"The trial of Edward Lay ten for the murder of his wife caine te a lingular and unsatisfactory termination lata last night That the public interest In the case had reached an almost unprecedented height was proved by the large number of per sons who Wcre unable te obtain admission te the court. "On the prerleus evening the evidence for the prosecution had closed, and thcre was a painful and eager expectancy in the minds of all present as te the line of de fense which the prisoner intended te adept. This line of defense It lndecd it can be called a defense was as surprising as it was brief. "The prisoner, addressing the judge and jury, Intimated that it was net his Inten tion te call witnesses en his behalf. Most of the witnesses for the prosecution, he raid, had given their evidence fairly, and If they bad committed themselves te mis statements and discrepancies, it was mero because they wcre cither misled or mis taken In the case of one witness, Ida White, because she was strangely preju diced against him than that they had a desire te make the case against hlra even blacker than it was.. It had happened be fore, and would doubtless happen again, that a man found himself thrust into such an unhappy position as he himself steed through no fault of his own, and that he was unable te say or de anything te prove his Innocence. Some times It was with such a man a matter of honor, sometimes n matter of conscience. In his own case it sprung from both his honor and his conscience that his lips wcre sealed, and the utmost he could say for himself was that he was an innocent man, with se dark an array of evidence against him as te almost Incontestable prove him te be guilty. All that he could de was te declare most solemnly that the accusation npeu which he was being tried was false, and that he steed befere them as un stained by crime as they wcre themselves. ' What could be said truly in bis favor was that his character, and te seme extent his blameless life, wcre a refutation of the charge. Evidence of character was gen erally called in mitigation of impending punishment. He did net Intend te call such evidence, because, by se doing, it would be ft half admission that he steed thcre a guilty Instead of an Innocent man. He knew perfectly well hew lawe and Im potent these weak words must sound In the cars of these who wcrp sitting in Judg ment .upon him; "but this he' could net help. It was but part of the fatal web la which he was entangled. That he and his wife hed lived unhappily together was net te be disputed; but even in this most serious crisis of his 11 fe he denied the right arrogated by the legal profession te rip open a man's private- affairs and cx cx cx pose te the vulgar gaze what he desired should be hidden from It. The last thing he would de, even if he had been In ten times the peril in which he then Btoed, was te drag ether persons Inte the case, and te allow them te be blackened and vlllfledas he had been. 'lean scarcely doubt,' said the prisoner, 'what your ver dict will 'be. Wcre I In you? place I ftheuhl most likely decide as you will de cide) but none the less will it be a solemn fact that, though you Pre legally right, you are morally wrong. I must be con tent te let the case rest as it has been pre sented te you, and te ablde the lssue, though it may cost me my life.' "Never in a criminal court, in the case of a man arraigned upon se grave a charge, has thcre been heard a defense se weak and strange; but it is nevertheless s fact that the prisoner's earnest and, te All pppoarnnce, ingenious manner pro duced a deep impression upon all who heard him, and when he ceased speaking there was, in the murmurs of astonish ment that followed, au unmistakable note of sympathy. "After a slight panse the attorney gen eral rose te sum up the case against the prisoner, and his ,iuc!slve judicial utter ances seen dispelled the impression which the prisoner's earnestness had produced. He said lhat in the circumstances of the case his speech would be briefer than it otherwise- would liave been. He had a duty te perform and he would perform it, without, he hoped, any undue severlty or barshnesi. Unhappily the cvidence was only tee clear against the prisoner, and unhappily the prisoner had strengthened the case against himself. This was net a matter of sentiment; it was a matter of justice, and justlce must be done. With slight limitations, around which the pris oner threw a veil of silence, contenting himself te cast suspicion upon them by seme kind of mysterious implication which no person could understand, and net venturlug te give them a distinct and indignant denial with slight limitations, then, the prisoner had admitted the truth fulness Of the evidence brought against him. As the prisoner hed net di rectly referred te these doubtful points in the evidence, he would him self de se and endeavor te clear away any latent doubt, if such existed, in the minds of the jury. First, with respect te the ulster. T10 prisoner did net deny that he were this ulster en the whole of the day his coachman, Jehn Moorhouse, was driving him te various places, and it was only upon his arrival home at midnight that he endeavored te shake the coachman's evldcnce as te whether, when he entered the carriage, upon leaving Provest's restaurant, mm upon his Issuing from the carriage when the coachman drew up at his house, he still had his Ulster en. What his motlve was in endeavoring te shake the coach man's testimony upon this point it was Impessible te say. He (the learned coun sel) had most carefully considered the matter, and the only conclusion he could arrive et was that the prisoner was anx ious te instil a doubt into the minds et the Jury, that it was net he who left the res taurant at 11:50 and entered his carriage, and that It was net he who alighted from the carriage and opened his street deer. But supposing for Instance, that this ar gument had a foundation In fact, was it net easy for the prisoner te prove what he hed done with himself between 11:50 en the night of the 25th et March and 7 o'clock en the morning of the SGthr Surely some person or persons must have seen him, and had he produced these persons thcre would have been a rcasouable alibi set up, which It would be the duty of evcry ene engaged in this case seriously te consider. Indeed, no weuiu go se xar as te say mar, admitting such cvidence te be brought forward and established, thcre could net be found a Jury who would convict the prisoner of the charge brought against him. It would then have been proved that the prisoner liad net seu Ids wlfe from 11 o'clock en the morning of the 25th of March until 7 o'clock en the morning of the 20th;and as itwas during the night of these days that the unhappy lady met ber death, it would liave been impossible te bring the prisoner In guilty. But, easy as this evldcnce must have been te pro duce, there 13 net only no attempt te pro pre duco It, but in his lamentably impotent speech the prUener does net e en refer te it. In his mind then, and In the minds et all reasonable men, thcre could net be a doubt that this was the case of ene who, in despair, was catching at a straw te save himself. The learned council touched briefly but incisively upon every point in the evidence concerning which the pris oner had maintained silence and had made no endeavor te confute. Fer instance, there was the lady whom he met In Bloerasbury square, whom he took te Pre Pre eost's restaurant, whom he regaled with " a supper which neither he nor the touched a distinct proof that they ere etherwise momentously occupied. The evidence with respect te this lady is irre fragable. She was no shadow, no myth, no creation of the imagination; she was a veritable being of llesh and bleed. All the efforts of the prosecution hed failed te trace her, end the Just deduction was that she was somewhere In hiding, afraid te taste and placed stde by aids with the prisoner in the deck. The prisoner did net deny her existence, nor that she and he were for several hour In company with each ether. Were he Innocent what pos sible doubt could exist that he would feting her forward te establish his Inno cence? Were both Innocent, would net ate et her own accord step forward te prove ltf The prisoner in his address made certain allusions te honor and con science, by which he would make It ap pear that he waa guided by his honor and his conscience In the singular method of bis defense t and it saay be that there ex isted in him some mistaken sense et chiv alry which Induced him te de all in his power te screen the partner in his crime. It would have been better for him had he brought his honor and his conscience te bear In the unhappy engagement into which he entered with the unfortunnte lady who afterward became his wife; but It had been amply proved that the mar riage was net, en his side at least, a mar riage of affection. Distinctly he 'harried her for her money, and distinctly he would be a great gainer by her death. Thus, then, there existed a motive, and net a novel one for the tragedy has been played many times in the history of crime for his getting rid et her. He (the counsel et the prosecution) did net wish te press hardly upon the prisoner, who was a man et culture and education and must (eel keenly the position in which he steed, whatever might be his outward demeanor. But it devolved Upen him te impress upon the jury net te allow any false sen timent te cause them te swerve from the straight path of duty. They must decide by the evldcnce which had been presented te them, and It was with a feeling the reverse of satisfactory that he pointed out te them that this evidence could lead te but ene result. "The summing up et the learned judge (which, with the attorney general's speech, will be found fully reported in ether columns) was a masterly analysis et the evidence which had been adduced. He impressed upon the Jury the necessity of calm deliberation, and of absolute con viction befere they pronounced their ver dict. Circumstantial evidence was, of all evidence, the most perplexing and dan gerous. It had, In seme rare instances, erred; but these exceptions wcre, happily, few and far between. It had, en the ether hand, led te the detection of great criminals, and without its old many holn heln holn eus aggressors against the' law would slip through the hands of justice. He dis missed the Jury te their duty, and he prayed that wisdom might attend their deliberations. "At 8:30 o'clock the Jury retired, and it was the general impression that the case would be ended within the hour. The prisoner sat in the deck, shading his eyes with his hand. Net ence did he leek up te the court, no seemed te be preparing himself for his impending fate. But 4 o'clock, 5 o'clock, 0 o'clock passed, and the suspense grew painful. It was clear that thcre was net that agreement be tween the jury which all the court, in cluding even the prisoner, had expected. At 6:20 the foreman of the Jury entered the court, and informed the Judge that there was no chance of the jury agreeing upon a verdict. "The learned Judge then intimated that, after se long and patient a trial, he could net lightly dismiss the jury from their duties, and he bade the foreman again re re ro tire te a further consideration et the cese. "Seven o'clock, 8 o'clock, 0 o'clock passed, and then the learned judge sent for the foreman of the jury and inquired whether any progress had been made toward an agreement.
