road, has been thoroughly repaired and given
a trial trip this morning. The engine waa in
charge of Mr. A. R. Mess, master mechanic
of the Frederick division.
Mr. "Wilsen Brown, superintendent or the
Frederick division, was In town te-day intro
ducing his patent joint supporter. The
patent waa given a teat en the tracks In the
west yards. The purpose of the supporter is
te prevent the wearing out of the Joints and
te avoid all Jolting when running ever them.

Jeseph A. Sehlegelmllch was next attached
for trial. This was an action te recover en
an account between the partlea, the amount
of which was agreed upon a few years age,
but which the defendant failed te pay. The
defendant did net appear, nor was he repre
sented by counsel. The Jury found In favor
el platnlltl for jaSi J. liay Brown for plain
tiff. The suit of Charles A. Lecher, surviving
partner or D. P. Lecher A Sen, vs. Michael
Ulmae, was tried this morning. This was a
suit en a promissory note given in 1SS1, for
MOO by Ultnan te William Sales, discounted
by the bank and placed te Sales' credit
The Jury found In taver of plaintltl ferK30 07,
and counsel ter delendant was granted a rule
te show cause why a new trial should net be
had. Reynolds and McMullen for plaintiff ;
Kaunian and J. liay Brown for defendant
The next case attached waa Henry M.
Mayer and Calvin Cooper, committee of
DivldM. Mayer, va Tb Fulton National
bank. The facta In the case, en the part of
the plaintiff are substantially these: On
November 10, 1S2, Henry M. Perney Ce.
gave a check payable en November 7, te
David M. Mayer. Tbla check In the course
of business came into the possession cf Levi
Sensenlg, who had it discounted and placed
te bis credit at the Fulton bank.
The check was net mat when due
and was protested alter the pretest
Ames B. llestetter, a member of the
firm or Ferney A Ce., called at the Fulton
bank and drew three drafts, aggregating
some (1,500, the proceeds of which were te be
appropriated te the payment et this check.
The bank, the allegation is, reiuaed te credit
the proceeds of the drafts en this check, and
Sensenlg then brought suit against Ferney
A Ce., and Mayer paid Sensenlg the amount
of the check, and then brought this suit te
recover from the bank whatever money they
may have collected en account of the check.
The delense was that the bank applied the
proceeds et the drafts te the payment of ether
debts owed by Ferney A Ce., and that the
.bank officers were never instructed te appro
priate the proceeds of the dralta te the pay
ment or the check in dispute.
BEFORE JUDOK PATTERSON.
The suit el William ShaeOer vs. Charles
Zech was attached for trial in the liwer court
room en Tuesday afteraeen. This la an issue
te ascertain. the ownership of certain property
levied en by the sheriff. The facta en the
part of the -plaintiff were that prier
te March, lbSO, Henry Wambaugh
and Jehn Hitn formed a partnership in
the bottling business. William Shaeffer, the
plaintiff, was asked te endorse them for 1200,
the price of a pair of mules, and he agreed te
de se, providing he was made safe ; and
according te his testimony the mules were te
be bis until the note waa paid. On April 3,
the firm or Wambaugh A Haln became
financially embarrassed and Wambaugh,
without consulting his partner, gave a judg
ment te Charles Zech, the delendant In the
suit, and en that judgment an execution was
Issued and the mules levied upon. Sheaffer
then came in, claimed the property and gave
bend and this Issue was framed.
The defense waa that the mules were the
property or Wambaugh & Haln, and the
judgment given by wambaugh for the firm
was an honest one for an honest debt and
that Sheaffer had no claim en the mules
The Jury rendered a verdict in favor of de
fendant. P. I). Baker for plaintiff ; B. F.
Davis and Ceyle for defendants,

Obarged Wltn a High Crime.
Samuel TUllsen, a colored man living in
the Seventh ward, was arrested en Tuesday
evening by Officer Merringer ler a serious
offense. The charge against him is assault
with intent te commit a rape en Ann Gray,
a week-minded daughter of Charlette Gray.
The offense is alleged te have been com
mitted en Saturday night, when TUllsen took
her home from an entertainment at the
theatre. She says be persuaded her te take a
walk, and when in Betz's field, near the
creek, he made the attempt, and placed his
hand ever her mouth te prevent her outcries
being beard. In default of ball he waa com
mitted for a bearing.

Frem the Times.
Mrs. Harriet Balmer, a widow, died last
evening at eight o'clock at the residence of
her son-in-law, T. W. Ntsley, 818 North
Eighth street. Deceased was in the Tlst year
ether age and had been ill about four weeks
with typhoid feverand malaria. Six chllaren
Jehn, Israel and Daniel Balmer and Mrs.
Gee. Lewis, all et Ellzabethtewn, and Dr. A.
F. Balmer, Broekvllle, and T. W. Nlsley
survive. Her remains will be burled at
Ellzabethtewn.

from his late residence, in Htrasburg, this
altarnoen and was ety largely attended.
Among these present were a number of telka
from Lancaster,and Frederick Brimmer aent
