Gould and Sage Escape. New York, February 20 —The Grand Jury handed a communication to Judge Cowing to-day before they were discharged, in which they say that a proceeding was brought before them by the District Attorney in re gard to Messrs. Jey Goald and Rus sell 8 as trustees of the Kansas Pacific Railroad mortgage in 1880; that they have given the case several days careful consideration, and have thoroughly examined all the compe- tent witnessess offered; that they had the benefit of the assistance aod ad- vice of the District Attorney sod the advice and rulings of the Court, and that under such rulings they did not feel warranted in finding an iodiot- ment. Mr. E L. Andrews, one of the counsel for the complainants, said : We do not propose to let the case rest where it is and will bring it be. fore the next Grand Jury. It is evident that the Grand Jury bave found th t a crime was committed, but, under the ruling of Judge Cowing, decided not to bring an indictment simply because they thought under that roling the crime had heen barred from prosecution by the Senate of Limitations.
