The bill providing for land registra , tlon was whipped into shape for intro duction into the 11)10 Legislature, but in view of the war It was decided to wait until the country had gotten bach to normal before taking any steps to have the bill passed. Would Prevent Itlanilors The primary objects nre to give great er security and certainty to titles, to avoid the necessity of repeated and ex pensive examinations of the evidence connected with the came title, and to cause real property interests to be more" readily available as security as the re sult of the quickness with which they may be transferred. In the first Instance there must be a judicial proceeding which, so far us possible, Bhnll determine and quiet title and fix and specify matters, if any. which may still be left undertermlned or to be worked out in the future. The system nt the outset would be Voluntary. The statute would have pro visions that will appeal to owners of land, especially In the larger counties. In order that the rights of possible clntmants may he safeguarded, and ade quate assurance fund tlioulil be pro vided by the state. I Present Plan Too Costly i Sir. S3iegert pointed out that thou sands of dollars are paid out annually in this city to get opinions upon the titles to pieces of real estate under the present sjslem of land transfer. I "From our own experiences in Phila delphia," continued Mr. Slegcrt, "we nil know that questionable titles may be refused insurance by one title com- ! pnny upon the opinion of the proper officer of that company, and yet will be Insured by another title company on ac count of n different opinion or the pay ment of a higher premium by the proper officer of that company. "Wc must further realize that the title company insuring such a title as sumes its responsibility only to the per hon or corporation Insured. Should tho insured sell the property and the new purchaser fall to have his title Insured by the company his Insurance ceases and the new purchaser has no better title than if the property had never been insured. "I'mler the Torrcns system the ex amination would be official against tnc whole world, because of an official ex amination and decree of the land regis tration court. This will of necessity be a greater protection to any property own er than n mere opinion of an attorney or conveyancer, or even tho title insur ance company, which Is itself only based on opinion." In the opinion of Mr. Slegcrt and his fellow members of the commission, the entire machinery to enforce the pro posed net will not cost more than $30, 000. The act provides for a court consisting of thrco judges who shall sit In Harris burg or nt various county nonts to pass judgment on disputed titles.
