He says that he has no authority under the law te make such a commission, and that recourse must behad te the brard of pardons ferany uctien in the cenvictbeli.ilf. The governor is doubtless right as te the lack of express authority in the statutes for the appointment of a commission by him te dotermine a convict's sanity, before he issues his death warrant. Yet there would seem te be such authority in the governor's oiuce because of the nature I' Jc , f and the necessity of the case. The members of the beard may say that there must be some end te the issius raised before thorn as te the pardon of convicts. And there is such nn end whenever it is clear te them that a convict should or should net be pardoned. Until then theie isneend. Their duty is te satisfy them selves, ana their consciences held them te it.
