We recall the Revolution, and the Pennsylvania line, even though some times mutinous, and the Confederation, and the Federal Convention, and the war of 1812. We think of the old Revo* lutionary Presidents, (so were they called), Wharton, and Reed, and Bryan, and Moore, and Dickinson, and Frank lin: and her brave soldiers, Wayne, and Morgan, andlrvin, and Armstrong, and Potter, and Muhlenberg, and Cad walader—of herearly Governors, Mifflin, and McKean, and Snyder, and Find lay—of her early and her later states men, Edward Biddle, Clymer, Wilson, Morris, Ross, of Fitzsimmons, Sit greaveß, the Hopkinßons, Sergeant, and Nicholas Biddle. And then we pause with mingled feel ings, as it were on the edge of the liv ing generation, and wonder what the judgment of history will be on them. To some, or at least to one of them, no f renter injustice can be done when ead, than there is while living. The dark cloud of prejudice which wicked men have tried, and perhaps success fully, to wrap around the fair form of the only President of the United States that Pennsylvania furnished, a states man of pure, private, and eminent pub lic character, must, in the end, be dis sipated, and Mr. Buchanan, if we mis take not, will pass without cavil into the canon of her illustrious men. So with others less prominent, but still distinguished. We have been led into this train of thought by the perusal and the reperusal —for no one will be content with one reading—of what we do not hesitate to describe (and in this we measure our words) as one of the most remarkable productions of the day. We refer to Judge Black's reported argument, or more properly oration, before the Su preme Court of the United States on the subject of military Commissions. In speaking of it as ail oration rather than as an argument, we do not disparage it as a forensic effort. What we mean is this : To prove to a bench of learned lawyers, by juithority or logic, that a citizen, outsideofacamp or even within it, no war existing, cannotbe convicted, or imprisoned, or hung, without a trial by jury, would be, even in these abnor mal times, hardly necessary. There is not a lawyer in the world, unless it be Mr. Speed, who disputes it. But soinert and benumbed have of late become the judicial instincts throughout the land, ho ready have judges, high and low, Federal and State, been to bow to Exe- cutive will, to shut their eyes to Execu tive intrusion, to be deaf to the prayer or the demand of those who appeal to them in behalf of violated law, that it needed something like the blast of the trumpet to arouse them. From the 27th of May, ISOl—fivelongyears ago—when, on the record of a Federal Court, not far oir, were written these brave but inef fectual words : Ordered that an attachment forthwith issue against General George Cadwulader for a contempt in refusing to produce the body of John Merryiuan according to the command of the writ of habeas corpus, re turnable and returned before me to-day, and that said attachment be returned be fore at 12 o’clock to-morrow, —from the day when the late Chief Justice wrote this order, down to this month when military commissions have been pronounced illegal, and their acts of blood, murders, not even judi cial, we repeat our convictions that the high instincts of the judiciary were benumbed. It was to stir them into new life, to shock them, as it were, into vital action, to make judges feel that it was time to assert their ancient func tions, and to stay the hand of arbitrary power, that Judge Black and his col leagues spoke. Wedoubtnottheeffbrts of all were worthy the occasion, and we shall be glad when the opportunity is afforded us to do them justice. Our gratitude and our praise are now due to this remarkable effort of our Pennsyl vania lawyer. We shall not attempt, within our nar row limits, to analyze it or to sketch its course ofreasoning. Thereisnotaword in it which the commonest mind can not comprehend. The heart must move sluggishly, and the imagination must be dull indeed, which its appeals do not stir and excite. Its rhetoric, often ornate, as is everything Mr. Black’s pen writes is so clear and direct, that no one can resist its influence ; and the feeling ev ery honest man must have when he lays it down and finishes the exposition of the lawless tyrrauny of which for four or five years the Northern people have been the victims, In the guise of these irregular processes and tribunals, is that of wonder and of awe at the escape which we have at least made. Listen to its concludiug appeal, the only ex tract we can make : . While such tribunals are utterly power less lo do even a shudow of good, they will be omnipotent to trample upon innocence, to gag the truth, to silence patriotism, and crush the liberties of the country. They will always be organized to convict, and the conviction will lollow the accusation as Hurely as night follows the daj r . The gov ernment, of course, will accuse none before such a commission except those whom it predetermines to ruin and destroy. The accuser can choose the judges, and will cer tainly select those who are known to be the most ignorant, the most unprincipled, and the most ready to do whatever may please the power which gives them pay, promotion, and plunder. The willing wit ness can be found as easily as the super- Horviceable judge. The treacherous spj r , and the base iuformer—those loathsome wretches who do their lying by the job will stock such a market with abundant perjury, for the authorities that employ them. A corrupt and tyrannical govern ment, with such an engine at its command, will shock the world with the enormity of its crimes. Plied as it may be by the arts of a malignant priesthood, and urged on by the madness of a raving crowd, it will be worse than the popish plot, or the French revolution—it will be a combination of both with Fouquior Tinvillo on the bench, and Titus Oates in the witness’s box. You can save us from this horrible late. You alone can “deliver us from the body of this death.” To that fearful extent is the destiny of this nation in your hands. Impassioned as these words may seem —unsuited in one sense as they may be said to be to the tribunal to which they were addressed, they were needed, and what is more material, they were effec tual, and the highest court of the land has denounced these processes of tyran ny as infamous. One other word. Judging others by ourselves, and in the dim hope that there is a remnant of sentiment left in the people of the North, wewouldprint this speech as a campaign document, circulate it by hundreds of thousands, put it in the hands of every voter of Pennsylvania, and with it make one last appeal to the popular heart. Our conviction is.it would meet with a re sponse, and that Judge Black would add to the triumph his eloquence has already won, the greater and the higher one of guiding back into the path oftrue loyalty to the Constitutionandthelaws the great array of the people in whose presence judges, and courts, and presU dents, and military commissions are literally naught.— -Age, April 10. sepl f<rti«o. Her life Was thus made a scene of painful distress and existence almost a burthen. she liad applied to all the physi cians within reach, and had diligently used such medicines as tney gave her, but all to no purpose.
