MvTJtt m- -- f X The Daily Intelligencer. ,-te bANOABTKIt, OOTOllER 10. 1SSS. '.'.J The Collapsed Lam t'-.-i Judge Paxson tells the Philadelphia iPtat from rittsburg that tlie sunrtms 'Court lias filed no decision In the municl- f'pt law case and declines te say what its VjCdejiskm has been in advance et such 1-filing;. Such retlccnce, however, was fx., wneny unnecessary in view or. me ibci. ""ttt the opinion et the court, in .tbe case of Grant street, Lancaster, whlch we printed in full yesterday, ccr- $ -fotiflcate nnd all, declares that the muni eipaiaccei iea iim neon unanimously j, mwu iw w u..,1 . .,.. Appeal. That lue decision in tne Avers DDeal is net vet filed does net effect i''i the fact that It has been made. It is net te be supposed that n decision deliber ately and unanimously roade is withheld from record by the supreme court from any doubt ns te its correctness. It must be assumed that it is net filed because it is net fully writ ten out, or for some ether formal cause that does net at all affect the certainty et what it will be. It is wrong, of course, for the Bupreme court te an Bounce a decision indirectly in another case before the decision in the case itself Is ready for filing. It was a piece of gross carelessness. But new that the decision has been thus announced it should be promptly recorded, that the municipalities affected miy set their houses In, order. We want te knew just what has been decided. The Grant street case seems clearly enough te state that the act of 16S7 is unconstitutional; but there may possibly le some saving ex ceptions in the decision itself. If the net is unconstitutional alto gether, et course it is ns though It was never passed nnd every net dene under it is void. Every officer elected or appointed under it is out of office- and has never lawfully be in efllce. Tliose who occupy offices that no ether person can claim under the old law, will held en te their ofTlce3 and be the ile facto officials until someone with a better right presents himself te claim them. The day of election under the new law Isthesame ns under the old, the third Tuesday in February ; aud the day upon which the new officers take their places Is the same, the first Monday In April. The term of the former mayor hed there fore expired when the present mayor was inaugurated, and his election took place en the proper day. There seems te be geed ground therefore for the opinion the city solicitor is said le ex press that the mayor will held Ills effice ler the two jeav term under the old' law, though he was elected for a four year term under the new. But the city councils are differently constituted under the new law ; nnd it would Beem that its collapse will carry the council down with it, along with all the new officials it created. The Turnplke question. The Beatd of Trade has listened te an able presentation of the objections te the proposed purchase of the turnpikes by the county, nnd it is cheering te the friends of tberneasure te find the best effort of their opponents be extremely feeble in 'Mwerth of .fftcterargument, His net .'"true vhiAffeaua can net be well managed by public officers, for they have been and are ee managed all ever the world, and in fact tell-gates, along with ether customs of past ages', have been long for gotten in many putts of the laud. The presentsystem isnet as Justus thoonepro theonepro thoenepro posed because geed reads ure a benefit te the whole county, and the whele county should pay for tbem. The traffic en them should be encouraged and net taxed ns it is at present. The farmer who brings LU preduce te town through a tell-gato must make geed his less olsewhere. His customers really pay his tell. Tlie de velopment of our town has been held in check by this lax en traffic, n tax that nt Mme time wn? justifiable and wise, but is new driving our country people toether towns that can be reached ever free reads. The peer farmers who pay this tax would hardly object te a proposal that it slieukl be shared by the people of the city who profit by it. As matters are, no farmer will pay tell te get into the town if he can de his business ns well elsewhere free. Under the proposed freedom et the reads our city will be at no such disadvantnee. The county will net object te a removal of this tax en traffic, which will fall mero lightly than the present tell upon every peer farmer who must use tlie pikes. Mr. Eshleman argues that the benefit of the measure te township? new having reads will be greater than te theso that nave none. And se will the cost be greater, for they will bave te keep up the reads. There is nothing lu the point any way. The govern ment Improves rlveis and harbors, though few own ships ; it keep3 up an expensive consular force In the Interests of a few citizens abroad, and in a thou Band ways appears te tax citizens for ser vices that can only affect them remotely. The state aud county maintain asylums and Jails that are filled mere from the town than from the country, and mere from one sectieu than nuether, yet all are taxed alike aud there is no injustice. Mr. Herr gave the advocate et tell-gates an awkward topic when he aske I him te consider hew the measure would af fect the county as a whole. That is the way the matter must be considered, and what is geed for the whele county must in"tfterCfl-bfi geed for any part. ,si The Contest for thVajerulty. Mr. Hewitt hai fairly launched him self, upon New Yerk as the candidate for mayor of one Democratic organization and of a citizens' mass meeting. Mr. Hewitt in accepting the nomination de clared that he did net want it, but was bound te run because Tammany Hall bad net put up its own candidate; and Mr. Hewitt thought that Its candi date should net be mayor ; though the man was geed, the organization that would own him was bid. It is a star chamber, nnd net a popular creation. It Is a trust In fact, Jn Mr. Hewit' opin ion ; and what could be worse V It is an amusing attitude for Mr. Hewitt te take, becausj he has been a Tammany mtn and a Tammany candi date often. Fer his present office he had 1U nomination. Tbete Is no doubt at all of Mayer Hewitt's honesty, sincerity and force. The fact new undoubtedly is thi t be find! Tammany Hall's hand raised against bim, and he will net kt It strike blin down, if he can help it. The old Adam is raised within him ; nnd he is in for the light. Llke an old war herse he sniffs the ba'.tle from afar, nnd prances about in enjoyment et the coming melee; whether or no it will hutt the presidential candidate of his party, is net the crucial question in the issue with Mayer Hewitt; it interests him mero te knew whither it will hurt him. Fortunately the contest of the mayors Is net likely te affect the presidential con test. Beth candidates for mayor and their partisans sustain the Democratic state nnd national tickets. The Itepubli cans seem te think that the lack of Damo Dame Damo cratie unity en the municipal question will be in their favor ; but it cannot be unless there should be trading et Demo Deme cratic presidential votes for Repub lican mayoralty votes ; and of this there is little likelihood, even though the Pennsylvania adepts in games of this kind muster under Quay in New Yerk te exercise their talent te the best advantage. And by the way, in view of Quay's eminent repute as a master of political chicanery, his offer et a reward for the detection of cheating at the polls in New Yerk is a refreshing exhibition of cheek. ASr.NA.TK committed hat descended te the conslderutlon of Widow McGulnesa' p'g, and ethor nut ter that Indicate tbe natural intercit of Democratic ductals in the success of their party. Tin: Lancaster & Llttlz Turnplke com pany calmly proposes te the city, when cotllled te repair Ha read, tbat It will aban aban den It if It Is ptl 1 for It. Our distinguished fellow luwuiman, Ben. H.
