A EOUKD-TJP OP ILL THE COtJET K00MS Just as Judge Stowe was preparing to shake off the cares of office for the day, yes terday afternoon, J. T. Edmnndson, Esq., came into court and asked that the Pitts burg and Lake Erie Railway Company, orjeratinc- the Bellevernon Railway, be further enjoined from disturbing the peacc4 of the McMasters heirs. He said the rail way company's employes were rending the rocks with dynamite and with such violence in the vicinity of the McMasters mansion that mere existence had become a burden; that a hole two feet square had been blown through the side of the kitchen, and the rock still possessed momentum sufficient to wreck a cook stove. Mr. Edmundson fur ther asserted that the company was doing this without having secured the right of way from the complainants. Per contra, Frank Smith, Esq., denied that the mischief was as great as contended and said the workmen had not yet got within the limits of Mcilasters' place. Judge Stowe decided finally to make an order that the defendants comply with the law coverning such caes, and quit such heavy shooting. Mr. Smith said precautions had already been taken to prevent a portion of the dynamite exuberance. A Mining Company Must Shell Ont rark Bros, to Pay 34,546. A verdict for $3,200 damages for the plain tiff was given yesterday in the suit of Kobert E. "Williams against the Ohio and Pennsyl vania Coal and Coke Company. "Williams was a miner, and in an explosion in the compauy's mine at Port Royal was severely injured, losing one eye. He brought suit, claiming that tho mine was not properly -ventilated, thus causing the explosion. Iu the suit of the Philadelphia Company against Park Bros. & Co. to recover for natural gas used in the Black Diamond Steel Works Jor lichtint:, a verdict was given yesterday for 54,546 89 for the plain tifls, with interest from November 14, 1888. The defendants had claimed that their con tract for gas luel purposes covered what was used fcr lighting the mill. Suloc a Traction Company. Mary Hague yesterday entered suit against the Pittsburg Traction Company for 55,000 damages. She states that on January 7 she was getting off car No. 19 at the corner of Fifth avenue and Dinwiddle street, the car was started before she was off and she was thrown down and dragged some dis tance and seriously hurt. Standing or n Surety Company. The American Surety Company yesterday filed in the Orphans' Court a statement of its financial condition for approval as surety as required by law. The annual meeting of the Betail Lum ber Dealers' Association will be held this evening. The reports of the Secretary and Treasurer will be read and the annual elec tion of officers will be held. It is under stood that the possibility of continuing tne association another year will depend largely upon the attendance at ahd the interest man ifested in to-night's meeting. AN ORDINANCE GRANTING UNTO the Wilkinsburg Street Railway Company, its successors, lessees and assigns, the right to enter upon, use and occupy certain streets, lanes, alleys and highways, and to leaso its franchises or property or either. That the Wilkinsburg Street Railway Company, its les sees, successors and assigns shall have the rnrbt and is hereby authorized to enter npon the streets, lanes, alleys and highways included within its route, to wit: Beginning at a point within the citj of Pittsburg at the intersection of Fifth avenue and Denniston avenue: thenco along Fifth avenue in a northerly direction to tlie intersection thereof with Grazier street; thence along Grazier street in an easterly direc tion within said city to the city line, and thence returning by second or double lines of track along the parts or portions of the streets and avenues before named reversedly to the place of beginning, thus forming a continuous and complete circuit with its own lines of track or returning by the single lines of track, with the necessary sidings, turnouts and switches, and there construct maintain, operate and use, during the term named la its charter, its rail way with double tracks or with single tracks, with the necessary sidings, turnouts and switches, and to use electricity as a motive power, and also to erect maintain, operate and use an overhead electric system for the supply of motive power and to erect, maintain and uso in the streets, alleys or highways before mentioned such posts, poles or other supports as said company may deem convenient for the support or maintenance of such overhead sys tem, under and subject however, to tho pro visions of a general ordinance, entitled "A general ordinance relating to the entry upon, over or under, or the use or occupation of any street, lane or alley, or any part thereof, for any purpose by passenger or street railway companies or by companies operating passen ger or street railways and providing reasonable regulations pertaining thereto for the public convenience and safety," approved the 25th day nf February, A. 1 1890 Section 2 The said Wilkinsburg Street Rail way Company shall have the right and consent is hereby given to said company to lease its property and franchises to the Duquesne Trac tion Company or to any incorporated traction or motor power company which may desire to operate the railway of said company. Section 1 Be it ordained and enacted bythe city or Pittsburg, in Select and Common Coun cils assembled, and it is hereby ordained and enacted by authority of the same. That the Duaucsne Street Railway Companv, its lessees, successors and asicns shall have the right and is hereby authorized to enter upon the streets, lanes, allej sand highways included within its route, to-wlt: Beginning at a point on the western side of Neville street opposite the southwestern end of Ellsworth avenue; thonce aeros Neville street and along Ellsworth ave nue in a northeasterly direction to tho Inter section thereof with Penn avenue, and across Penn avenue to a point upon the northern side of Penn avenue immediately opposite tho northeastern end of Ellsworth avenue, and thence returning with second or double lines of track across Penn avenue to the north eastern end of Ellsworth avenue, and thence continuing with second or double lines of track along Ellsworth avenue in a southwesterly direction to Neville street and across Neville street to the place of beginning and thus form ing a continuons and complete circuit with iu own lines of track. And also for tho purposo of an extension of said railway at tho north eastern end of its route consent is given to enter with the consent of the owners upon priv ato property lying between the northern side of Penn avenue and Kirkwood streot. It appears by the petition and affi davit on file in the office of the Clerk of Coun cils that one-third in interest of owners of property fronting and aDuttlng upon the said street have petitioned the Councils of said city to enact an ordinance for the grading of tho same; therefore, section 1 Be it ordained and enacted by the city of Pittsburg, in Select and Common Coun cils assembled, and it is hereby ordained and enacted by the authority of the same. That the Chief of the Department of Public Works be and is hereby authorized and directed to adver tise in accordance with the acts of Assembly of the Commonwealth of Pennsylvania and the ordinances of the said city of Pittsburg re lating thereto and regulating the same for pro posals for the grading of Renfrew street from Achilles street to Lincoln avenue, the contract therefor to be 1c: in the manner directed by the said act of Assembly and ordinances. The cost and expense of the same to be as sessed and collected in accordance with the provisions of an act of Assembly of the Com monwealth of Pennsylvania entitled "An act relating to streets and sewers in cities of the second class," approved the 16:h day of Mar.
