An Inherent Power.
Gov. 1'attisen refuses te order a com
mission te inquire into tbe sanity of Jeseph
Tayler, the prisoner in the Eastern peni
tentiary who killed ene of the keepers. He
says that he has no authority under the
law te make such a commission, and that
recourse must behad te the brard of pardons
ferany uctien in the cenvictbeli.ilf. The
governor is doubtless right as te the lack
of express authority in the statutes
for the appointment of a commission
by him te dotermine a convict's sanity,
before he issues his death warrant. Yet
there would seem te be such authority in
the governor's oiuce because of the nature
I' Jc , f and the necessity of the case. The law can
- naruiy contemplate mat tne governor shall
' cJgn the death warrant of an insane man ;
"' , unless upon the theory of Dr. Hammend,
that the fact of the insanity of a mur
derer is an additional reason for
"f hanging him. If the governor adepts
I tills theory he may very co, sist
ently indeed refuse te interfere with the
execution of Tayler. But if he thlnksthat
he should net be hung if he is insane, he
should net sign his death warrant until he
1b satisfied of his sanity ; and he may ap

as it does net seem probable that the beard
would be se deliberately cruel, it will be

governor, unless the beard really believes

the gallows, it will surely listen te the weigty
evidence adduced as te Miller's insanity,
v vIt has no expies? power, any mere than the
governor, te appoint a commission te in
quire into his insanity; but it has the power
(implied in its duty te decide it, te ad
judicate the question of sanity. It may de
this in any way that it sees proper. There
is nothing te stand in the way of its in
forming its conscience, unless it may lie
the lack of money and the inability te
charge a debt against the state for expert
testimony. Hut this can hardly be an ob
stacle, as there is yet humanity enough left
in the world te Becure, without charge, all
the evidence needed te inform the con
science of the pardon beard as te the mental
condition of Jeseph Tayler.
The members of the beard may say that
there must be some end te the issius raised
before thorn as te the pardon of convicts.
And there is such nn end whenever it is
clear te them that a convict should or
should net be pardoned. Until then theie
isneend. Their duty is te satisfy them
selves, ana their consciences held them te
it. If they can honestly say that
they have thoroughly examined Jo Je
, fceph, Tayler's, case, and have deter
mined and still determine, upon a full
show of the evidence, that he is sane, they
need net hear further evidence ; but in this
event they will leave the ieeple te wender
of what stuff they are mnde,that the doubts
thrown ever Miller's sanity by a multitude
of witnesses have net penetrated their
minds!" and caused themAe give him the
benefit of that reasenable doubt which is
preservted te him by the law.
A Loud of Useless Hills.
The Wilkcsbarre Union Lmiler agrees
with the Intelligencer that the "real
secret of the waste of the time of our state
legislatures, the defeat of se many geed
measures and the passage of se many that
are wholly bad," is in the lack of discrimi
nation or honesty in the work of the com cem
mittees which lead the calanders up lth
se many useless bills that are introduced
merely for buncombe.
It is lamentably true that very few mem
bers in their work upon these committees
give intelligent care te the great mass of
bills laid before them. They leg-roll ameuu

up te heavily that scarcely a tenth of all

This in itself would net be a serbus evil
if it was the proper bills that steed the
best chance. Hut they tee often are bur

they block the way.
