It is a hopeful sign tluit,eren In the clos ing days of the session and amid the mad Btruggleef Jostling measures for precedence, the Heuse took up and passed the bill for feiting the Northern racillc railroad grant. The forfeiture runs against all the lauds unearned prier te July 4, 1S70, which in cludes the alternate sections for a distance of forty miles en each side of the read bed west of Bismarck, Dakota, te Portland, Oregon. Since the wholcsale and lavish grants of the public lands by Congress be tween 1M1 and 1S75 for net an aero lias been giren since the Democrats get con trol of the Heuse a vast change of the public mind lias been experienced upon this subject ; and the shameful misuse of the government's bounty lias come te be understood and appreciated. The building of the Pacific railroads, beneflceut as they were from one point of view, were the fruitful source of a great deal of shame and scandal. The government wu net only pillaged with high hand at the outset, but they have persistently ignored their obligations ever since and ha ve left nothing attempted in law and in the lobby te evade the payment of their just debts. The issue is well made up. The Heuse bis put itself en the ris?ht side, and if the upper branch asserts itself against the will of the people its members w ill suffer mere than deserved reproach. The friends of the oleemargarino tax law profess te be hopeful that the president will sign their bill, because it has been re ferred te the attorney general for an opinion of its constitutionally, and Mr. Garland, an old "Whig, with rather liberal ideas of governmental powers, is said net te be regarded as a strict constructionist. It is altogether likely Mr. Garland will answer the bill is constitutional; it is within the power of Congress te lay a tax en any article for revenue purposes, butter as well as oleomargarine. The case Is different in form from a bill avowedly te suppresser prohibit one industry for the benefit of another ; and the congressmen who knew the distinction recognized it when they named this bill and expressly Bought te evade it. There is a better reason than its pessible unconstitutionality for the president te veto it. This is that it Is a fraud, in pre tending te be what it is net. Although called a revenue bill, at every point of the debate in either Heuso, it was undisguised that its real purpose was te suppress an existing industry, te drive it out of compe tition with the dairy.
