Governor General Dodges Discussion of Subject Explanatory Comment rriHE partition of tha administration of Belgium, nj?annt which the Cardinal so forventlv protests, was part - of the same insidious plan the intent of which was revealed in the Flemish reorganization of the University of Ghent. It wns characteristic of the German mind to seek to capitalize differences of language and to make them the basis of differences in national aspirations. ' As a matter of fact, although the Flemings and Walloons had bcon at odd3 on a number of subjects prior to the invasion of Belgium, the disputes were nt bottom chiefly cultural or sentimental. The Breton of France takes pride in his native Celtic tongue. The profession "Feilbrige" of the louth of France labors diligently to extend the use of Provencal, but the men of Qulmperle and the men of Aries are equally good Frenchmen. And, although differing in language, the men of Charleroi and tho men of Antwerp were perfectly good Belgians., ; But the Germans sensed a possibility for disunion and played their cards to tho utmost. Flemish, although markedly differing in some particulars, is, on the whole, closely allied with Dutch. It bears also certain vital resemblances to English. Flemish prevails in the north and west of Belgium, and there wero more tlian 3,000,000 who spoke that tongue exclusively in 1910. French, tho language of the south and east, was tho solo language of something under 3,000,000 Belgians. More than 800,000 persons spoke both Flemish and French. Some 74,000 persons spoke French and German, 8000 spoke Flemish and German and 52,000 spoke all three languages. the conference took a broader view of the matter. It quite realized that were certain officials to remain at their posts in invaded territory, they would fre quently perform their duties much bettor, at least morally speaking, toward the population. Refers to Hague Conference Notwithstanding this, both at tho Brussels con ference in 1874 and Tho Hague conference in 1890, the official representatives intrusted with tho task of drawing up n code of international law, laid great stress not only on the claim of officials to liberty of action, either in resuming their duties when the oc cupying power invites them to do so or in declining to resume them, but also on the liberty of resigning after having once agreed to resume the various duties. I would invite your Excellency to read over again Article IV of the Brussels conference of 1874 and the protocols of the same conference and you will find there, supporting the liberty of officials, the explicit declarations of M. Beernaert and Baron Lamber mont, for Belgium; M. Landsberge, for Holland; M. Vedel. for Denmark, and Colonel Staaf, for Sweden and Norway. I appeal to the testimony of neutral countries as they are indisputable arbitrators of international law. I would also invite your Excellency to read through again the protocol of The Hnguo conference of 1899 and the Rolin report, which is an authentic commentary on the articles voted by this conference. Your Excellency would see that the conference unanimously denies "the right of the occupier to constrain directly or indirectly any class of employes of the occupied state to resume their duties." Seeing that the Government General in Brussels at the end of the year 1914 sheltered its invitation to the public officials in Belgium behind The Hague con vention, I forme 1 my conscience according to its pro visions and answered my harassed inquirers: "Tho conti act submitted for your signature prior to your engagement includes nothing which com promises your consciences on the score of morality or religion or loyalty to your country. You may, therefore, sign it without forfeiting either your honor or your patriotism. Your services contribute, indeed, toward the national weal. I do not doubt that the Belgian Government, were it possible to consult it, would ratify your acceptance. You are not, there fore, wanting in loyalty. As regards the engage ment you are lequired to enter into, "to undertake nothing against Geiman administration in the occu pied territories," it commands you to respect both public order and the regulations needful to maintain it. None of you has the, intention to break thorn. But if some day the conditions of the contract sub mitted for your acceptance were to change their character, you would always be free to repudiate it. CHAPTER XLI The Cardinal's Altitude Toward Partition of Administration THE German Government, wishing to break up Bel gian national unity, included in its program of reconstruction in Belgium a regime of administrative separation. This work of disintegration was begun in Novem ber, 1916, by doubling certain branches of tho service in tho ministry of science and art, thus creating two classes of officials, whose duty it was to control educa tion in the Flemish and Walloon provinces, respectively. To pacify tho mind3 of the officials in charge, the Ger man civil administration informed them that the ques tion was but one of internal order and had nothing to do with separatist administration. On March 23, 1917, the occupying power threw off the mask. By way of fulfilling tho promise made by the Imperial Chancellor some weeks previously to the members of the traitorous "Conseil dos Flandres," who had gone to visit him in Berlin, he had an order pub lished according to which Belgium was to be divided into two administrative districts, the first with its headquarters at Brussels, the second at Namur. On leceiving this news, Belgian national feeling was deeply stirred and numerous protests were made to the Governor General by prominent persons in tho country. Senators and deputies belonging to all parties met and deliberated on the attitude of passive resistance they ought to take toward tho order) of March 23. Some of them considered that all officials in the central administration ought to resign; others went so far as to recommend the resignation of all officials, even purely local ones, magistrates, mayors, teachers, etc. The opinion which prevailed and to which in the end the members unanimously assented wns that only the highest officials of the cential administration should lesign and that lower officials should bo free either to resign or remain at their posts. The Belgian Government, on being consulted, Implicitly approved of this modified solution, urging, (however, the officials of the exchequer to delay their kengnations for the time being. The occupying power was not slow in taking steps tigainst refractory officials. On tho pretext that in withdrawing the declaration of loyalty, which they had signed at the beginning cf the occupation, and refusing Eto continue giving their services they were setting up Uctive resistance against the carrying out of legal pro visions, the government had them deported to Ger many. Protests to Falkenhauscn The Cardinal made an energetic protest to Baron fon Falkenhauscn against these flagrant violations of nternational law and The Hague convention. Sir Since the beginning of the occupation of Belgian soil by armed force, the representative of the Imperinl Government fully understood that the administration of our country had to be organized in conformity with international law. To the various classes of officials forming pair of the civil administration, Baron von Bissing, basing his action on The Hague convention, addressed an invitation, whose burden, if we prescind from the hanants of diction, was as follows for all of them: "Do you agree to fulfill under my general admin istration the offices you held under the Belgian Gov ernment? Not otherwise than my predecessor, Baron on der Goltz, I do not ask you to lay on one side your national spirit; rather, I appeal for your co-operation m the public interest.
