forfeited bis commissions and the costs of this case wore placed onim. To-Dbt's Trial Lists.
