William Shaeffer, the plaintiff, was asked te endorse them for 1200, the price of a pair of mules, and he agreed te de se, providing he was made safe ; and according te his testimony the mules were te be bis until the note waa paid. On April 3, the firm or Wambaugh A Haln became financially embarrassed and Wambaugh, without consulting his partner, gave a judg ment te Charles Zech, the delendant In the suit, and en that judgment an execution was Issued and the mules levied upon.
