Important Decision. The Supreme Court of Pennsylvania have affirmed the judgment of the Court of Common Pleas of Dauphin county, rendered for defendant, in the suit by the Commonwealth of Pennsylvania vs. The Delaware and Hudson Canal Company, in which the sum in controversy amounted to about ninety thousand dollars. The opinion of the Court was delivered by Chief Justice GIBSON. The main question settled, is, that the defendants, who by statuatory license, purchased out the interest of IVlsuarcE Wunrz, in certain improvements in Pennsylvania, and by the same license hold land in Pennsylvania, are mevertlieless a New York corpo ration, and not embraced by the terms of the acts of 1840 and 1844 taxing companies "incorporated 'by or under the laws of Pennsylvania," &c. It is understood that the company have been paying the taxes imposed on them by the prospective act of 1848. REAR, Esqrs. • CHOLERA.—Forty cases of Cholera reported in Philadelphia, on Saturday, 0 deaths-. 23 cases on Sunday, 10 deaths. The total number of inter ments in Cincinnati, during last week, were 1,101 - of which 800 were from Cholera, 296 other dis eases. :MISSISSIPPI.—At the Democratic Convention for this State, held at Jackson on the 28th of June, General JOHN A QUIT/a r cs was nominated as the DeMocratic candidate fot Governor by acclamation: SAMUEL STAMPS, for Secretary of State ; GEORGE G: SWAN, for Auditor ; li. GRIFFITH, for Treasurer; and D. C. GLENN, for Attorney General. This is a ticket that will be sustained by an overwhelming majority at the polls. From Mr. Warren's Book of Lawyers Lawyers' Ilifdakes. I myself recollect a case in which an attorney's clerk had omitted one single letter, in making the copy of a writ of capias, to be served upon. a de fendant, who was clandestinely going to India, owing a widow a large sum of money, which she had lent him. She accidently, however, discovered what he was about, and instantly communicated with her attorney, in such a state of alarm as may be conceived. He was an able and energetic prac titioner; and within a few hours' time, had got a capias issued against the dishonorable fugitive, and accompanied by an officer, succeeded in arrestin‘r the prisoner just as'he was' stepping into a steam boat to go to a ship, which Was expected to sail from Gravesend on that or the ensuing one. Yo. may guess the consternation with which he found hiinself thus overtaken; but it scarcely equaled that with which the attorney received, early the next day, a rule to show v cause why the defendant should not be discharged out of custody, on enter ing a common appearance, on the ground of a va riance between the writ and the copy served; the discrepancy being between "Sheriffs of London" in the one, and "Sheriff of London" in the other. Eminent counsel were instantly instructed to show cause, and struggled desperately to discharge the rule; but in vain. "It is better," said the tranquil Chief Justice Tindal, "to adhere to a general rule, capable of application to all cases, than to raise an argument on every imperfection in a copy, as to the materiality or immateriality of the error, and thereby offer a premium on carelessness." So the rule was made absolute—the defendant discharged—he went to India. I sadly fear that he has never made his appearance here again, and that the widow lost all that he owed her, and which, but for the wretched mistake, she would, in all hu man probability, have recovered. This happened nearly sixteen years ago, and coming under my personal notice, made a deep impression on my mind. I have a vivid recollection of the vexation and distress which it occasioned to the parties both lay and professional. Only a year or two ago, a precisely similar de cision was reluctantly pronounced in the Court of Exchequer, in respect to a similar blunder, the very same word! (See Moore v. Magan, 10 M. and W. 95.) Now, can anything be imagined more serious to the client and mbtifying and in jurious to the practitioner, than such miscarriages? Counsel, also, 'alas, can make desperate slim, of this sort. That eminent conveyancer, the late Mr. But ler, accidentally omitted a single word, "Gloucester, - on drawing the will of Lord Newburgh,.which de prived a lady, the intended devisee, of estates worth £14,000 a year. HENRY E. LEMAN :—Your favor of the 25th inst., is at hand, and in reply say that the Grind stones we run with Wortes wheel are from 5 to 6 feet high, 9 to 12 inches thick, weighing front 3 to 5000 lbs. We formerly used 'an undershot wheel 12 feet wide and 14 feet high. Our head in an ordinary stage of the water is about 3 feet, 3 or 4 inches. Sometimes much less than that. -With the old wheel we run two grindstones. In the same place we have now four of Wortz's wheels (3 36 and 1 40 inches,) running four grindstones and one trip hammer weighing about 80 lbs. with less water and doing more work in the same time. In regard to the quality of the wheel for the purpose of grinding, it is far superior to . any I have ever used or seen used, and for a low head I believe it is the beat wheel in use—during the whole winter (which has been untisuallrEold) we have not been affected at all with the ice,and in high water at.a stage which would stop he old wheel entirely, we now find no inconvenience from back water.
